Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, June 18, 2024. Present were Vice Chairman, Scott Steward, Commissioners Lee Livingston, Scott Mangold, Lloyd Thiel and Clerk Colleen Renner.
Kelly Simone led the audience in the pledge of allegiance.

Commissioner Thiel made a motion to approve the following consent agenda items as presented: minutes 6/4/24; payroll $493,737.21 for employees and Elected pay at $102,401.09; vouchers; monthly Earnings & Collection Statements for Clerk, Clerk of District Court and Sheriff; approve and sign lease renewal for Ragain & Clark; Public Health Contract; allow Chair to sign letter for Crisis Intervention Services; TANF/CPI Grant Final Application FFY2025; WellPath Amended Contract; Wyoming State Library Additional Grant Request. Commissioner Livingston seconded and the motion carried.

Kari Smith, Clerk’s Office – RE: Public Hearing: Liquor License Renewals
Chairwoman Overfield opened the public hearing.
Ms. Smith presented the renewal for liquor licenses in Park County. All licenses will be renewed July 25, 2024, through July 24, 2025, except for DAC LLC dba Mountain Liquor will be parked until the entity comes into compliance. All license holders are in good standing, current sales taxes paid, and all other requirements have been met.
Chairwoman Overfield called for public comments, there being none, Commissioner Mangold made a motion to close the public hearing, Commissioner Livingston seconded motion carried.
Commissioner Livingston made a motion approve all licenses except DAC LLC and Wood River Ranch and consider those separately, Commissioner Mangold seconded, motion carried.
Commissioner Livingston moved to park DAC LLC until the building and location are finished, Commissioner Thiel seconded, motion carried.
Commissioner Livingston made a motion to approve Wood River Ranch LLC, Commissioner Mangold seconded, motion carried. Commissioner Steward recused himself due to a conflict.
Lorilyn Beck, Globe Life Family Heritage Division – RE: Introduction and Updates
Ms. Beck presented her product as an option for county employee participation and how she feels it could benefit them. Mangold suggested an informational email be sent to all employees.
Commissioners – RE: Museum Board Appointments
Chairwoman Overfield stated the two applications received were from the incumbents Patra Lindenthal and Rebekah Childers.
Commissioner Livingston made a motion to reappoint Rebekah Childers and Patra Lindenthal to the museum board Commissioner Thiel seconded, motion carried.
Commissioners – RE: Library Board Interview
Sharon Smith was interviewed for the opened position.
Brian Edwards, Engineer, Public Works Department – RE: Open Sealed Bids for Contract 1- Construction of Phase 2 Waste Disposal Area and Related Site Improvements at Cody Landfill
Mr. Edwards stated this is the beginning of Phase 2 for the Landfill to prepare the next cell and Contract 1 is for construction. There was one bid received from Nicholson Dirt Contracting in the amount of $1,108,668.00 with alternatives offered.
Brian Edwards, Engineer, Public Works Department – RE: Open Sealed Bids for Contract 2- Geosynthetics Supply and Installation for Phase 2 Waste Disposal Area at Cody Landfill
Mr. Edwards stated this is the beginning of Phase 2 for the Landfill to prepare the next cell and Contract 2 is for geosynthetics supplies and installation. There were eight bids received.

