Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, August 1, 2023. Present were Vice Chairman, Lloyd Thiel, Commissioners Lee Livingston, Scott Mangold, Scott Steward and Clerk Colleen Renner.
Commissioner Steward led the audience in the pledge of allegiance.

Commissioner Thiel made a motion to approve the following consent agenda items as presented: minutes 7/17/23 & 7/18/23; payroll with insurance $684,810.03; vouchers; approve and allow Chair to sign Catering Permit for the Irma Hotel, Elkhorn Bar & Grill and two for Wyold West Brewing Co.; Willwood Irrigation Certificate; Search and Rescue Resolution with Wyoming Retirement - RESOLUTION 2023-46; Agreement FY22 with Dustbusters; MOU between Park County and City of Cody: Septage Receiving Facility. Commissioner Livingston seconded and the motion carried.

Kim Dillivan, Planning & Zoning Assistant Director – RE: Cross Ranch SS-307 Final Plat
Mr. Dillivan presented the final plat application for Baltazar Rodriguez, and property owner Mindy Gilbert requesting approval to create one 15.00-acre lot leaving a remainder parcel of 64.90-acres. The zoning is GR-P and is located 3 miles northeast of Powell. Agency referrals and notices have been met; no public comments received. Staff recommends approval with conditions that were read into the record.
After brief discussions on water and cisterns Commissioner Livingston made a motion to approve as presented, Commissioner Mangold seconded, motion carried. RESOLUTION 2023-47
Kim Dillivan, Planning & Zoning Assistant Director – RE: Townsend SS-308 Final Plat
Mr. Dillivan presented the final plat application for Lydia Moore requesting approval to create one 3.95-acre lot for residential leaving a remainder parcel of 93.85-acres. The zoning in GR-P and located 4 miles southeast of Powell on Highway 295. Agency referrals and notices have been met; no public comments received. Staff recommends approval with two conditions read into the record.
Commissioner Mangold moved to approve, Commissioner Livingston seconded, motion carried. RESOLUTION 2023-48
Kim Dillivan, Planning & Zoning Assistant Director – RE: Ando Farms SS-305 Final Plat
Mr. Dillivan presented the final plat application for Shalice Cook/Ando Farms LLC requesting approval to create one 2.41-acre lot for residential use leaving a remainder parcel of 69.53-acres located two miles west of Powell on County Lane 10. Agency referrals and notices have been met; no public comments received. Staff recommends approval with three conditions read into the record.
Discussion on shared driveway was addressed by Nick Hummel, Engineering Associates who stated the lots are all owned by the developer and family members.
Commissioner Livingston moved to approve with staff recommendations, Commissioner Mangold seconded, motion carried. RESOLUTION 2023-49
Ben McDonald, Project Manager, Public Works Department – RE: Open SOQ’s for the FY23 TAP Project-North Powell Bicycle and Pedestrian Facilities Improvements
Mr. McDonald stated the first go round there was only one SOQ received, WYDot required an additional two weeks of advertising. Several calls were received but the Clerk received no additional bids. Engineering Associates (EA) submitted the only proposal.
Commissioner Thiel moved to approve and allow the Chair to sign pending County Attorney approval and WYDot awarding the contract to EA, Commissioner Livingston seconded, motion carried.
Commissioners – RE: USDA, Forest Service and State Parks MOU-North Zone Snowmobile Trail Management
Engineer Edwards stated the proposed agreement is reconsidered every three years to manage the snowmobile trail from the Wyoming-Montana state line north of the Pilot Creek Trailhead to Long Lake on the Beartooth Plateau.
Bert Miller, Cody Country Snowmobile Association, Pete Halstead, WYDot and Engineer Edwards have discussed the possibility of plowing further east about 1 mile to the rest area. Further discussion included updating agreement, time requirement for plow driver, rest area maintenance, and additional costs. Chairwoman Overfield recommend approving current MOU and track any additional costs.
Commissioner Mangold moved to approve the current MOU with direction to test the additional proposed work for a year tracking costs and time, Commissioner Steward seconded, motion carried.
Hans Odde, First Deputy Clerk – RE: Full Size SUV Bid Openings for Clerk/Treasurer
Mr. Odde specked out 2023 gas 4-wheel drive full-size SUV, two bids were received.
• Denny Menholt – 2023 or 2024 Chevrolet Tahoe 4 x 4 – $58,769 – order item September 9, 2023 – Delivery date to be determined after order is placed.
• Fremont Motors – Ford Expedition – $65,598 – delivery 90-365 days after order placed.
Commissioner Thiel made a motion to accept the bid for $58,769 from Denny Menholt for the Tahoe to be delivered ASAP, Commissioner Livingston seconded, motion carried.
Brian Edwards, Engineer, Public Works Department – RE: Consider Purchase Options for Used Bull-Dozer for Road and Bridge Division
Mr. Edwards presented information on a used bulldozer. Mr. Edwards reached out to dealers to identify the availability of used bulldozers. There is one particular used bulldozer that is a one owner unit but has sat for two years and has 300 hours of use, is in like new condition, and would like permission to check it out.
Commissioner Mangold made a motion to negotiate the purchase of the used CAT bulldozer. Commissioner Livingston seconded, Mr. Edwards would make the purchase contingent on the CAT dealer completing an inspection of the unit. Motion carried.
