Tuesday, September 3, 2024
Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, September 3, 2024. Present were Vice Chairman, Scott Steward, Commissioners Lee Livingston, Scott Mangold, Lloyd Thiel and Clerk Colleen Renner.
Ben McDonald led the audience in the pledge of allegiance.

Approve-Minutes, Payroll and Vouchers
Commissioner Livingston made a motion to approve the following consent agenda items: minutes for 8/27/24; payroll in the amount of $514,582.59; vouchers; renewed lease for Northwest Health Care; and chair to sign Malt Beverage Permit for Field of Dreams. Commissioner Steward seconded, motion carried.

Commissioners – RE: Continued Public Hearing: Mendoza Subdivision Preliminary Plat
Commissioner Thiel was not in attendance at the first part of the public hearing but has done research and feels he can be part of the discussion.
Chairwoman Overfield continued the public hearing.
Ms. Cramer gave updated information regarding a letter received stating what Mendoza’s are willing to move their subdivision forward.
Chairwoman Overfield called for public comments.
Donald Hansen spoke regarding the mistakes that have been made since the beginning with the adjacent subdivisions such as Western Hills. Cody Schatz, Engineering Associates commented on the road being placed improperly and why it is now the Mendoza’s responsibility to bring Barrows Road up to standards. Ben McDonald, Public Works stated it might be easiest to vacate the road and Thelma Mendoza commented about mistakes have taken place but believes their property rights need to be respected.
There being no further public comments Commissioner Livingston moved to close the public hearing, Commissioner Steward seconded motion carried.
After discussion on how to proceed forward in cleaning up the plat, water, access, administrative relief that was granted, Commissioner Livingston made a motion to approve as requested the 20-foot easement granted to the public and Park County, Commissioner Steward seconded, further discussions and Mr. Schatz stating they will appear again with final plat, motion carried. Commissioners – RE: Final Consideration on Perrine Appeal
Chairwoman Overfield stated the notice of violation was sent on the septic system in Powell at the end of April and does not believe the system has been replaced at this time.
Commissioner Mangold stated the septic is working and no issues have occurred at this time and the Perrine’s are working on application and fees, and the perk tests have been completed. DEQ has also stated that the system needs to be replaced.
Commissioner Thiel stated he thinks the system was put in before permits were required and is not in violation and adding clean outs is not a modification.
Commissioner Livingston stated they appealed a notice of violation and are moving forward to replace the system per DEQ requirements.
Commissioner Thiel made a motion uphold the appeal of Perrine’s for an unpermitted system, Commissioner Livingston seconded for discussion.
Clarification on upholding the appeal means they don’t have to replace their system. DEQ states they need to, and Chairwoman Overfield read the letter dated June 24, 2024, into the record.
Commissioner Steward opposed the motion and the motion carried. RESOLUTION 2024-49
Karen Horner, Library Director, Park County Library – RE: Consider Allowing Alcohol to be Served at Night at the Library Event
Barb Frances, Chairwoman for the Library Board stated that October 19 will be the “Night at the Library” event which was very successful last year and would like to once again be able to serve alcohol. Ms. Frances also introduced Marilee Ward who is also on the board.
Commissioner Mangold moved to approve the request of allowing alcohol at the event, Commissioner Steward seconded motion carried.
Park County Commissioners – RE: 307 Horse Racing Ballot Initiative
Chairwoman Overfield stated that 307 Horse Racing has requested an initiative to be placed on the November ballot to allow pari-mutual betting in Park County. The proposed resolution was read into the record. Attorney Skoric had some concerns with the wording and Statutes listed.
Commissioner Mangold questioned what the timeline on something like this was to be put on the ballot. Hans Odde, First Deputy Clerk stated we follow the certification date set by the SOS which is September 5. Commissioner Mangold is not opposed to allowing the voters to decide on the issue. Commissioner Livingston reiterated county attorney’s concerns and commented that he wasn’t in favor at this time to put it in front of the voters.
Mr. Odde stated that the statute is very vague, and the public has not had time to comment like they did on the lodging tax proposition.
Commissioner Mangold called for the question as no motion was brought forth on this issue.
