Tuesday, May 19, 2020
Chairman Tilden called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, May 19, 2020. Present were Vice Chairman, Lee Livingston, Commissioners, Dossie Overfield, Jake Fulkerson, Lloyd Thiel, and Clerk Colleen Renner.
Commissioner Livingston led the audience in the Pledge of Allegiance.
Consent Items:
Approve-Minutes, Payroll and Vouchers
Chairman Tilden added the MOU for the Coroners Building with the City of Cody to the agenda for discussion. Commissioner Thiel made a motion to approve the following consent agenda items: minutes from May 5, bi-weekly payroll in the amount of $392,663.43, vouchers, monthly earnings and collection statements for the Clerk, Clerk of District Court, and Sheriff, Chairman Sign Companion Life Insurance Company for Aggregate and Specific Excess Loss Insurance Application, Sign WY FLAP 6WX (1) Southfork Road FHWA Agreement No: 6982AF-18-K-500020, Modification #002 Between Federal Highway Administration and Park County, and the additional item, Commissioner Livingston seconded and the motion carried.

Park County Commissioners – RE:
• Approve and Allow Chairman to Sign Grant Recipient Agreement between Wyoming Game and Fish Commission and Park County for $2,400.00 – Mr. Pomajzl presented the agreement which stated that the FY18-19 was never paid for their special funding, but the States records showed we did pay but have not paid for the FY19-20. The agreement was for the FY19-20 and FY20-21 which Commissioner Livingston was not in favor of them keeping the payment until decisions are made for the next fiscal year. Ms. Kohn will contact WY Game & Fish to come and present before the board.
• Discussion on Further Opening of Park County Courthouse
Chairman Tilden questioned if the Commissioners had concerns about the Courthouse opening to the public. Commissioner Thiel felt that each department should proceed with their comfort levels. The courthouse will proceed with opening.
Park County Clerk, Colleen Renner – RE: Park County Election Polling Place Report
Clerk Renner reported on the directives from Secretary of State asking clerks to decrease the number of polling places within the county. The Elections department will be moving the Southfork Fire Hall, Wapiti School/Yellowstone National Park, and Valley to the Cody Rec Center, and Garland Church, Heart Mountain View Clubhouse and Clark Recreation Center to the Powell Fairgrounds, Heart Mountain Building.
Park County Planning & Zoning Director, Joy Hill – RE: Public Hearing: Continuance of the Wyoming Game & Fish Flood Plain Permit
Ms. Hill presented the request for another continuance to July 21, 2020 at 9:45 a.m. Commissioner Livingston made a motion to allow continuing the hearing, Commissioner Thiel seconded, and motion carried.
Park County Commissioners – RE: Approve Dollar Amount to Applicants of the 2021 TANF Award Funding - $61,250.00
Ms. Kohn stated the TANF Award Funding is down from last year and presented scenarios. Commissioner Overfield made a motion to approve the entities on the percent basis of what was awarded, Commissioner Livingston seconded, and motion carried.
The Commissioners heard testimony from the Special Funding Entities who receive funding from Park County.

Park County Planning & Zoning Planner II, Kim Dillivan – RE: Three Sister Final Plat MS-34
Mr. Dillivan presented the final plat for 3 Sisters MS-34 for approval. Applicants are Russ & Diane Whitlock with an address of 26 Jody Lane. A public hearing is not required, and no public comments have been received. Mr. Dillivan stated the three outstanding conditions have been met. Commissioner Fulkerson made a motion to approve the final plat as presented, Commissioner Thiel seconded, and motion carried. RESOLUTION 2020-21
Park County Engineer, Brian Edwards – RE: Park County Coroner’s Building Project Preliminary Pricing, Trimming Items and Guaranteed Maximum Amount
Mr. Edwards reported on the meeting with Filener Construction. The preliminary pricing has come in higher than expected so the internal group looked at possible ways to reduce costs. After discussion, Mr. Edwards stated unless we add scope to the project their price is locked, we share in that value engineering and share in savings.
Commissioner Fulkerson made a motion to go with recommendations presented not to exceed $500,000 and allow the chair to sign, Commissioner Thiel seconded, and motion carried.
Memorandum of Understanding & Lease Agreement with City of Cody and Park County
Chairman Tilden stated this MOU allows the County to build the Coroner’s building on the property that the Law Enforcement Center is currently located on. Commissioner Livingston made a motion to approve and allow the chair to sign, Commissioner Overfield seconded, and motion carried.
Executive Session.
Commissioner Livingston made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (vii), Commissioner Thiel seconded, and motion carried.
Commissioner Livingston moved to exit from executive session, Commissioner Fulkerson seconded, and the motion carried. No decisions were made in or as a result of the executive session.
