Regular Meeting
Tuesday, March 7, 2023Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, March 7, 2023. Present were Vice Chairman, Lloyd Thiel, Commissioners Lee Livingston, Scott Mangold, Scott Steward and Clerk Colleen Renner.
Molly Nordberg led the audience in the pledge of allegiance.

Approve-Minutes, Payroll and Vouchers
Commissioner Livingston made a motion to approve the following consent agenda items with the addition of a letter being sent to BLM stating our interest in becoming a cooperating agency; minutes from February 21, 2023; payroll of $476,257.33 and Elected payroll for $102,045.29; vouchers; approve and allow Chair to Sign Petitions for Inclusion for Northwest Rural Water District; Lease Addendum for Cody Pardners at Park County Complex; Commissioner Thiel seconded, and the motion carried.

Kim Dillivan, Planning & Zoning – RE: Public Hearing: Deer Creek Ranch FP 1-23
Chairwoman Overfield opened the public hearing.
Mr. Dillivan presented the application requesting approval to complete an upland restoration and streambank protection project for 525 feet of the west bank of the South Fork of the Shoshone River 38 miles southwest of Cody. The plan is to restore uplands lost to pre-flood dimensions using dredged material and riprap to provide bank protection. Fifteen hundred cubic yards of material will be removed from the channel to rebuild the upland area and 850 cubic yards of riprap will be used to stabilize the restored bank. Public notices and agency responses have been met and received.
Provisions for approval or denial were read into the record along with staff recommendations of approval.
Chairwoman Overfield called for public comments.
Travis Conklin, Engineering Associates updated the board with the conversation he had with Kevin Little, U.S. Army Corps of Engineers who has spoken with Game & Fish regarding their concerns.
Laura Burkhart, Wyoming Game & Fish expressed her concerns in a letter to the Board, but the Army Corp has since addressed the concerns.
There being no further comments, Commissioner Mangold made a motion to close the public hearing, Commissioner Steward seconded, motion carried.
Commissioner Livingston moved to improve the flood plain permit with conditions as presented, Commissioner Thiel seconded, motion carried. RESOLUTION 2023-13
Joy Hill, Planning Director – RE: Public Hearing: Hawkeye Ranch FP 6-22
Ms. Hill presented the amendment for Permit #6-22 to add activity and materials to this permit addressing the concerns of the Wyoming Game and Fish per Resolution 2022-107. The location is 36 miles southwest of Cody. Notices and agency referrals have been met. Staff recommends approval with conditions which were read into the record.
Chairwoman Overfield called for public comments.
Commissioner Thiel questioned where materials will be hauled from. Travis Conklin stated where the materials will come from and who would be delivering the product.
There being no further comments, Commissioner Livingston made a motion to close the public hearing, Commissioner Mangold seconded, motion carried.
Commissioner Mangold moved to approve with conditions from staff Commissioner Livingston seconded, motion carried. RESOLUTION 2023-14
Commissioners – RE: Board Liaison Updates
Commissioner Mangold reported on the Fair board, Rec Board and PEP.
Commissioner Steward had no report.
Commissioner Thiel reported on Meeteetse Visitor Center, Meeteetse Planning area, Urban Systems for Powell, Predatory Animal Board, Weed & Pest Board. Commissioner Thiel would like to see a meeting in the future with the Forest Service for an update.
Commissioner Livingston reported on his time in Cheyenne, Travel Council and Drug Court.
Chairwoman Overfield reported on Library Board, Museum Board, Forward Cody, and Urban Systems for Cody.
Josh Shorb, Park County Weed & Pest – RE: Annual Report
Mr. Shorb gave an overview of the overall program and included the annual report. Mr. Shorb discussed the weed control plan for the county including prevention, control, monitoring, and education. Mr. Shorb also addressed information regarding board members, full time employees and the programs and services that are funded by 1 mil. available through Weed and Pest. The Board had several questions and thanked Mr. Shorb for the partnership.
Commissioners – RE: Predator Board Interview with Harry G. Longobardi
Kristin Fong, Northwest Regional Director, Wyoming Business Council – RE: Business Council Updates
Ms. Fong updated the Board on the Meeteetse Community Center grant for $750,000 and the Cody Legacy Meats project for expansion. Ms. Fong is working on a class through Harvard School on government economic policy and procedure and collaboration within the state. Leadership Academy partnership with Leadership Wyoming whose first class will be held in June in Park County.

Decision on Predator Board
After discussions Commissioner Livingston moved to appoint Jim Shorb for the sportsman position to the Predator Board, Commissioner Thiel seconded, motion carried.
Commissioners – RE: Park County Travel Council Board Appointments
Chairwoman Overfield stated two applications were received and both are current members.
Commissioner Mangold made a motion to appoint Michael Darby and Richard Hoeninghausen to the Travel Council, Commissioner Livingston seconded, motion carried.
Park County Commissioners – RE: ARPA Funds Discussion
Chairwoman Overfield explained that there are two pots of money which we will refer to as COVID dollars and GENERAL fund dollars.
The COVID funds of $5,670,592 must be appropriated by 2024 and spent by 2026. The GENERAL fund dollars will total $12 million once the full amount is received.
There have been projects approved and current requests waiting approval with regards to both pots of money.
After further discussions Commissioner Livingston moved to approve the updated request for the Meeteetse Community Center in the amount of $168,400 out of the COVID funds, Commissioner Mangold seconded, motion carried.
Powell Clarks Fork Conservation District requested funds for updating equipment used for water quality sampling. Commissioner Thiel moved to approve the $24,700 request from the GENERAL funds, Commissioner Livingston seconded, discussions on which fund and Commissioner Thiel amended the motion for the dollars to come out of COVID funds, motion carried.
Cody Conservation District requested $15,000 for a mail ballot election on the 1 mil question. The request also included an additional $67,000 to cover wages while seeking and writing grant applications. After discussion Commissioner Mangold moved to approve the $67,000 out of the GENERAL funds, Commissioner Thiel seconded, motion carried.
Projects that would be eligible for the GENERAL fund money were further discussed. Commissioner Mangold moved to approve $1.2 million from the GENERAL fund pot for additional gravel from the three county pits, Commissioner Livingston seconded, motion carried.
Commissioner Mangold moved to approve $50,000 for the purchase of new voting booths for the Elections department out of the COVID funds, Commissioner Livingston seconded, motion carried.
Commissioner Thiel made a motion to proceed with placing a new cistern at the Powell Road & Bridge shop out of COVID funds, Commissioner Mangold seconded, motion carried.
Chairman Overfield thanked Mr. Pomajzl for putting the spreadsheets together.
