As Dr. Larry Akin prepared to sell his former dental office on North Bernard Street, he discovered a problem: It turned out that the back portion of his building was technically on his neighbor’s property.
Akin’s former clinic and the neighboring apartment building owned by Will Ambrose are both believed to have been built back in 1935. However, it appears that at some point, the lot was split improperly, as Akin’s building spills over the property line by about 3 feet.
But for decades, no one noticed.
“From what we can find through our research, his [Ambrose’s] apartments have been sold four times without anybody ever surveying, engineering, even looking,” Akin told the Powell Planning and Zoning Commission in January. “And from what I can see, the building that I presently own has been sold four times without anybody doing the same.
“And at some point somebody’s got to make it right,” Akin said.
Ambrose agreed to a lot line adjustment that enlarges Akin’s parcel and shrinks his own to accommodate the trespassing building, and the Powell City Council approved the change at its Feb. 17 meeting.
That should clear up the issue and pave the way for a sale.
