Regs public hearing

NOTICE OF PUBLIC HEARING:
UPDATED DEVELOPMENT STANDARDS AND REGULATIONS, PARK COUNTY, WYOMING
The Park County Board of Commissioners (“Board”) will conduct a public hearing at their regular meeting on Tuesday, December 1, 2026, at 6:00pm, and consider adopting the Park County, Wyoming, 2027 Development Standards and Regulations (“2027 DSR”). The meeting will be held in the Grizzly Room, located in the Park County Public Library, 1500 Heart Mountain Street, Cody, WY.
Following the adoption of an updated comprehensive land use plan in 2024, Park County adopted the 2025 Development Standards and Regulations (effective October 1, 2025) as a first step to updating and replacing the 2015 Development Standards and Regulations. The draft 2027 DSR is the second and final step in this process and is intended to replace and supersede any previous versions of the DSR. Park County is authorized by Wyoming State Statutes, as amended, to adopt these regulations pursuant to: W.S. § 9-8-301, et seq. (Local Level); W.S. § 16-3-101 et seq. (Administrative Procedure); W.S. § 18-5-201 et seq.(Planning and Zoning Commission); W.S. § 18-5-301 et seq. (Real Estate Subdivisions); W.S. § 18-5-401 et seq. (Conservation Design Process); W.S. § 18-5-501 et seq (Wind and Solar Energy Facilities); W.S. § 24-1-104 et seq; (Management and Control of County Roads); W.S. § 34-12-101 et seq. (Platting and Dedication); W.S § 35-11-301(a) (Prohibited Acts) and W.S. § 35-11-304(a) (Delegation of Authority and (iii) Establishment of Rules). Further, Park County is authorized to regulate development in special flood hazard areas (SFHAs) as part of the National Flood Insurance Program (NFIP) according to the U.S. Code (U.S.C.) Title 42 § 4001 et seq., and Code of Federal Regulations (CFR), Title 44, Chapter I, Subchapter B, Part 60, Subpart A.
The Board hired a consultant, Logan Simpson, to lead the County and public through the update process. Logan Simpson prepared a draft DSR and draft zoning map, each of which have been evaluated by County staff, the Planning and Zoning Commission (“P&Z Commission”) and the Board. The entirety of the regulations has been reformatted, reorganized and rewritten and the official zoning map of the county revised. The 2027 DSR meets the minimum substantive requirements of state statute and promotes the public health, safety, morals and general welfare of the County. The Park County Road and Bridge Standards (“RBS”) are being removed from the DSR, and the Board is considering adopting an updated, standalone version of the RBS concurrent with the review of the 2027 DSR.
The P&Z Commission certified approval of the 2027 DSR by resolution with recommended modifications at special meetings on September 23, 2026 (Resolution 2026-32), and October 5, 2026 (Resolution 2026-33). The Board received the P&Z Commission’s recommendations at their regular meeting on October 6, 2026, and announced their intent to release the P&Z Commission’s recommendations and redlined adoption draft of the DSR for a minimum of forty-five (45) days. The culmination of the review period will be the public hearing identified in this notice.
A copy of the proposed adoption draft is available for public inspection at the following locations: Board of County Commissioners’ Office and Planning & Zoning Department (1002 Sheridan Ave, Cody); County libraries in Powell (217 E. 3rd St.), Cody (1500 Heart Mtn. Park County has complied with the requirements of W.S. § 9-5-304 and interested persons may obtain a copy of the assessment used to evaluate the proposed rule pursuant to W.S. 9-5-304 at each location where a copy of the proposed rule is available for public inspection.
