Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, February 21, 2023. Present were Vice Chairman, Lloyd Thiel, Commissioners Lee Livingston, Scott Mangold, Scott Steward and Clerk Colleen Renner.
Stephen Dow led the audience in the pledge of allegiance.
Approve-Minutes, Payroll and Vouchers
Commissioner Livingston made a motion to approve the following consent agenda items: minutes 2/7/23; payroll of $686,054.25; vouchers; monthly earnings & collection statements from Clerk, Clerk of District Court, Sheriff; New Lease for WSP Global at Park County Complex; Chair to Sign Thirteenth Amendment for Inmate Health Care Services at Park County; and out of state travel for Homeland Security Director, Jeff Martin. Chairwoman Overfield stated that the 11:15 agenda item will be withdrawn, Commissioner Mangold seconded, motion carried.

Commissioners – RE: Land Use Plan Update with Clarion Associates via Zoom
Ms. White from Clarion updated the board on the draft plan which kicked off one year ago and is in the home stretch. The public comment period will close March 10.
The adoption of the draft document will be ready April 10th. Notification requirements for Planning and Zoning will be 30 days before the meeting and 45 days before the Commissioners meeting to consider adoption.
Kim Dillivan, Planning & Zoning – RE: Meadow Flower MS-50 Final Plat/SIA
Mr. Dillivan presented a revised final plat for Blue Bell Properties, LLC which is requesting approval of one 9.33-acre lot, one 7.62-acre lot, one 9.34-acre lot, one 7.29-acre lot and one 3.70-acre lot for residential/agricultural use. The applicant is also requesting Board approval of the Subdivision Improvements Agreement (SIA) and surety bond performance and will address required utility improvements. The property is located 2 miles east of Powell in GR-P zoning district.
The sketch plan was reviewed and approved on June 1, 2021, with conditions noted in Resolution 2021-28. Staff recommends approval with conditions that were read into the record.
Commissioner Livingston moved to approve the surety bond, Commissioner Thiel seconded, motion carried.
Commissioner Thiel moved to approve the SIA, Commissioner Livingston seconded, motion carried.
Commissioner Mangold moved to approve the final plat with conditions listed, Commissioner Livingston seconded, motion carried. RESOLUTION 2023-10
Kim Dillivan, Planning & Zoning – RE: Amended Plat of Breezy Meadows
Mr. Dillivan presented the amended plat for Kim Garrison which will vacate a 1.59-acre portion of original lot 4-A and merging it with the exempt remainder resulting in a 47.68-acre which is not included in the subdivision and an 8.79-acre amended lot to be designated as lot 104. The property is in RR-zoning three miles north of Cody. Proposed lot 104 is currently vacant, the exempt remainder is developed with residence, septic system, and accessory structures. Bureau of Reclamation exempt lands border the north. Staff recommends approval with the conditions which were read into the record.

Joy Hill, Planning Director and Brian Beauvais, Archives – RE: Park County Historical GIS Story Map Presentation
Ms. Hill approached Mr. Beauvais in October 2019 and discussed creating a GIS story map for Park County. Mr. Beauvais applied for a non-profit ESRI Arch GIS license and received one. Brian Clarkson has volunteered his time in showing/helping make this project move forward. Mr. Clarkson stated the project is only limited to the imagination of the creator. Mr. Beauvais stated this is only the beginning of the project using archival photos, overlaying mapping information, map aerials and high-resolution topography. Ms. Hill stated that this is only the beginning, and this will become a tool citizens will be able to help with.
Kim Dillivan, Planning & Zoning – RE: Public Hearing: Rose MS-71 Sketch Plan
Chairwoman Overfield opened the public hearing.
Mr. Dillivan presented the minor subdivision requesting approval to vacate Lot 2 of the Oliver SS-102 and create a two-lot subdivision comprise of one 10.34-acre lot and one 14.43-acre lot for residential use. The property is owned by Leslie Rose and is in GR-5 zoning located six miles southwest of Cody south of Hwy 291. Agency referrals and notices have been met with no comments from the public received. Staff recommends approval with eight conditions that were read into the record.
Chairwoman Overfield called for public comments. Cody Schatz, Engineering Associates who represents the applicant has met with the irrigation which will require sprinklers.
There being no further discussion Commissioner Livingston made a motion to close the public hearing, Commissioner Thiel seconded, motion carried.
Commissioner Thiel moved to approve the Rose Minor Subdivision with conditions, Commissioner Mangold seconded, motion carried. RESOLUTION 2023-12

Brian Edwards, Engineer, Public Works Department – RE: CMAR Proposal Selection- Powell Landfill Heavy Equipment Maintenance Shop
Mr. Edwards stated five proposals were received. The review committee, which consisted of Buildings & Grounds, Public Works and Commissioner Thiel interviewed and ranked the candidates. The high score was achieved by Filener Construction and the committee recommends contracting with Filener. Commissioner Livingston made a motion to award the contract to Filener Construction, Commissioner Mangold seconded, motion carried.
RE: Request to use ARPA Funds to Purchase Road Materials for Road & Bridge Division Maintenance Projects
Mr. Edwards would like to purchase a large amount (150,000T) of road materials with an estimated cost of $1.2 million out of the ARP general funding since there is such uncertainty in pricing, availability and ahead of the construction season. Mr. Pomajzl is rebuilding spreadsheets showing the use of this funding and the COVID ARPA funds. The spreadsheet will be available for the March 7th meeting and a decision will be made at that time.
HVAC Contract Discussion – Mr. Edwards presented a change order for Long Building Technologies for the balancing and testing which was in the original scope of the project and was left out in the amount of $32,786.50.
Commissioner Thiel moved to increase the Long Building Technologies contract by $32,786.50, paid out of ARP funds, Commissioner Mangold seconded, motion carried.
Decision of P & Z Commission
Commissioner Thiel moved to appoint Randy Mair to the P&Z Commission, Commissioner Steward second, motion carried.
Commissioner Mangold excused himself for the rest of the day.
Cody Conservation District – RE: ARPA Funds Request
Mr. Dwyer, Chairman of the District presented a request for funds from the ARPA funding to help cover upfront costs as their grants are mostly reimbursable. They are requesting $67,000 to cover wages and $15,000 to conduct a mail ballot election with the question of imposing mill levy on those properties in the Cody Conservation District. Following discussions, the Board will decide on March 7th after reviewing all requests for funding.
