Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, January 2, 2024. Present were Vice Chairman, Scott Steward, Commissioners Lee Livingston via video conference, Scott Mangold, Lloyd Thiel and Clerk Colleen Renner.
Clerk Renner led the audience in the pledge of allegiance.

Commissioner Thiel made a motion to approve the following consent agenda items: Minutes from 12/19/23; payroll in the amount of $688,983.77 which included insurance; vouchers; approve and sign Renewed Lease for Cody Pardners & AirPro; and allow Chair to Sign PCHPC 2023 Annual Report
Commissioner Mangold seconded and the motion carried.

Commissioners – RE: Election of 2024 Officers
Commissioner Mangold made a motion to elect Commissioner Overfield as Board Chairman, Commissioner Thiel seconded. Motion carried.
Commissioner Thiel made a motion to elect Commissioner Steward as Vice Chairman, Commissioner Mangold seconded motion carried.
Commissioners – RE: 2024 Board Liaisons
Chairwoman Overfield outlined who is currently serving as liaisons to the county appointed boards, county committee appointments and Federal Cooperating Agency Appointments. The board members will remain in their current positions for the upcoming year.
Kim Dillivan, Planning & Zoning Assistant Director – RE: Notice of Consideration of Penalties: Owens
Mr. Dillivan presented the history of violations on the property that is currently owned by Barbara Owens which is Lot 12 of Shoshone River Estates. Neighbor’s complaints have been received since July 6, 2022, and over the course of time some items were removed, and some has reaccumulated on the property. The property has a Planned Unit Development Agreement which prohibits the activities that are occurring on the property.
Jeff Bales and Mark Roberts, neighbors, both commented on the non-compliance by the property owners and would like to see enforcement of some sort to take care of the issue.
Commissioner Steward made a motion to give a deadline of February 1st and defer to the County Attorney for imposing penalties of $500 per week for every week of non-compliance, Commissioner Thiel seconded, discussion on PUD, imposing fines and the courts placing a lien on the property if fines not paid. Alex Florek and Jason Lund, Carver Florek & James CPA’s – RE: Audit Report Presentation via Zoom
Mr. Florek presented the reports for the 2023 Audit of the financial statements and what the requirements are for reporting. Mr. Florek also went through the revenue and expenditures with changes in fund balances, and briefly covered some of the significant accounting policies. Mr. Florek thanked the board for the opportunity to work with Park County and its staff and encouraged anyone to call if they have additional questions. In closing Carver Florek found no deficiencies in internal control or compliance.
Commissioners – RE: Park County Policy Manual – Holiday Pay Discussion
Sheriff Steward discussed the Holiday Pay on both Christmas Eve and Christmas Day with regards to Christmas Eve on Sunday and departments that work a 5-day work week were not given an additional day. Departments that work 7 days should be compensated for the Holiday worked as our policy manual states December 24 & 25.
After further discussion Commissioner Mangold made a motion to pay those employees that worked on Christmas Eve holiday pay, Commissioner Thiel seconded, and work will be completed to update the manual. Motion carried.
Kim Dillivan, Planning & Zoning Assistant Director – RE: Rose MS-71 Final Plat
Mr. Dillivan presented the final plat for owner Leslie Rose requesting approval to vacate Lot 2 of the Oliver SS-102 and create a two-lot subdivision of one 10.37-acre lot and one 14.40-acre lot each for residential use. The property is in GR-5 zoning and is six miles southwest of Cody. Each lot has existing residence, outbuildings, and irrigated pastureland. A private indoor riding arena is on proposed Lot 2. No public comments were received, and staff recommends approval with two conditions that were read into the record and easements identified on the final plat.
Commissioner Thiel moved to approve Rose MS-71 with conditions, Commissioner Steward seconded, motion carried. RESOLUTION 2024-02
Brian Edwards, Engineer, Public Works Department – RE: Award Bids for 2 Dump Trucks and 1 Heavy Haul Tractor
Mr. Edwards stated the bids were opened one month ago and have been reviewed. Staff recommends two Western Star, Model 47X be purchased from Floyd’s Truck Center for $486,922 with delivery of April 15, 2025.
Commissioner Steward moved to award to Floyd’s Truck Center for two dump trucks with Jay Kraft uplifts in the amount of $486,922, Commissioner Thiel seconded, motion carried.
Mr. Edwards recommends the purchase of the Peterbilt, Model 567 for the new heavy haul tractor with a May 2024 delivery.
Commissioner Mangold moved to approve the purchase of the Peterbilt Tractor in the amount of $212,974, Commissioner Steward seconded, motion carried.
Commissioners – RE: Park County Historical Preservation Committee Appointment
Chairwoman Overfield reached out to Dan Schein to see if he had interest in serving on this board.
Commissioner Mangold moved to appoint Dan Schein to the Park County Historical Preservation Board as he was interested, Commissioner Thiel seconded, motion carried.
Commissioners – RE: Designation of Official Newspaper
Commissioner Mangold moved to approve the Powell Tribune and Cody Enterprise the official newspapers for the County, Commissioner Thiel seconded, motion carried.
Park County Historic Preservation Commission Interview – RE: Miranda Bickford
Chairwoman Overfield introduced Mirand Bickford who stated she is the new manager at the Heart Mountain Interpretive Center. After some interview questions Commissioner Mangold moved to appoint Miranda Bickford to the Historic Preservation Commission, Commissioner Steward seconded, motion carried.
