Chairman Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, March 15, 2022. Present were Vice Chairman, Scott Mangold, Commissioners Lloyd Thiel, Joe Tilden and First Deputy Clerk Hans Odde. Commissioner Lee Livingston was absent.
Molly Norberg led the audience in the Pledge of Allegiance.

Re: Introduction & Park County’s growth and progress updates
Ms. Fong introduced herself as the new Northwest Regional Director for the Wyoming Business Council and reported to the Commissioners some of the issues and programs she is working on in the four-county region.

Re: Public Hearing- The Saddle Salon SUP-228
Chairman Overfield opened a public hearing for a Special Use Permit application from the owner of the Saddle Salon, Charity Haukaas, a commercial custom leather restoration business at 10 Shultz Dr. Ms. Haukaas will be leasing a portion of a shop on the property that is owned by Denise Fink who has also signed the application. Legal notices were published and notices to area neighbors were mailed, and no public comments have been received. Ms. Haukaas and Ms. Fink both spoke on their own behalf advocating for approval of the SUP.
Hearing no further comment Commissioner Tilden made a motion to close the public hearing. Commissioner Mangold seconded and the motion carried.

Re: Public Hearing- Skip’s Auto SUP-230
Chairman Overfield opened a public hearing for a Special Use Permit application from Larry J. Hart the owner of the property where Skip’s Auto is located at 397 Lane 13. Planning & Zoning Department staff discovered that Skip’s Auto and Diesel was
29 operating as a business without a permit. According to the applicant, this auto repair business has been in operation since 2015. After meeting with the applicant’s nephew, Skip Hart, about the use, the Planning and Zoning Department classified the use as a major commercial business. Major commercial business uses are not allowed in the GR-P zoning district. At the time, no formal notice of violation had been issued to the property owner. The applicant is working towards compliance through this application process. As a condition for approval the owner will be required to have a WYDOT approved access to the property from State Highway 295 to which an application has been made. Representing the Hart’s, Engineer, Scott Lewis stated that he is in contact with WYDOT and working through their application process to gain access approval. Skip Hart thanked the commissioners and the planning staff for helping them through the process of coming into compliance.
Hearing no further comment Commissioner Tilden made a motion to close the public hearing. Commissioner Mangold seconded and the motion carried.

Re: Public Hearing- Good SUP-227
Chairman Overfield opened a public hearing for a Special Use Permit application from Christopher and Miria Good to operate a fireworks storage and distribution business in an existing shop building and residence at 127 US HWY 14A, and in addition up to 40 storage containers. P&Z staff witnessed advertising of commercial fireworks sales on this property in April of 2021; Staff issued a Notice of Violation on May 3, 2021 to address the unpermitted business and unpermitted structures (storage containers) on the property, and several communications with the landowners and their attorney followed; The applicants submitted a Variance Request Application to bring their property into compliance; On August 17, 2021 the Board of County Commissioners approved a variance request to allow the applicants the opportunity to apply for a Special Use Permit to establish a major wholesale business. The State Fire Marshal has inspected the property and structures and found them to be in compliance with regulations. Staff is recommending approval with conditions including a minimum set back of 100 feet for storage containers from the property boundary and residential structure and that there be no more than 20 containers stored on the property. Good’s representative, Colin Simpson proposed a 50-foot setback as the State Fire Regulations state that a 10-foot setback is sufficient and the proposed 100-foot setback appears to be regulation creep.
Hearing no further comment Commissioner Thiel made a motion to close the public hearing. Commissioner Tilden seconded and the motion carried.
Commissioner Thiel made a motion to approve SUP-227 striking conditions 4 regarding the number of containers and 5 regarding the 100-foot setback. Commissioner Mangold seconded. Commissioner Tilden asked if Commissioner Thiel would consider the compromise 50-foot setback and Commissioner Thiel wanted Good’s to follow the State Fire Regulations setback of 10 feet. Commissioner Tilden offered a friendly amendment to impose the setback at 50 feet, Commissioner Thiel agreed, and the motion carried. RESOLUTION 2022-29
Park County Planning & Zoning, Kim Dillivan
Re: Double T SS-283 Final Plat
A Final Plat Application, signed by Brian Tashiro requests approval of the final plat for a subdivision comprised of one 17.23-acre lot and one 28.23-acre lot for residential use, the existing parcel is 45.47 acres at 27 Whitney Drive and bisected by CR 6WX. Using lot size averaging, the lot sizes proposed are consistent with the General Rural 20-Acre (GR-20) zoning district. The Planning Staff recommends approval of the Final Plat of Double T SS-283 and the applicant shall otherwise comply with standards in the Park County Development Regulations and the minimum subdivision requirements as set forth in Wyoming Statute 18-5-306. Comments from Wyoming Game and Fish regarding the proposed subdivision being entirely within critical mule deer winter range were brought up and expressed as a concern by commissioners as well as members of the public. Alan Rosenbaum and Steve Devenyns both had concerns about the steep hill on the proposed south parcel being developed because of ice flow in the winter and significant sloughing of the hill as well as the mule deer winter range issue. Commissioner Tilden mentioned that development of the south parcel would be taken into consideration if a building permit were ever applied for, while Chairman Overfield questioned whether there is enough room at the top of the hill to feasibly develop. Engineer, Cody Schatz mentioned that there is no access to the parcel from Cattle Drive so if development were to ever happen on the south parcel, south of the Southfork Road, a road would have to be built up the steep slope.
Chairman Overfield asked that this decision be postponed gathering more information and Commissioner Mangold made a motion to table a decision of Double T SS-283 Final Plat. Commissioner Thiel seconded and the motion carried.
Cody Conservation District
Re: Primary Election Ballot for a Mill Levy
Cody Conservation District Chairman Russ Dwyer reported that an agreement has been reached with the State Department of Agriculture and the Teton County Conservation district to realign their boundaries through Yellowstone National Park so that it will now follow the Park/Teton County line so the northern area of the park will be included in the Cody Conservation District.
Next Chairman Dwyer presented the Commission a request to place a mill levy question on the primary ballot in August of 2022.
Commissioner Tilden made a motion instructing the County Clerk to place a question on the primary election ballot asking voters to vote for or against a levy of one mill to be assessed on all property within the Cody Conservation District boundary. Commissioner Mangold seconded and the motion carried.
Next Chairman Dwyer requested the Commissioners consider a funding request of $1000 for educational materials that would inform the community what the Conservation District’s function is. After discussion the District will come back with a more formal request on April 5th.
Park County Homeland Security Director, Jeff Martin
Re: Homeland Security Grants and Region 6 Plan
Director Martin presented three grant agreements for the Commissioner’s consideration; Director’s salary grant for $48,500 which is 50/50 split with the county, equipment grant for a power monitoring unit for the Powell Fairgrounds $5,800 and electronic keypads for doors in the EOC building $36,945.75.
Commissioner Thiel made a motion to approve all three grant submissions as presented. Commissioner Tilden seconded and the motion carried.
Director Martin then presented the Wyoming Region 6 Hazard Mitigation Plan for approval.
Commissioner Mangold made a motion to approve the Wyoming Region 6 Hazard Mitigation Plan as presented. Commissioner Thiel seconded and the motion carried.
Park County Commissioners
Re: Discussion on BLM Natural Resource Management Plan
Commissioner Tilden discussed the upcoming NRMP and that lands with wilderness characteristics (LWC) needs to be re-evaluated and he is requesting that the Commissioners draft a letter to the BLM requesting a new inventory and re-evaluation of the LWCs.
Commissioner Mangold made a motion to draft said letter for the Chairman’s signature. Commissioner Tilden seconded and the motion carried.
