Suspect in Cody woman’s disappearance takes plea deal

Agreement solely relates to gun, ammo charges

A Cody man who’s been named as a suspect in the disappearance of his ex-girlfriend has reached an agreement with federal prosecutors on pending gun and ammo charges, though the details have yet to be publicy disclosed.

Adam S. Aviles Jr., 27, was arrested in early November, after the Park County Sheriff’s Office found bullet holes and numerous blood-stained items inside his SUV.

Aviles’ former girlfriend, 33-year-old Katie Ferguson of Cody, was last seen inside the vehicle on Oct. 5 in Trumann, Arkansas. At the time, the couple and their two children had been traveling from Alabama to Cody, but only Aviles and the children made it back to Cody; when authorities questioned Aviles in early November, he reportedly said Ferguson wasn’t missing and was just avoiding her family. Days later, he preemptively turned himself into Park County Sheriff’s Office and invoked his right to remain silent.

Public statements indicate authorities have been treating Ferguson’s disappearance as a homicide and Aviles as a suspect. However, the only charges that have been filed against Aviles to date relate to allegations that he illegally possessed a Glock Model 41 .45 caliber handgun and .45 caliber ammunition despite a prior felony conviction. Charging documents indicate that officers found a fully loaded magazine inside Aviles’ SUV. Like several other items in the vehicle, the magazine had blood on it, and officers noted several .45 caliber-sized bullet holes in the vehicle.

Aviles was set to be tried on the gun and ammo charges starting next week in Cheyenne, but on Friday, the U.S. Attorney's Office and Aviles’ court-appointed defense attorney informed the court they had reached an agreement.

The specifics of the plea deal have yet to be made public, as the U.S. District Court in Wyoming chooses to seal those documents. A spokeswoman for prosecutors also declined to comment on the deal, saying the U.S. Attorney’s Office “does not typically release information on plea agreements.”

Aviles’ attorney, David Weiss, said in a filing last month that the parties were discussing a plea deal that would be contingent on Aviles abandoning any efforts to suppress evidence against him. The motion didn’t say what evidence the defense might have sought to suppress.

Weiss’ motion to delay some of the deadlines in the case came partially in response to prosecutors adding the illegal gun possession charge. The office’s superseding indictment alleges Aviles possessed the Glock between Aug. 14 and Nov. 8 — the day he turned himself in.

Between the new gun charge and the ammo charge first filed in November, Aviles could face anywhere from zero to 30 years of prison time. 

Beyond the federal case in Wyoming, Weiss has indicated that authorities continue to investigate Aviles in connection with Ferguson’s disappearance, writing that Aviles “is a suspect in a homicide case” that’s being investigated in another state. 

In early March, Weiss indicated prosecutors might make a decision on whether to charge Aviles in connection with the homicide investigation “in the coming weeks.” More than three months later, no such charges appear to have been filed.

In a post made to a missing person’s Facebook group on Friday, Ferguson’s mother, Mona Hartling, wrote that Ferguson remains missing and that law enforcement agencies continue to search for her in Arkansas. Hartling shared a missing poster that describes Ferguson and the circumstances of her disappearance.

“Please keep sharing,” Hartling wrote, “our family is broken.”

Aviles will remain in federal custody while he awaits further proceedings in his case.
