Chairman Livingston called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, June 1, 2021. Present were Vice Chairman, Dossie Overfield, Commissioners, Scott Mangold, Lloyd Thiel, Joe Tilden and Clerk Colleen Renner.
CJ Baker led the audience in the Pledge of Allegiance.

Commissioner Tilden made a motion to approve the following consent agenda items: minutes from May 11 and 18, bi-weekly payroll in the amount of $590,010.97, approve and allow the Chairman to Sign Amendment One to the Contract between Wyoming Department of Health, Public Health Division and Park County – Bill Crampton; FY2021 Congestion Mitigation Air Quality Program Subrecipient Agreement Between the Wyoming Department of Transportation and Park County – Ben McDonald; Special Prosecution Resolution – Bryan Skoric-RESOLUTION 2021-32; and Jake Clark’s Mule Days 24-Hour Malt Beverage Permit. Commissioner Overfield seconded, and motion carried.

Park County Commissioners – RE:
• Approve a Letter of Support for the Hank Coe Yellowstone Regional Airport Terminal – After discussion Commissioner Mangold made a motion to write a letter of support, Commissioner Tilden second and motion carried.
• Discussion on the Cody Shooting Complex Amended Lease Agreement – Attorney Skoric recommended amending the lease to incorporate the new area. Commissioner Thiel moved to approve the amended lease to include the added acreage, Commissioner Tilden seconded, and motion carried.
Park County Commissioners – RE: Approve Park County Powell Library Design Company
Ms. Horner, Librarian gave a brief committee update and information on how the interviews went for all three proposals. The committee recommends Plan One Architect who scored the highest during the interviews. Commissioner Overfield also described the process and stated this is only for the conceptual design and working with the public and the focus group. After discussion regarding the committee’s recommendations, Commissioner Overfield reminded the board the funding is coming from Park County Library Foundation.
Commissioner Mangold made a motion to accept Plan One for the design, there being no second the motion died. Ms. Horner also stated that the committee was comfortable with any of the three companies, Plan One, GSG and Arete are who submitted.
Commissioner Tilden made a motion to approve GSG and enter fee negotiations, Commissioner Thiel seconded, Commissioner Mangold opposed, motion carried.
Park County Treasurer, Barb Poley – RE: Park County Revenue Review
Ms. Poley presented the board with an update on registration fees being down a bit, sales tax is up, property taxes are down with over 2,000 delinquent notices sent out, revenue is $2.4 million over what was projected with $1.4 million coming from the CARES Act and $600,000 for the organizations that requested help which has been expended. Expenditures are down about half a million. We are right on budget with one month to go before year end, it appears as if there will be a cash carry-over.
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing - Continuance: Meadow Flower Minor Subdivision-50 Sketch Plan Review
Chairman Livingston opened the public hearing.
Mr. Dillivan stated the continuance was due to a revised sketch plan that was submitted the morning of the original hearing on May 18th.
The applicant is requesting approval for a five-lot minor subdivision which is located 2.2 miles east of Powell on the north side of County Lane 8H. Located in a General Rural Powell zoning district which allows low and moderate-intensity land uses. The parcels are currently vacant, irrigated land. Notices and agency referrals have been met and no public comments have been received.
A Subdivision Improvements Agreement, Homeowners Association Agreement, easements identified, subdivision road name, Shoshone Irrigation Districts written approval of water distribution, and a note on the final plat that water wells shall comply with State Engineer’s requirements before submission of Final Plat review.
Chairman Livingston called for public comments, there being none, Commission Tilden moved to close the public hearing, Commissioner Thiel seconded, and motion carried.

Park County Planning & Zoning Planner II, Kim Dillivan – RE: Bateham Simple Subdivision Final Plat Review - 269
Mr. Dillivan presented the Final Plat application for Shane Larsen for final approval to create two lots, one 10.53-acres and one 10.54-acres. The property is in GR-5 zoning district, proposed lot 1 has an existing residence with a permitted small wastewater system, located seven miles southwest of Cody and ½ mile east of Southfork Hwy on the north side of Douglas Drive. The applicant shall provide a shared use agreement for the spring water addressing the percentage distribution of permitted flow. No public comments have been received.
Commissioner Theil questioned why the notice of the Wyoming Right to Farm and Ranch Act of 1991 is not included on all final plats and the use of recommendations vs. conditions. After discussion Ms. Umphlett stated she will be more aware in the future of placing that statement on the plats.
Commissioner Thiel moved to accept the Bateham with change of wording from recommendations to conditions and adding the Right to Farm Act statement, Commissioner Tilden seconded, and motion carried. RESOLUTION 2021-29
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Bellflower Simple Subdivision Final Plat Review - 272
Mr. Dillivan presented the final plat application which requests approval to create two lots, one 3.0-acres and one 6.81 acres which is located 2.2 miles east of Powell on the north side on County Lane 8H in zoning district GR-P. Lot 1 is vacant agriculture and Lot 2 has one primary residence and four accessory structures. No public comments have been received.
Chairman Livingston addressed the discrepancy in wording use and consistency is needed going forward.
Commissioner Overfield moved to approve final plat with conditions as listed Commissioner Thiel seconded, and motion carried. RESOUTION 2021-30
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Winchester Major Subdivision Phases 4 & 5 Final Plat
Mr. Dillivan presented final plat for Phase 4 creating Lots 10 through 16 and Phase 5 creating Lots 17 through 23 which is located 1.5 miles south of Powell, south of Lane 11 and west of Road 8, the owners are TJR Ventures, LLC. Phases 1, 2 and 3 have been completed and required conditions of previous resolutions have been met.
Commissioner Overfield made a motion to approve Phase 4 and 5 as presented, Commissioner Thiel seconded, and motion carried. RESOLUTION 2021-31

Commissioner Thiel made a motion to appoint Anna Marie McMahill to the Library Board, Commissioner Mangold seconded, and motion carried.
Park County Commissioners – RE: Acknowledge Retiring Park County Public Works Cody District Forman, Ron Nieters
Chairman Livingston presented a plaque and framed picture of Heart Mountain to Ron Nieters for his 38 years of employment to Park County. All Commissioners made comments and thanked him for his years with the county.
