Chairwoman Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, February 15, 2022. Present were Vice Chairman, Scott Mangold, Commissioners Lee Livingston, Lloyd Thiel, Joe Tilden and Clerk Colleen Renner.
Molly Norberg led the audience in the Pledge of Allegiance.

Commissioner Livingston made a motion to approve the following consent agenda items: minutes from February 1 and 8; bi-weekly payroll in the amount of $409,682.36 and Elected pay of $92,152.63; vouchers; resign updated lease agreement for McCarty, Reed and Earhart; approve Park County Travel Council Board Appointment Ad; approve and sign updated JPA for Park County Travel Council; review and approve Resolution 2022-15 on the Northern Rockies Ecosystem Protection Act; review & sign Financial Assurance Update Park County Regional Landfill; and monthly earnings and collection statements for the Clerk, Clerk of District Court, and Sheriff; Commissioner Thiel seconded, motion carried.

First Deputy Clerk, Hans Odde – RE: Public Hearing Consider retail liquor license transfer application from Top of the World Inc. to Triple 9 Inc.
Chairwoman Overfield opened the public hearing.
Mr. Odde stated this is a mid-year transfer from Top of the World Inc. located on Beartooth Pass to Triple 9 Inc. The license has been vetted by state and there are no concerns. The lease from the Forest Service has been transferred to Triple 9 Inc. and does allow for liquor sales on the premises.
Chairwoman Overfield called for public comment, there being none, Commissioner Tilden made a motion to close the public hearing, Commissioner Mangold seconded, motion carried
Commissioner Tilden moved to approve the transfer as presented, Commissioner Livingston seconded, motion carried.
Commissioners – RE: 2022 Updated Fee Schedule & Effective Date
Chairwoman asked for comments. Commissioner Thiel wished the changes would have been tracked as he questioned some of the fees put forth in the document, mostly from Road & Bridge. Mr. Edwards stated the changes were only by several dollars and no major cost adjustments. After discussion Commissioner Mangold moved to approve updated fee schedule effective March 1 for departments to update, Commissioner Tilden seconded, motion carried. Resolution 2022-17
Commissioners – RE: Administrative Relief Appeals on Jody Lane MS-63
Chairwoman Overfield stated that the Board all received the information and input from the last meeting. Mr. Edwards reminded the Board the administrative relief was to widen and stay within structure there and not relocate utilities or require paving.
Discussions regarding width, require paving, clarification of what administrative relief is suggesting, denying appeal and then motion to alter appeal, Chairwoman Overfield called on Deputy Attorney Riley for clarification and she stated the motion could uphold or deny in part.
Commissioner Thiel made a motion to grant administrative relief on paving, requiring the entire road meet county road standards with a gravel surface, Commissioner Livingston seconded, after discussion Commissioner Thiel amended the motion to require the 24-foot width on the entire road. Motion carried.
Planning & Zoning Director, Joy Hill – RE: Continued Public Hearing: Jody Lane MS-63
Chairwoman Overfield opened the continuation of the public hearing.
Commissioner Thiel questioned the proposed condition of having to meet the game and fish recommendations and how that is enforced. After lengthy discussion. Mr. Schatz of Engineering Associates noted that the letter from game and fish states “adhere to as close as possible.” Ms. Hill recommended the applicant be encouraged to follow the recommendations so the Board will not need to enforce.
There being no further comments from the public, Commissioner Livingston made a motion to close the public hearing, Commissioner Thiel seconded, motion carried.
Commissioner Livingston made a motion to approve the subdivision with changes to condition #2 encouraging them to follow the recommendation of Game & Fish, Commissioner Tilden seconded, motion carried. Resolution 2022-16
Commissioner Livingston left the meeting at this time.
Planning & Zoning, Patti Umphlett – RE: Public Hearing Merit Energy SUP-224
Chairwoman Overfield opened the public hearing.
Ms. Umphlett stated the SUP application was received on December 2, 2021 including the plan-view drawings showing the tower location, vicinity map, type of activity and impact on adjacent properties. The parcel is in GR-35 zoning surrounded by BLM land, some ag and mostly oil and natural gas production. Legal notices and agency referrals have been met and no public comments have been received.
Chairwoman Overfield called for public comment, there being none, Commissioner Tilden made motion to close the public hearing, Commissioner Mangold seconded, motion carried.
