June 5, 2023
The governing body of the City of Powell met in regular session at 6:00 p.m. on June 5, 2023, in the Council Chambers of City Hall. Mayor John Wetzel called the meeting to order, and the following were present: Mayor John Wetzel, Council Members Lesli Spencer, Zane Logan and Tim Sapp. Absent Council Members Floyd Young, Steven Lensegrav and Geoff Hovivian. City Officials: City Administrator Zack Thorington, City Clerk Tiffany Brando, City Attorney Sandee Kitchen, Building Official Ben Hubbard and Police Chief Roy Eckerdt. Approval of Agenda: Councilwoman Spencer moved to approve the agenda as presented, seconded by Councilman Logan, unanimous approval, MOTION CARRIED.
Approval of May 15, 2023: Councilman Sapp moved to approve as presented, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Bills and Claims: Councilman Sapp abstained from item #59. Councilwoman Spencer made a motion the bills be allowed and authorize the Treasurer to draw warrants for payment of the same, seconded by Councilman Logan, unanimous approval, item #59 will not be paid for lack of a quorum, MOTION CARRIED.
Public Hearing: Budget Amendment FY 2022-2023 – Attorney Kitchen opened the public hearing at 6:02 p.m., no comments, closed at 6:03 p.m. Resolution No. 6 2023: A Resolution to Amend the 2022-2023 Budget. Councilman Logan moved to approve Resolution No. 6, 2023, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Public Hearing: Zone Change for 275 N Hamilton St., 285 N Hamilton St., 832 East 3rd St., and 274 North Ingalls St. from B-G General Business District to R-M Residential Mixed Use District – Attorney Kitchen opened the public hearing at 6:04 p.m., no comments, closed at 6:05 p.m. Ordinance No. 2, 2023: Attorney Kitchen Read by title only: An Ordinance to Change the Zoning Designation of N. 75’ of S. 150’ of W/2 Lot B; N 50’ of W/2 Lot B; the E/2 Lot B Excepting the S. 75’ and the N/2 of Lot A, All Within Block 38, Original Town of Powell, From B-G, General Business District. To R-M, Residential Mixed Use District. Building Official Hubbard indicated Planning & Zoning has approved and an easement received for existing electrical. Councilman Sapp moved to approve Ordinance No. 2, 2023 on first reading, seconded by Councilman Logan, unanimous approval, MOTION CARRIED.
Public Hearing: Amendments to R-M, Residential Mixed Use District, To Allow for Accessory Uses and Structures as Permitted Uses and Creating Affordable Small Lot Exceptions to Minimum Lot Requirements – Attorney Kitchen opened the public hearing at 6:07 p.m. has been approved by Planning & Zoning, no comments, closed 6:08 p.m. Attorney Kitchen read both Ordinance No. 3 & 4 by title only. Ordinance No. 3, 2023: An Ordinance Amending Section 17.32.020(A) By Adding Subsection (7) Allowing Accessory Structures and Uses. Ordinance No. 4, 2023: An Ordinance Enacting Section 17.32.035 on the Powell City Code to Allow Affordable Small Lot Exceptions to Minimum Lot Requirements In R-M, Residential Mixed Use District. Councilwoman Spencer moved to approve Ordinance No. 3, 2023 and Ordinance No. 4, 2023 on first reading, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Resolution No. 7, 2023: Waiver of Open Container July 1, 2023 @ NWC for Celebrities for a Cause. Ryan Brown spoke on the event, Councilwoman Lesli Spencer, moved to approve, 2nd by Councilman Logan, unanimous approval, MOTION CARRIED.
Resolution No. 8, 2023: Waiver of Open Container June 7 and 21, 2023; July 12 and 16, 2023 and August 2 and 16, 2023 @ Washington Park for Band in the Park Series. Amy Cozzens spoke on the event sponsored by the K-Bar. Councilwoman Spencer moved to approve, seconded by Councilman Logan, unanimous approval, MOTION CARRIED.
Request for a Street Closure: Amy Wells, Director of Powell Medical Foundation spoke on the event. Jess Laughlin, WYOld West Brewing expressed parking concerns and restroom concerns for the event with the street closure and read a letter from Powell Drug President. Diedra Asay with Vali Cinemas expressed concerns with access to the theatre. Mayor Wetzel spoke on the street closure on 2nd street between Clark and Bent and leaving that intersection open, also closing Bent Street between the Commons and 2nd St. and blocking the intersection diagonal to allow traffic. Those concerned agreed and Chief Eckerdt stated logistics will work and he will get the permit issued.
Councilman Geoff Hovivian arrived 6:21 p.m. Resolution No. 9., 2023: Waiver of Open Container June 9, 2023 @ Plaza Diane for Downtown Boot Scoot. Councilwoman Spencer moved to approve, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED.
Request for Extension of Bar Hours: Amy Cozzens, owner of the K-Bar presented the request to extend hours on Halloween and New Years and have spoken to the chief and other bar owners. They would like to be able to serve until 3 a.m. and have everyone out by 4 a.m. Mayor Wetzel asked for language to be drafted for an ordinance change and give an option annually to look at this. Attorney Kitchen will draft an ordinance for review. 2023 WAM Resolutions: Mayor Wetzel asked if they were in support of all 2023 WAM Resolutions presented. Councilman Hovivian moved to support the 2023 WAM Resolutions, seconded by Councilman Logan, unanimous approval, MOTION CARRIED.
Employment Agreement Zachary Thorington: No changes except the year on the agreement. Councilman Hovivian moved to approve and authorize necessary signature, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Ordinance No. 1, 2023: Attorney Kitchen read by title only - An Ordinance to Provide for the 2023-24 Budget for the City of Powell, Wyoming for the Fiscal year Beginning the First Day of July 2023 and Ending the 30th Day of June 2024. Councilman Logan moved to approve Ordinance No. 1, 2023 on second reading, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED.
Slurry Seal Bid: Administrator Thorington reviewed the slurry seal bids and is recommending to reject all bids and re-bid. Councilwoman Spencer moves to reject all bids and re-bid the slurry seal, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
General Announcements: WAM this week in Cody.
Adjourn: There being no further business to be considered at this meeting, Councilman Hovivian moved to adjourn, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Mayor Wetzel adjourned the regular meeting at 6:43 p.m.
