AN ORDINANCE ANNEXING CERTAIN REAL PROPERTY
KNOWN AS THE JONES STREET ANNEXATION.
​​​​​​​​​​​​WHEREAS, there has been filed with the City Clerk of the City of Powell, a written Petition seeking the annexation of the territory described in said Petition, referred to as Jones Street Annexation and being a parcel of land located within a portion of Tract 1 of Lot 74, more particularly described as follows:
A PARCEL OF LAND WITHIN THOSE LANDS DESCRIBED BY THAT QUITCLAIM DEED RECORDED AS DOCUMENT #2007-2303 AND BY THAT PATENT RECORDED AS BOOK 292 AT PAGE 486 IN THE OFFICE OF THE PARK COUNTY CLERK, BEING WITHIN TRACT 1 OF LOT 74, TOWNSHIP 55 NORTH, RANGE 99 WEST, 6TH P.M., PARK COUNTY, WYOMING, SAID PARCEL BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING AT A CORNER ON THE WEST BOUNDARY OF HOMESTEADER PARK ADDITION TO THE CITY OF POWELL AS FILED IN PLAT CABINET “D” AT PAGE 56 IN SAID CLERK’S OFFICE, BEING ON THE WEST LINE OF SAID TRACT 1 OF LOT 74, LOCATED S.00°02’W., 1048.9 FEET FROM THE NORTHWEST CORNER OF SAID TRACT 1;
THENCE ON AND ALONG THE WESTERLY LINE OF SAID HOMESTEADER PARK ADDITION, S.20°06’E., 375.31 FEET, MORE OR LESS, TO THE SOUTH LINE OF SAID LANDS DESCRIBED IN DOCUMENT #2007-2303;
THENCE ON AND ALONG SAID SOUTH LINE, N.89°58’40”W., 129.18 FEET, MORE OR LESS, TO THE WEST LINE OF SAID TRACT 1 OF LOT 74;
THENCE ON AND ALONG SAID WEST LINE, N.00°02’E., 352.40 FEET, MORE OR LESS, TO THE POINT OF BEGINNING;
SAID PARCEL CONTAINS 0.52 ACRES, MORE OR LESS.
​WHEREAS, the Governing Body has specifically found that the subject real property meets the following criteria, to-wit:
​1. The annexation of the area is for the protection of the health, safety and welfare of the persons residing and/or to be residing in the area and in the City;
​2. The Urban Development of the area sought to be annexed would constitute a natural, geographical, economical and social part of the annexing City;
​3. The area sought to be annexed is a logical and feasible addition to the annexing City and the extension of basic and other services customarily available to residents of the City can reasonably be furnished to the area proposed to be annexed;
​4. The area sought to be annexed is contiguous with or adjacent to the annexing City, and
​WHEREAS, pursuant to Wyoming Statute 15-1-407, the annexed property is solely owned by the City of Powell and therefore no public hearings were held by the governing body of the City of Powell. The Planning and Zoning Commission has recommended the subject property to be annexed be designated and zoned as follows: RM – Residential Mixed Used District, as per Chapter 17.32 of the Powell Municipal Code.
​NOW, THEREFORE, it is hereby ordained by the Governing Body of the City of Powell, Park County, Wyoming as follows:
​SECTION 1. There is hereby annexed to the City of Powell, Park County, Wyoming, the following described real property known as the Jones Street Annexation, which real property is located in the County of Park, State of Wyoming, and more particularly described upon Exhibit “A” attached hereto and by this reference incorporated herein, as shown on a plat thereof, accepted and approved by the Governing Body of the City of Powell.
​SECTION 2. Said property is hereby designated and zoned as RM- Residential Mixed Use District, as per Chapter 17.32 of the Powell Municipal Code, and shall be used accordingly.
​SECTION 3. This ordinance shall be in full force and effect upon adoption and publication as required by law.
