June 20, 2023
The governing body of the City of Powell met in regular session at 6:00 p.m. on June 20, 2023, in the Council Chambers of City Hall. Mayor John Wetzel called the meeting to order, and the following were present: Mayor John Wetzel, Council Members Lesli Spencer, Zane Logan, Tim Sapp, Floyd Young and Geoff Hovivian. Absent Council Members Steven Lensegrav. City Officials: City Administrator Zack Thorington, City Clerk Tiffany Brando, Building Official Ben Hubbard and via phone City Attorney Sandee Kitchen. Approval of Agenda: Councilman Young moved to approve the agenda as presented, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED. Approval of June 5, 2023: Councilwoman Spencer moved to approve as presented, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Bills and Claims: Mayor Wetzel abstained #53; Councilman Sapp #59; Councilman Hovivian #36. Councilman Young made a motion the bills be allowed and authorize the Treasurer to draw warrants for payment of the same, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED. Public Hearing: Budget Fiscal Year 2023-2024 – Attorney Kitchen opened the public hearing at 6:02 p.m., no comments, closed at 6:03 p.m. Ordinance No. 1, 2023: Attorney Kitchen read by title only - An Ordinance to Provide for the 2023-24 Budget for the City of Powell, Wyoming for the Fiscal year Beginning the First Day of July 2023 and Ending the 30th Day of June 2024. Councilman Hovivian moved to approve Ordinance No. 1, 2023 on third and final reading, seconded by Councilman Logan, unanimous approval, MOTION CARRIED.
Public Hearing: Reducing Clear Vision Triangle Area Section 17.36.060 - Attorney Kitchen opened the public hearing at 6:04 p.m., no comments, closed at 6:05 p.m. Ordinance No. 5, 2023: Attorney Kitchen read by title only – An Ordinance Amending Section 17.36.060 of the Powell City Code Pertaining to and Reducing the Clear Area Vision Triangle From 55’ to 25’ for the Location of Structures. Councilman Sapp asked the zoning and it is for Business General (B-G). Building Official Hubbard answered questions regarding hampering certain development and has been recommended by Planning & Zoning. Councilwoman Spencer moved to approve on first reading, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Request Waiver of Fees at the Commons for Paint the Town Red, Shelby Wetzel, NWC Foundation Director spoke on August 25th event and the use of the Commons. Councilman Hovivian moved to approve waiver of fees at the Commons, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Resolution No. 10, 2023: Waiver of Open Container June 26, 2023 @ Plaza Diane for a wedding reception. Councilman Young moved to approve, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED.
Mayoral Appointment: Thom Miller to Planning & Zoning. Councilman Logan moved to approve appointment, seconded by Councilman Young, unanimous approval, MOTION CARRIED. Ordinance No. 2, 2023: Attorney Kitchen Read by title only – An Ordinance to Change the Zoning Designation of N. 75’ of S. 150’ of W/2 Lot B; N 50’ of W/2 Lot B; the E/2 Lot B Excepting the S. 75’ and the N/2 of Lot A, All Within Block 38, Original Town of Powell, From B-G, General Business District. To R-M, Residential Mixed Use District. Councilwoman Spencer moved to approve Ordinance No. 2, 2023 on second reading, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED. Ordinance No. 3, 2023: Attorney Kitchen Read by title only – An Ordinance Amending Section 17.32.020(A) By Adding Subsection (7) Allowing Accessory Structures and Uses. Councilman Logan moved to approve Ordinance No. 3, 2023 on second reading, seconded by Councilman Young, unanimous approval, MOTION CARRIED.
Ordinance No. 4, 2023: Attorney Kitchen Read by title only – An Ordinance Enacting Section 17.32.035 on the Powell City Code to Allow Affordable Small Lot Exceptions to Minimum Lot Requirements In R-M, Residential Mixed Use District. Councilwoman Spencer moved to approve Ordinance No. 4, 2023 on second reading, seconded by Councilman Logan, unanimous approval, MOTION CARRIED. Ordinance No. 6, 2023: Attorney Kitchen Read by title only – An Ordinance Amending Section 5.080.040 of the Powell City Code Pertaining to Hours of Operation for Alcoholic Beverage Licensees by Allowing Request for Extended Hours for Two (2) Holidays Per Year. Councilman Hovivian moved to approve Ordinance No. 6, 2023 on first reading, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Policy & Procedure updates: 3.1; 4.1; 4.2; 5.8; 5.10; 5.11 Administrator Thorington discussed the changes as presented with an update on 5.11. Councilwoman Spencer moved to approve all policy & procedure updates as presented, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED.
Maintenance Agreement 360 Office Solutions – PAC copier – Councilman Logan moved to approve and authorize necessary signatures, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED. Change Order North Seventh Street Circuit Bore – Administrator Thorington discussed the decrease in price for the project with J&J Construction of $3180.00. Councilman Logan moved to approve and authorize all necessary signatures, seconded by Councilman Young, unanimous approval, MOTION CARRIED. Adjourn: There being no further business to be considered at this meeting, Councilman Logan moved to adjourn, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED. Mayor Wetzel adjourned the regular meeting at 6:21 p.m.
