May 6, 2024
The governing body of the City of Powell met in regular session at 6:00 p.m. on May 6, 2024, in the Council Chambers of City Hall. Mayor John Wetzel called the meeting to order, and the following were present: Council Members Tim Sapp, Steven Lensegrav, Floyd Young, Geoff Hovivian and Lesli Spencer. Absent Councilman Zane Logan. City Officials: City Administrator Zack Thorington, City Clerk Tiffany Brando and City Attorney Scott Kolpitcke. Approval of Agenda: Councilwoman Spencer moved to approve the agenda as presented, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED.
Approval of April 15, 2024 Minutes: Councilman Young moved to approve as presented, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Bills and Claims: Councilman Hovivian made a motion the bills be allowed and authorize the Treasurer to draw warrants for payment of the same, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
PUBLIC HEARING: 6:00 PM Shoopman No. 5 Annexation – Attorney Kolpitcke opened the public hearing at 6:02 pm no comments, closed hearing at 6:03pm. Ordinance No. 4, 2024: An Ordinance Annexing Certain Real Property Known as the Shoopman No. 5 Annexation. Discussion on property and is South of Monroe St as shown on the map. Councilman Hovivian moved to approve on first reading, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Request Waiver of Fees Commons: NWC for Paint the Town Red Aug. 23, 2024. Councilwoman Spencer moved to approve the waiver of fees, seconded by Councilman Young, unanimous approval, MOTION CARRIED.
Committee Updates: Councilwoman Spencer Urban Systems, Traffic and Golf Board, Councilman Young YCAN. Proclamation Child 55th Anniversary of Municipal Clerk’s Week May 5-11, 2024: Mayor Wetzel Proclaimed May 5-11, 2024 Municipal Clerk’s Week. Councilman Lensegrav moved to accept, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED.
WAM Voting Delegate: Summer WAM in Pinedale June 6th. Councilwoman Spencer moved to approve Councilman Hovivian as the voting delegate, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED.
Shoshone Municipal Pipeline Appointment: Mayor Wetzel asked to re-appoint Councilman Sapp. Councilman Young moved to approve, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Ordinance No. 2, 2024: Attorney Kolpitcke read by title - An Ordinance Amending Section 16.16.020 of the Powell City Code Pertaining to Streets, Alleys and Easements. Councilman Lensegrav moved to approve on third reading and authorize all necessary signatures, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED.
Ordinance No. 3, 2024: Attorney Kolpitcke read by title - An Ordinance Annexing Certain real Property Known as the Jones Street Annexation. Councilman Young moved to approve on seconded reading, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Waiver of Conflict of Interest and Consent – Copenhaver, Kitchen & Kolpitcke, LLC and Northwest Community College District: Attorney Kolpitcke discussed the waiver in regards to the retention drainage agreement between the two entities. Councilman Sapp moved to approve and authorize necessary signatures, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Adopt Capital Improvement Plan FY25-29: Administrator Thorington discussed the plan as outlined in the budget work session and online. Councilman Sapp moved to adopt the plan, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Declaration of Surplus Property: Administrator Thorington discussed the City will have items auctioned. Councilman Lensegrav moved to approve and authorize necessary signatures, seconded by Councilman Young, unanimous approval, MOTION CARRIED. 2024 Wyoming Emergency Insect Management Grant Pre-Award Acceptance Letter: Administrator Thorington discussed the award being less than the previous year. Councilman Lensegrav moved to approve and authorize necessary signatures, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Chief of Police Conditional Offer Request: Administrator Thorington is requesting approval in addition to the conditional offer to include up to $5,000 moving expenses reimbursed and 12 days of vacation. Councilman Hovivian clarified vacation would be upon starting. Councilman Sapp moved to approve the request, seconded by Councilman Young, unanimous approval, MOTION CARRIED.
Adjourn: There being no further business to be considered at this meeting; Councilman Hovivian moved to adjourn, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Mayor Wetzel adjourned the regular meeting at 6:19 p.m.

NOTICE OF PUBLIC HEARING
OLLOKOT MINOR SUBDIVISION (MS-79)
SKETCH PLAN
At their regular meeting on Tuesday, May 21, 2024, at 11:05am, the Park County Board of Commissioners will conduct a public hearing to consider the application and Sketch Plan for Ollokot Minor Subdivision (MS-79) (Applicant: Mighty Rock Properties LLC). The proposed four-lot subdivision will create one 20.23-acre lot, one 20.13-acre lot and two 20.21-acre lots, from an 80.78-acre parcel, each for agricultural and residential use. The proposed subdivision is described as the E1/2SE1/4 of Section 27, T57N, R102W of the 6th P.M., Park County, WY. The property is located in the Clark Planning Area, approximately 2.5 miles west/southwest of the intersection of the Belfry Highway and County Road 1AB, east of the terminus of Jackrabbit Lane, in a General Rural 20-acre (GR-20) zoning district. The property is unaddressed at this time.
