Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, February 7, 2023. Present were Vice Chairman, Lloyd Thiel, Commissioners Lee Livingston, Scott Mangold, Scott Steward and Clerk Colleen Renner.
Sheriff Darrel Steward led the audience in the pledge of allegiance.
Consent Items:
Approve-Minutes, Payroll and Vouchers
Commissioner Thiel made a motion to approve the following consent agenda items: Minutes from 1/24/23; Payroll in the amount of $455,803.79 and Elected payroll with insurance $102,048.40; approve and sign letter of clarification to Gardiner Chamber; Resolution Concerning Special Prosecutor RESOLUTION 2023-04; MOU with WCCA as Cooperating Agency in the Bureau of Land Management’s Effort to Revise the Greater Sage Grouse Plan, allow chair to sign; MOU between Park County Sheriff’s Office and Town of Meeteetse; ad for upcoming March Board Appointments. Commissioner Livingston seconded, discussion on changes within the MOU for Sheriff and Town of Meeteetse and what they enforce and do not enforce, motion carried.

Commissioners – RE: Approval of Vouchers
Commissioner Livingston made a motion to approve the vouchers, Commissioner Mangold seconded, Commissioner Thiel declared a conflict on an invoice for the gravel from his company that is included in the vouchers. Motion carried.
Kim Dillivan, Planning & Zoning – RE: Public Hearing: Gillett North MS-66 Variance
Chairwoman Overfield opened the public hearing.
Mr. Dillivan presented a minor subdivision permit application to create a two-lot subdivision consisting of one 12.9-acre lot and one 22.0- acre lot for residential use for owner Donald S. Gillett. The variance request is to allow flexibility in utilities to the property which now use propane and electricity. If future owners prefer gas over propane or electricity, they could put in a gas line. Legal notices, agency referral and property owner notifications have been met. The property is in GR-P. Staff recommends denial because conditions of approval are not met.
Chairwoman Overfield called for public comments, there being none, Commissioner Livingston made a motion to close the public hearing, Commissioner Mangold seconded, motion carried.
Commissioner Mangold moved to approve the variance with the easement for utilities be placed on the final plat, Commissioner Livingston seconded, after discussion on the meaning of the easement the motion carried. RESOLUTION 2023-05
Executive Session.
Commissioner Mangold made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (ii), Commissioner Livingston seconded, and motion carried.
Commissioner Livingston moved to exit from executive session, Commissioner Mangold seconded, and the motion carried. No decisions were made in or as a result of the executive session.

Commissioner Livingston made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (iii), Commissioner Thiel seconded, and motion carried.
Commissioner Thiel moved to exit from executive session, Commissioner Livingston seconded, and the motion carried. No decisions were made in or as a result of the executive session.

