Chairwoman Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, April 5, 2022. Present were Vice Chairman, Scott Mangold, Commissioners Lee Livingston, Lloyd Thiel, Joe Tilden and Clerk Colleen Renner.
Commissioner Mangold led the audience in the Pledge of Allegiance.

Commissioner Mangold made a motion to amend the consent agenda removing the WYDOT MOU and approving the rest as presented. Minutes from March 15, 28 and 29; two bi-weekly payrolls in the amount of $416,933.01; $638,582.09 with insurance and Elected payroll $92,801.51; vouchers; re-sign Park County Travel Council JPA; review & sign MOU for lease with Legacy Reserves and review & sign DEQ Delegation Agreement; Commissioner Tilden seconded, and the motion carried.

Commissioners - RE: Land Use Plan Update with Clarion via Zoom
Darcie White with Clarion updated on the progress. Winding down on phase one and moving to phases two and three which will introduce the survey on the website and local meetings with the planning advisory committee. There will be series of meetings, public involvement, stakeholder groups and education. The information for the survey will lead the way to the future of Park County. The survey will be open through the end of April. Go to www.parkcounty-wy.gov There will be updates monthly. The Board will present their selection of LUPAC committee members today at 10:55 a.m.
Commissioners – RE: Double T SS-283 Final Plat Decision
After short discussion on part of the property that contains a hill and putting building restrictions on the land, Commissioner Tilden moved to approve as originally presented, Commissioner Thiel seconded, motion carried. Commissioner Livingston abstained from voting since he was not present on March 15. RESOLUTION 2022-31
Commissioners – RE: Urban Systems Program WYDOT & Big Horn Ave. Meetings Update
Chairwoman Overfield gave an update on the two meetings attended and to give notification of the survey on the City of Cody website on the Big Horn Avenue issue and encourages everyone to put in comments.
Kim Dillivan, Planning & Zoning- RE: Montgomery SS-282 Final Plat
Mr. Dillivan presented the final plat for owner James Montgomery which is located approximately 11 miles west of Cody in GR-5 zoning. This subdivision is comprised of two 5.0-acre lots for residential use and 81.69-acre exempt remainder parcel. No public hearing is required, agency referrals have been met and one public comment was received. Commissioner Livingston moved to approve as presented, Commissioner Tilden seconded, motion carried. Kim Dillivan, Planning & Zoning – RE: J1S SS-280 Final Plat
Mr. Dillivan presented the final plat for the property located one mile south of Garland for one lot that is 2-acres and a remaining parcel of 36.28- acres located in GR-P zoning. All agency referrals have been met and no public comments were received. Denman Jones is the applicant, and the owner is Raymond & Marina Rodriguez, Trustees.
Commissioner Mangold made a motion to approve as presented, Commissioner Thiel seconded, motion carried. RESOLUTION 2022--33
Commissioners – RE: LUPAC Selections
Chairwoman Overfield stated there were 80 applications received. After interviews these are the members that the Board chose: Kelly Spiering, Jerry Thompson, Marion Morrison, Rebekah Burns, Tye Whitlock, Dave Hoffert, Kathleen Jachowski, Andy Quick, Tiffanie May, Bret Allard, Matt Curtis, Laurie Steward, Michael Bromley, Richard Lasko, Brett Trudo and Tracy LaFollette.
Commissioner Livingston made a motion to appoint those listed to the Land Use Planning Advisory Committee, Commissioner Tilden seconded, motion carried.
Commissioner Thiel stated the importance of these members being involved and to get the public in their area involved. Ms. Hill stated the kickoff date is April 25.
Cody Conservation District – RE: Funding Request and Advertisement Draft
Mr. Vanata provided copies of the request in which Conservation District is requesting $952.25 allowing their educational ads to be placed in the newspaper, one color and two black and whites. Mr. Jones, also a board member of the Conservation District stated the mass mailing just went out educating the public of what the district does, and they are receiving calls and questions.
Commissioner Thiel moved to approve the $952.25 and to have Chairwoman Overfield look over the ads before they are placed in the paper, Commissioner Tilden seconded, motion carried.
Brian Edwards, Engineer, Public Works Department – RE: Review and Consider Agreement for Professional Engineering Services for Courthouse HVAC System Upgrades
Mr. Edwards stated the agreement has been to the county attorney and at this point it is to complete the scoping of the project.
Commissioner Thiel made a motion to approve and allow the chair to sign the agreement, Commissioner Livingston seconded, and motion carried.
Executive Session.
Commissioner Livingston made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (ii), Commissioner Thiel seconded, and motion carried.
Commissioner Thiel moved to exit from executive session, Commissioner Mangold seconded, and the motion carried.
Commissioner Livingston motioned to adopt the proposal as discussed in executive session, Commissioner Thiel seconded, motion carried.
Boone Tidwell – RE: Election Ballot Hand Count
Mr. Tidwell came before the Board to air a grievance regarding voting integrity and offering a viable solution which would be to have “volunteers” count the ballots once the polls close on Election Day. Dave McMillan spoke about the mock election they did with the schools. Larry French spoke next on the processes that took place at the library in the processing and tabulating of the 200 ballots they did.
After the lengthy discussions, Chairwoman Overfield requested hearing from Secretary of State, Honorable Buchanan who has attended via zoom. One of the statements he made was the statutory authority to do what they presented is not there. Mr. Buchanan spoke briefly with the new auditing process that will also be taking place with this year’s election. Mr. Buchanan recommended the Board reach out to their County Attorney before any decisions regarding the hand counting of ballot is decided.
In closing Clerk Renner stated no matter the outcome she invited everyone present to please come to the public testing of the voting equipment.
Scott Bagnell, PVHC – RE: Funding Request for Ambulance Bay
Mr. Bagnell stated the area for the building has passed the rezoning and moving forward the cost has gone up and they are here today to request more funds. Scott Shoppa, Plant Operations Director stated the deficit to complete the project is roughly $170,000. Powell Valley Healthcare has already requested $330,000 from the American Rescue Plan through the county. After discussions the Board recommended, PVHC reach out to the state to see if they qualify for the funds that have become available through the Governor. June Minchow, Emergency Services Director stated they will check with the state and give regular updates.
Steve Donham, Healthy Is Wellness – RE: Renewal Proposal
Mr. Donham gave a brief history of the program and the county participating since 2019. Described what is offered to the employees during the health check-ins at our workplace. The information is available in paper or app form. Chairwoman Overfield thanked Mr. Donham for the information, and they will decide after the Health, Safety & Wellness committee gives their presentation.
