January 4, 2021
The governing body of the City of Powell met in regular session at 6:00 p.m. on January 4, 2021 in the Council Chambers of City Hall. Mayor Wetzel called the meeting to order and the following were present: Mayor John Wetzel, Council Members Tim Sapp, Floyd Young, Lesli Spencer, Steven Lensegrav and Geoff Hovivian. City Officials: City Administrator Zack Thorington, City Clerk Tiffany Brando, City Attorney Sandee Kitchen and Deputy Attorney Scott Kath.
Unfinished Business of Current Seated Council: Approval of December 21, 2020 minutes: Councilman Young moved to approve minutes as presented, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED. Bills and Claims: Councilman Hovivian made a motion the bills be allowed and authorize the Treasurer to draw warrants for payment of the same, seconded by Councilman Young, unanimous approval, MOTION CARRIED.
Vacancy Ward II Appointment: Mayor Wetzel recommends Zane Logan be appointed to fill Scott Mangold’s vacancy. Councilman Lensegrav moved to approve Zane Logan appointment, seconded by Councilman Young, unanimous approval, MOTION CARRIED. Oath of Office: City Clerk Brando gave the Oath of Office to Mayor John Wetzel, Councilmembers Floyd Young, Lesli Spencer, Geoff Hovivian and Zane Logan. Approval of Agenda: Administrator Thorington asked to add under Administrative Gluten Free Oats Sale. Councilman Lensegrav moved to approve the agenda as amended, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
PUBLIC HEARING 6:00 PM: Retail Liquor License Application 241 West Coulter, LLC and Albertson’s, LLC. Attorney Kitchen opened the hearing 6:04 p.m. Eric Holzer with Albertson’s presented via Zoom on purchase of building at 1005 W. Coulter Ave with 12 months estimated for construction remodel. Mr. Holzer answered questions from Council. Mike Bailey owner of 241 W Coulter, LLC d/b/a Pit Stop #12 spoke on purchasing the business in 2012 and a remodel of the location into the existing carwash to add liquor and a food service by fall. Mr. Bailey answered questions from Council. Cami Yates from the Market at Powell asked how many grocery stores can Powell support and Trinell with the Market at Powell spoke in support of a local business in the area receiving the license. No further comments and closed at 6:20 p.m.
Council discussion on retail liquor license and Councilman Hovivian and Councilwoman Spencer looked at the job creation and economic development. Councilman Lensegrav discussed gaining employment either way and both have opportunities. Councilman Lensegrav asked Mr. Holzer he would still remodel without a license and Mr. Holzer stated, yes, they are in the planning stage. Mayor Wetzel indicated he would like the license to be operational sooner than later. Councilman Hovivian asked if Pit Stop #12 would continue expansion, Mr. Bailey indicated it would be pushed into the future if licensed not procured. Councilman Logan addressed the utility service for large commercial property. Councilman Sapp moved to approve the Retail Liquor License to Albertson’s LLC, seconded by Councilman Hovivian, AYE – Young, Hovivian, Logan, Sapp, Spencer NAY – Wetzel, Lensegrav, MOTION CARRIED.
Mayoral Appointments: Appointment of City Attorney Sandra S. Kitchen and Deputy Attorney R. Scott Kath, Councilman Hovivian moved to approve appointments, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED. Appointment of Bret T. Allred and approval of contract for Municipal Judge. Councilman Young moved to approve, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED. Ordinance No. 8, 2020: An Ordinance to Change the Zoning Designation of the Cottonwood Village Subdivision, Parcel I, from Its Current Designation of A-C, Agricultural Cultivation to R-L, Limited Residential District. Councilwoman Spencer moved to approve on third and final reading, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Gluten Free Oats Sale: Administrator Thorington updated council on the sale of the GFO Property and asked for an extension through the end of January. Councilman Young moved to approve and authorize necessary signatures for extension to January 31, 2021, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
There being no further business to be considered at this meeting, Councilman Lensegrav moved to adjourn, seconded by Councilman Hovivian unanimous approval, MOTION CARRIED. Mayor Wetzel adjourned the regular meeting at 6:34 p.m.
