Chairman Tilden called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, December 1, 2020. Present were Vice Chairman, Lee Livingston, Commissioners, Dossie Overfield, Jake Fulkerson, Lloyd Thiel, and Clerk Colleen Renner.
Commissioner Thiel led the audience in the Pledge of Allegiance.

Approve-Minutes, Payroll and Vouchers
Commissioner Overfield made a motion to approve the following consent agenda items: minutes from November 17, bi-weekly payroll in the amount of $601,670.33 which included health insurance; vouchers; and approve Park County Weed & Pest Newspaper ad; Commissioner Thiel, seconded and the motion carried.

Park County Planning & Zoning Director, Joy Hill – RE: Public Hearing: Continuation of Park County Planning & Zoning Small Wastewater Regulations
Ms. Hill continued the discussions on the changes that were made and addressed at the earlier meetings. Long and short-term use, seasonal usage, business vs. construction, agriculture vs. oil fields using chemical toilets were some of the topics brought forth for clarification. Ms. Hill stated the new regs allow the administrator to better address the issues on a case by case basis and make clarification with the applicant filing for a small wastewater permit. The new regs clarifies requirements for both standard and non-standard wastewater systems. These regulations will replace the regulations that were adopted December 19, 2017. Commissioner Overfield made a motion to approve as presented, Commissioner Fulkerson seconded, after further discussion, Chairman Tilden called for the question, and motion carried, Commissioner Thiel opposed. Effective date will be January 1, 2021. RESOLUTION 2020-81
Park County Commissioners – RE: Discussion on Park County Complex – Drug Court Property
Commissioner Fulkerson discussed the process over the past six months to investigate selling the drug court building and sub-dividing the complex property. An engineer was hired, and historical perspectives where given by past Commissioner French and Attorney Skoric and after that information was obtained, Commissioner Fulkerson stated he has changed his mind about selling the properties. Discussion on the Complex then lead to selling the complex but having a 99-year lease for the library to get the building back on the tax rolls, along with purchasing land elsewhere. Discussion followed on keeping the drug court building and renting it out or selling the building and parcel. Commissioner Livingston stated all options are worth exploring.
Discussion continued regarding the former drug court property across from the Courthouse. There are two entities that would like to rent the property. Commissioner Fulkerson would like to advertise the property for rent to have a more transparent process. Commissioner Fulkerson made a motion for Mr. Garza to put together a Request for Proposal to negotiate and rent the former Drug Court building, Commissioner Livingston seconded. Motion carried and Commissioner Thiel opposed.
Commissioner Fulkerson made a motion to further research the sale of the complex property and, if sold, use the proceeds to purchase land elsewhere for county growth. Commissioner Thiel seconded with an amendment to include a lease agreement for the library to remain if this proceeds forward, motion carried.
Park County Engineer, Brian Edwards – RE:
• Approval to Submit and Sign Letter for the Park County Flap 2 Phase Application – Mr. Edwards stated phase two would finish the next section on the Southfork Road from end of state maintenance to the forest boundary. Various agencies have submitted letters of support for the project. Park County’s obligation would be roughly $2.5 million which would come from the county road fund for this 16-million-dollar project. Commissioner Fulkerson made a motion to sign the letter and apply for the FLAP program with the suggested amendments, Commissioner Thiel seconded, and motion carried.
• Consider Request to Fill Open Landfill Lot Attendant for Park County Landfills – Mr. Edwards gave a brief history of the position and the past six months or so of it not being filled. The wage is $15.05 per hour with no benefits and not to exceed 30 hours per work week. Commissioner Fulkerson made a motion to approve the landfill hiring Commissioner Thiel seconded, and motion carried.
Park County Attorney, Bryan Skoric – RE: Powell Library RFP
Attorney Skoric made a couple grammatical changes and reviewed the document for legality. Commissioner Overfield stated the study will be paid for by the Library Foundation and does not obligate the library but will give them options to look at going forward before decisions are made. Commissioner Overfield made a motion to send out the RFP as presented for the Powell Library, Commissioner Thiel seconded, and motion carried.
Park County Clerk, Colleen Renner – RE: Park County Clerk’s Employee Wages
Clerk Renner presented her recommendations to move some employees up the pay scale. Due to some unforeseen circumstances the Clerk’s office is well under budget in payroll and Clerk Renner would like to reward those who have filled in the interim gaps. Commissioner Thiel moved to allow the clerk wages as presented, Commissioner Livingston seconded, and the motion carried.

With all interviews completed, Commissioner Overfield made a motion to reappoint Roger Kearns and Greg Irwin to the Buffalo Bill Dam Visitor Center, Commissioner Fulkerson seconded, and motion carried.
With only one applicant for Meeteetse Local Planning Committee after discussion it was decided to re-advertise in 60-days and encourage the only applicant to reach out and try to recruit members and also contact Angie at the Town of Meeteetse and encourage them to get interested people to step up especially with the land use plan coming up for review. Commissioner Thiel moved to appoint Mary Rumsey and re-advertise for appointments in 60 days, Commissioner Fulkerson seconded, and motion carried.
Commissioner Fulkerson made a motion to reappoint Tiffany Brando and appoint Andrea Earhart to the Fair Advisory Board, Commissioner Overfield seconded, and motion carried.
Commissioner Overfield made a motion to reappoint Bonnie Smith, Russell Dakota, Brian Beauvais and Amy Phillips and appoint Ray Maple to the Park County Historic Preservation Committee, Commissioner Livingston seconded, and motion carried.
Commissioner Livingston made a motion to reappoint Andy Metzler and appoint Brian Beauvais and Richard Lasko to the Park County Parks & Rec Board, Commissioner Overfield seconded, and motion carried.
Commissioner Fulkerson made a motion to reappoint Duncan Bonine to the Park County Planning & Zoning Board, Commissioner Livingston seconded. Commissioner Fulkerson recommended going forward that the board interview all board members not just new applicants. Commissioner Thiel stated he feels this board is over staffed with realtors. Motion carried.
Executive Session.
Commissioner Overfield made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (ix) (x), Commissioner Thiel seconded, and motion carried.
Commissioner Overfield moved to exit from executive session, Commissioner Fulkerson seconded, and the motion carried. No decisions were made in or as a result of the executive session.
Chairman Tilden will add this to next week’s agenda.
