Park County man arrested after domestic dispute involving firearm in Powell

Cody resident Arturo Brown is currently being held in the Park County Detention Center on felony charges of possessing a deadly weapon and convicted felon in possession of a firearm.

Brown was originally arrested on Aug. 14 on charges of aggravated assault with a firearm, domestic battery and property destruction, according to the affidavit written by Powell Police Department Sergeant Dustin Del Biaggio. 

According to the affidavit, Powell police responded to an incident on North Bent Street at approximately 7:51 a.m. where someone was reportedly trying to kick down an apartment door. 

After speaking to the occupants, the man was identified as Arturo Brown. Brown had allegedly been in a dispute with the resident, who will be referred to as JB, who Arturo was in a recent relationship with. Her friend JF was also present.

According to the affidavit, Brown entered the apartment and began arguing with JB and JF. After they all exited the apartment, Brown punched JB in the neck. Brown later walked to his vehicle and returned with his hand in his shirt, JF believed Brown was concealing a firearm and ran inside the apartment. Brown kicked the door multiple times and left a 4-foot long crack and visible footprints on the door. Del Biaggio and Officer Paul Sapp searched the area but were unable to locate Brown.

Brown arrived at the law enforcement center later that morning of his own accord, and claimed that he had been invited back to the apartment. When he arrived at the apartment he said he was attacked by two young men. 

According to JB and JF, Brown, got into an altercation with both JF and JB during which point he pulled a gun on JF and had hit both JB and JF with a chair. The gun was taken from Brown and unloaded by JF. The weapon was later handed over to Del Biaggio and Sapp.

Brown was driven from Cody to the apartment by a friend, Brown took his friend’s gun without his knowledge upon arriving at the apartment. This was consistent in both Brown and JB and JF’s series of events. JF told Del Biaggio and Sapp that Brown’s friend was not involved in the altercation.

“Arturo could not or would not tell me why he took the gun with him,” Del Biaggio said in the affidavit. 

Del Biaggio noted in a second affidavit that the series of events in the altercation according to JB and JF  held some contradictions that could potentially be attributed to both Del Biaggio and Sapp asking separate questions. JF said that he was “having difficulty recalling the events due to the gravity of the situation.”

Upon inspection of the scene JF and JB’s account was consistent with what officers observed at the scene.

In the second affidavit Del Biaggio notes that he later found out Brown has two felony convictions  from March 24, 1998 in Florida: a third degree felony charge of battery on a police officer, firefighter or EMT and a felony charge of resisting an officer with violence.

Brown is currently held on $50,000  bond; a preliminary hearing has not yet been set.
