Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, August 27, 2024. Present were Vice Chairman, Scott Steward, Commissioners Lee Livingston, Scott Mangold, Lloyd Thiel and Clerk Colleen Renner.
Commissioner Thiel led the audience in the pledge of allegiance.

Commissioner Steward made a motion to approve the following consent agenda items: minutes 8/6/24; payroll $734,926.93 with insurance; contracts for Special Funding; vouchers; monthly earnings and collection statements for the Clerk, Clerk of District Court, and Sheriff; out of state travel for Events Department; and allow Chair to Sign FFY2025 TANF CPI Contract, Commissioner Livingston seconded, motion carried.

Commissioners – RE: Public Hearing: Bentley Appeal
Chairwoman Overfield opened the public hearing.
Todd Bentley stated he does not understand why he was denied a building permit to add on to the present building and relocate a sign announcing the business which has been permitted for the past 8 years. I was then notified this was not allowable due to covenants on the property that states it is only for residential and recreational purposes.
Chairwoman Overfield called for public comments. Ms. Hill, Director of P&Z spoke on the shop, business and the unpermitted expansions that have taken place on the property. Ms. Hill also stated the county does not enforce covenants but does not ignore them either. Paul Berling a neighbor who lives within one mile has no objections to the business.
There being no further comments, Commissioner Livingston moved to close the public hearing, Commissioner Mangold seconded, motion carried.
Commissioner Thiel commented the highway separates the business from the rest of the subdivision and does not interfere with the covenants. Additional discussions regarding growth without permits, amending covenants to allow, working with neighbors to achieve, other businesses currently operating as a business within the subdivision, the landowner also feels covenants to be a private contract. Commissioner Mangold would like the owner to document if there is any opposition from the residents in his subdivision and see if the covenants can be addressed in a group effort. No decision was made at this time.
Jenny Cramer, Planning & Zoning – RE: Public Hearing: Pioneer Place Subdivision Preliminary Plat Review
Chairwoman Overfield opened the public hearing.
Ms. Cramer presented to the Board an application request from Rusty Blough, Morrison-Maierle for a major subdivision on behalf of Dan & Sherri Willette to approve to vacate and re-subdivide Lot 2 of Gillett MS-66 into an eight-lot subdivision consisting of 6 2.40-are lots and 2 3.50-acre lots, all for residential use.
Notices and agency referrals have been met; two neighbors made public comments in writing, and 5 of 6 neighbors voted to not fence. A Subdivision Improvements Agreement addressing applicable improvements will be required. Staff recommends approval with the ten conditions read into the record.
Chairwoman Overfield called for public comments. Jeff Baumann stated his concerns about size of acreages. Rusty Blough discussed the fencing issues and working with Shoshone Irrigation regarding the access road, and the county road right of way. Dan Willette gave comment on the fencing. Commissioner Thiel suggested the use of a cattle guard. An existing easement runs into the parcel and may affect the entrance. Mr. Blough suggests that the easement be vacated, or the plat could be amended. Chairwoman Overfield thinks that would be a legal decision.
Commissioner Mangold move to close the public hearing, Commissioner Livingston seconded motion carried.
Chairwoman Overfield suggested returning with a decision once some questions get answered.
Commissioners – RE: Park County Travel Council Board Appointment
Chairwoman Overfield stated the appointment is for the Yellowstone Park position and one application was received.
Commissioner Livingston moved to appoint Mike Keller to vacant position on the travel council, Commissioner Thiel seconded motion carried.
Commissioners – RE: Wyoming State Shooting Complex Discussion of Joint Powers Board
Chairwoman Overfield had a discussion with Attorney Skoric on the statutes that set up a joint powers board. Once a document is drafted, it could take the Attorney General 3 to 4 months to review. Commissioner Livingston made a motion to proceed, Commissioner Mangold seconded, motion carried.
Mr. Klessens stated the draft comes from the travel council, who revised their document two years ago, and will have something to the Board soon. Commissioner Thiel questioned whether the document would cover the dissolution of the joint powers board, Mr. Klessens stated that there is a dissolution clause. The committee will continue drafting the agreement, to be scrutinized later.