Mr. Edwards stated qualifications and references will all be verified, and staff will return later today to make the recommendations and show comparisons.
Commissioners – RE: Library Board Interview
Patty Kearnes, Jennisen Lucas and Tammy Jackson were interviewed for the opened position.
Chairwoman Overfield stated no incumbents applied and the open positions are for one each in Cody and Powell.
Commissioner Livingston made a motion to appoint Patricia Kearnes for the Powell position, Commissioner Thiel seconded. Motion carried.
Commissioner Thiel made a motion to appoint Tammy Jackson for the Cody position, Commissioner Livingston seconded and stated all were good applicants, motion carried.
Cody Beers, WYDOT Public Relations Specialist – RE: Annual STIP Meeting
Mr. Beers provided an update on projects such as the signal on Blackburn is complete, the crossing at Roberts Street is moving forward which is in final design and construction. More information on this project can be found on the City of Cody website. Intersection of 2 AB and Hwy 14, Beartooth Hwy and parking at Hwy 296 are also being considered for improvements.
Pete Hallsten presented the State Transportation Improvement Program (STIP) which includes the primary purpose for safe and effective transportation, strategic objectives, guiding principles, road map, mission, vision, values and an overview with cost escalations. Mr. Hallsten showed the STIP process overview and project map.
There was then open discussion on Hayden Arch Bridge west of Cody, stretch of Hwy past Sulphur Creek, west strip, crossing light by City Park obstructed by tree, flooding west of Cody, Meeteetse with regards to boardwalk and meeting ADA with the upgrade through town, and finished with several projects that have been delayed.
Commissioners – RE: Continued Public Hearing: Perrine Appeal
Chairwoman Overfield continued the public hearing for the Perrine appeal.
Commissioner Livingston stated the easement issue is a civil issue and questioned if the system has ever been moved.
Ms. Hill spoke with DEQ in what the county role is, Department of Health was the permitting authority in 1921 and that the system needs to be brought to current standards. If a permit existed, it was through Department of Health. The system spans both properties and bubbles are a sign of leakage. Commissioner Overfield stated the system did not cross survey line in 2001.
Commissioner Thiel stated he will not recuse himself as he has nothing personal to gain, and that Cooley and Andrade need to work this out with no violation at this time.
Commissioner Mangold stated he felt a new system should be put in place.
Commissioner Overfield called for public comments. Ms. Andrade stated once the new system is in place, she would allow then to decommission the system. Ms. Andrade also questioned why the Board is challenging the expertise provided by staff, the appellant was also told about funding and grants for new systems. Ms. Andrade stated she felt they have been given plenty of evidence That the system has failed, and needs replaced.
There being no further public comments, Commissioner Thiel made a motion to close the public hearing, Commissioner Mangold seconded, motion carried.
Chairwoman Overfield stated Perrine received a letter of violation and action or penalty is what is being appealed. Ms. Hill stated you don’t have to have affluent on the surface to show failings and the system must be brought to today’s standard. That any type of repair is considered a modification and would require permitting.
Commissioner Thiel made a motion to approve the appeal, Commissioner Mangold seconded but stated the this needs to be taken care of you must come up with a septic system that is adequate, Commissioner Mangold asked to amend the motion to include an August 30 deadline to have a new system in place, Commissioner Thiel did not accept the amendment as they may be able to get the system pumped which could solve the problem and put off a new system for a year. Commissioner Mangold & Thiel voted eye, Commissioner Livingston and Steward opposed Chairwoman Overfield also opposed, motion died.
Commissioner Mangold made a motion to put off the violation until August 30 and revisit at that time, Commissioner Livingston seconded, motion carried.
Brian Edwards, Engineer, Public Works Department – RE: Recommend Award of Construction Contracts #1 and #2 For Phase 2 Waste Disposal Area and Related Site Improvements At Cody Landfill with Chair to Sign Agreement Pending County Attorney review.
Mr. Edwards returned to recommend Nicholson Dirt with the base price of $1,108,668.00. Required bid documents were presented and complete. Four options for deductions were looked at and recommend the Board accept A1, A3 and A4 alternatives in the amount of $36,000 leaving a total of $1,072,668. Commissioner Steward moved to approve as stated by Engineer and remove the $36,000, Commissioner Livingston seconded, motion carried.
Mr. Edwards stated that there were 8 bids received which were very close in price. Documentation was looked at; references were called, and all were out of state bids. Staff recommends Patriot Environmental, Meeker OK who can meet the schedule and bid $841,703.67. Commissioner Livingston moved to accept the Engineer’s recommendation, Commissioner Mangold seconded, motion carried.