Commissioner Tilden made a motion to approve except for condition number 2 which should state, “encourage the applicant to follow recommendations set forth by Game & Fish”, Commissioner Thiel seconded, motion carried. RESOLUTION 2022-18
Planning & Zoning, Patti Umphlett – RE: Public Hearing Miller Barns SUP-225
Chairwoman Overfield opened the public hearing.
Ms. Umphlett presented the SUP application to operate a business building small storage barns, cabins, greenhouses, and storage sheds all of which will be sold off-site. The property is owned by Reuben & Anna Miller and the business will operate in about 1,600 sq foot space within an existing 2,880 sq foot shop. The lot is GR-P zoning surrounded by primarily agriculture, along the northern property line is Bureau of Reclamation. The business will have two family members as employees. No municipal review is required, legal notices and agency referrals were met, two public comments were received with one in support and one requesting a condition added that the SUP only applies to the applicant themselves and not the land. A permitted small wastewater system is still needed, and finished structures shall not be stored on the property.
Chairwoman Overfield called for public comment, Larry French stated he is the neighbor and has no objection. Commissioner Tilden made motion to close the public hearing, Commissioner Thiel seconded, motion carried.
After discussions regarding the SUP going with owner or land and the period a finished product can remain on property, Commissioner Tilden made a motion to approve the SUP and extended time to three weeks for storage of the finished buildings on the property, Commissioner Mangold seconded, motion carried. Planning & Zoning, Patti Umphlett – RE: Public Hearing Hecht Tower SUP-226
Chairwoman Overfield opened the public hearing.
Ms. Umphlett presented a SUP application for Scott Hecht which included plan-view drawings showing location, vicinity map, type of activity and impact on adjacent properties which will allow the replacement of a 160-foot-tall communication tower located 1.6 miles south of Powell. Legal notices and agency referrals have been met, no public comments received, and the primary use will be for TCT Internet.
Chairwoman Overfield called for public comment, there being none. Commissioner Tilden made motion to close the public hearing, Commissioner Thiel seconded, motion carried.
Commissioner Thiel moved to approve Hecht Tower SUP- 226 which replaces the existing tower, Commissioner Tilden seconded, motion carried.
RESOLUTION 2022-20
Planning & Zoning Director, Joy Hill – RE: Public Hearing Hawkeye Ranch FP 1-22
Ms. Hill presented the flood plain permit which would allow stabilization of the toe of a levy. The project site is 4148 Southfork Road on the left bank of the Shoshone River using cut/fill material for 730 feet. Public notices and agency responses were met, and no public comments received. A permit has not been received from the Army Core of Engineers. Ms. Hill read the Standards of Evaluation & Analysis for the record.
Chairman Overfield called for public comments, there being none, Commissioner Tilden made a motion to close the public hearing, Commissioner Thiel seconded, motion carried.
Commissioner Thiel move to approve the Floodplain Permit 1-22 based on standards of valuations with staff recommendations, Commissioner Tilden seconded motion carried. RESOLUTION 2022-21
Sheriff, Scott Steward – RE: Command Trailer and bullet resistant vests
Sheriff Steward introduced the new Homeland Security Jeff Martin.
Sheriff Steward was previously authorized $82,000 for the purchase of a command post for homeland security; however, the project was delayed and now the Sheriff would like to purchase body armor vests to for detention officers for $18,000 and to spend $10,000 on trauma kits to outfit patrol cars.
Commissioner Tilden made a motion to approve both requests from the existing cares money, Commissioner Thiel seconded, motion carried.
Sheriff Steward also stated a letter from the Board will need to be submitted to the Governor requesting appointment of the new Homeland Security Director. Commissioner Mangold moved to write the letter and allow the chairwoman to sign, Commissioner Thiel seconded, motion carried.
Payton Allerheiligen, QI/Risk Management Specialist, Powell Valley Health Care – RE: Project requests for the upcoming SLIB grant
Ms. Allerheiligen presented several projects that Powell Hospital would like to request from the State Lands & Investment Board this year since no funding was available last year. SLIB covers 50% of the cost if approved. The three items are:
• Replace the front doors in the care center - $24,000
• a stretcher for the ambulance - $22,000
• a new serving line for the cafeteria which would be three modular pieces - $72,000.
Powell Hospital reserve fund would cover the remaining half of approximately $59,000 if approved. Commissioner Tilden moved to approve a letter of support for the hospitals request, Commissioner Thiel seconded, motion carried.