Jeremiah Vardiman, University of Wyoming Extension – RE: Update on Positions in Office & Introduction of Mary Louise Wood
Mr. Vardiman gave a brief update regarding office positions, support staff, the 4-H educator leaving and Horticulturalist Bobbie Holder retiring. Mary Louise Wood was introduced as the new 4-H Educator in Park County who comes from Albany County with 15 years’ experience. The Horticulture position has been advertised as part-time. Mr. Vardiman invited a board member to sit in on the interviews. Commissioner Overfield asked what will happen if they receive no applicants, Mr. Vardiman stated that maybe this could become a regional position for the Big Horn Basin.
Commissioners – RE: Jon Sowerwine Appeal Decision
Commissioner Livingston reminded the board that the appeal decision by the planning & zoning director was to not allow applicant to move forward with a simple subdivision.
Commissioner Livingston made a motion to uphold the planning and zoning director’s decision to deny, Commissioner Steward seconded. After discussion on processes moving forward, Park County Deputy Attorney Riley stated the typical timeline would be that the applicant be required to go through a new application. Chairwoman Overfield called for the question, the motion carried, Commissioner Thile opposed, motion carried. RESOLUTION 2023-06
Commissioners – RE: Continued Public Hearing: Horizon Green Creek Tower SUP-244
Chairwoman Overfield opened the continuation of the public hearing. Chairwoman Overfield requested that participants only provide new information when speaking. Mary Selby, Catherine Clarkson, Tom Rullman, Rod Hall, Brian Clarkson, Colleen Monahan all spoke in opposition.
Mr. Leonard and Mr. Kennedy with Horizon were questioned on where other proposed sites were located, did they respond, did that include federal lands, the location, the need and who proposed the need and placement of this tower. Mr. Kennedy stated cell phone pings shows where a need exists.
Ms. Hill, Planning & Zoning director after listening to the conversation remarked that the approval is based on four criteria of compatibility and impacts, services and infrastructure, specific criteria and overlay districts, and harmony with surrounding land uses and where the structure will be located.
Commissioner Thiel questioned if this is denied but they chose a different location can this not be heard for another year. Park County Deputy Attorney Riley stated with a different location it would be a new SUP.
There being no further discussion Commissioner Thiel made a motion to close the public hearing, Commissioner Livingston seconded, motion carried.
Commissioner Livingston moved to deny the SUP for Horizon based on the tower not being in harmony and compatibility with the land uses in the area from testimony received during the public hearing, Commissioner Thiel seconded, motion carried. RESOLUTION 2023-07
Commissioners – RE: Amended Plat of Hedrick Spring SS-225
Commissioner Thiel moved to approve the partial vacation and amended plat with the three conditions as read into the record, Commissioner Livingston seconded. Mr. Dillivan read the staff recommendations into the record for clarification purposes. Motion carried. RESOLUTION 2023-08
Karen Horner, Library – RE: Annual Report
Ms. Horner introduced Vice Chairman, Geoff Baumann of the Library Board. Ms. Horner presented a quarterly report regarding the mission, vision, services given to the public, a teen space now located in the Powell Library, 2022 public service statistics, community outreach and engagement. The outreach van has modernized abilities to reach out to communities like Clark, Powell, Wapiti, Meeteetse and Cody. Plans are to reach out to smaller communities like Ralston, Frannie, Deaver, and Valley on the Southfork.
Chairwoman Overfield asked for updates on the Powell Library, Mr. Baumann stated things are moving forward and they have met with another consultant for more ideas regarding libraries.
Jeff Martin, Homeland Security Director – RE: Wyoming Office of Homeland Security Grant
Mr. Martin presented for approval the grant from WOES for 50% salary and benefits to fund his position totaling $47,254. The County Attorney approved the agreement. Commissioner Mangold made a motion to approve the grant and allow the chair to sign for final approval, Commissioner Livingston seconded, motion carried.
Brodie Serres, Meeteetse Recreation Director – RE: ARPA Funds Request for New Community Center
Ms. Serres presented on behalf of the Meeteetse Rec Center seeking support for a community center to be built in Meeteetse. The proposed project would consist of a 6,600 square foot facility and the Wyoming Business Council recently approved a grant in the amount of $750,000. Ms. Serres is asking for the commissioners to consider appropriating ARPA funds help the community complete this project. Ms. Serres reported that the community has grown, new student enrollment is up, and family memberships have gone from 22 to 40 since 2018. No decision was made at this time as the Board will need to evaluate the funds remaining in the ARPA accounts.
Brian Edwards, Engineer, Public Works – RE: Open Proposals for Construction Manager At Risk Services for New Powell Landfill Equipment Maintenance Shop
Mr. Edwards stated five bids have been received and were opened from the following companies: Filener Construction, Diamond Point Construction, Sletten Construction, Groathouse Construction and Caspar Building Systems. Commissioner Thiel will attend the interviews with Brian Edwards, Travis Ball and Ben McDonald, the group will report back with recommendations.
RE: Consider Updating Resolution for Resubmittal of Application for State ARPA funds
Mr. Edwards presented the resubmittal application for consideration with a change of a 50% match. This resolution would supersede Resolution 2022-73 approved in July 2022. After discussion on reimbursements, reclamation of the land and the 50% match Commissioner Thiel moved to approve the resubmittal at 50% match, Mangold seconded, motion carried. RESOLUTION 2023-09
