December 7, 2020
The governing body of the City of Powell met in regular session at 6:00 p.m. on December 7, 2020 in the Council Chambers of City Hall. Mayor Wetzel called the meeting to order and the following were present: Mayor John Wetzel, Council Members Tim Sapp, Floyd Young, Lesli Spencer, Scott Mangold, Steven Lensegrav and Geoff Hovivian. City Officials: City Administrator Zack Thorington, City Clerk Tiffany Brando, City Attorney Sandee Kitchen, Deputy Attorney Scott Kath and Chief of Police Roy Eckerdt.
Approval of Agenda: Councilman Mangold moved to approve the agenda as presented, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Approval of November 16, 2020 minutes: Councilman Young moved to approve minutes as presented, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Bills and Claims: Mayor Wetzel abstained #54. Councilman Lensegrav made a motion the bills be allowed and authorize the Treasurer to draw warrants for payment of the same, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
PUBLIC HEARING 6:00 PM: Budget Amendment FY 2020-2021. Attorney Kitchen opened the hearing 6:02 p.m. Councilman Mangold asked for clarification on funds, Administrator Thorington gave a breakdown of Coronavirus Relief Grant Funds Request. No other comments, closed at 6:03 p.m. Resolution No. 17, 2020: A Resolution to Amend the 2020-2021 Budget. Councilman Mangold moved to approve and authorize necessary signatures, seconded by Councilman Young, unanimous approval, MOTION CARRIED.
PUBLIC HEARING 6:05 PM: Consider the Zoning Designation of Cottonwood Village Subdivision Parcel I to (R-L) Limited Residential Zoning. Attorney Kath opened the hearing 6:05 p.m., Ingrid Eickstedt spoke on the improved drainage near the proposed parcel off of 7th street and hopes the developer will continue appropriate drainage, Ms. Eickstedt also addressed a need for an accessible park in the area. Attorney Kath indicated similar comments at Planning & Zoning and the board approved the zone change. No other comments, closed 6:09 p.m.
Ordinance No. 8, 2020: An Ordinance to Change the Zoning Designation of the Cottonwood Village Subdivision, Parcel I, from Its Current Designation of A-C, Agricultural Cultivation to R-L, Limited Residential District. Councilman Mangold moved to approve on first reading, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED. Committee Updates: Councilman Mangold Recreation Board.
Resolution No. 18, 2020: Authorizing the Sale of Property to Gluten Free Oats, LLC. Attorney Kitchen reviewed items needed for the title commitment for the approved sale agreement October 5, 2020 and along with a resolution approval and authorize signatures for a Warranty Deed and State of Consideration. Councilman Lensegrav moved to approve Resolution No. 18, 2020, Warranty Deed and Statement of Consideration for sale of Property to Gluten Free Oats, LLC and authorize all necessary signatures, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Ordinance No. 6, 2020: An Ordinance Amending Section 6.04.030(A) of the Powell City Code Pertaining to Restrictions on Animals Within City Limits as Will Allow the Keeping and Slaughtering of Animals Pursuant to Sections 6.04.080 of the Powell City Code. Councilman Young moved to approve on third and final reading and authorize all necessary signatures, seconded by Councilman Mangold Aye – Wetzel, Young, Spencer, Mangold, Lensegrav, Hovivian Nay – Sapp, MOTION CARRIED.
Ordinance No. 7, 2020: An Ordinance Amending Section 6.04.080 of the Powell City Code Allowing for the Slaughtering of Animals at an Approved Slaughter House Facility. Councilman Mangold moved to approve on third and final reading and authorize all necessary signatures, seconded by Councilman Young. Aye – Wetzel, Young, Spencer, Mangold, Lensegrav, Hovivian Nay – Sapp, MOTION CARRIED.
2nd Re-Plat of Lot 8 Royal Subdivision: Attorney Kath reviewed the lot line adjustment and has been approved by Planning & Zoning. Councilman Sapp moved to approve and authorize necessary signatures, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED.
Slaughter House Approval at 887 E North Street: Administrator Thorington presented the request to authorize a slaughter house at 887 E North Street after the approval of Ordinance 6, 2020 and Ordinance 7, 2020. Councilman Sapp indicated he is not in favor of this location for a slaughter house. Councilman Mangold asked if all businesses have to come before council for approval of noise and smell in regards to an industrial area, and indicated the owner has already agreed to mitigate the issues addressed. Councilman Lensegrav spoke on adverse effects of the area, and Councilwoman Spencer spoke on the noise issue similar to a barking dog and that you can get a ticket for it and the area currently has a large number of residents. Mayor Wetzel addressed the discussion on property values similar to the transfer station topic and how those have not been adversely affected and those purchasing property recently in the area it is designated as an industrial area. Councilman Sapp made a notion to not approve the location at 887 E North St for a Slaughter House, seconded by Councilwoman Spencer. Aye – Sapp, Spencer; Nay – Wetzel, Mangold, Young, Lensegrav and Hovivian, MOTION FAILS.
Motion to approve the location at 887 E North St for a Slaughter House made by Councilman Mangold, seconded by Councilman Lensegrav. Aye – Wetzel, Mangold, Young, Lensegrav, Hovivian; Nay – Sapp, Spencer, MOTION CARRIED. Proud Cut Foods Agreement for Wastewater Pretreatment, Sewer Charges and Animals on Site: Councilman Lensegrav discussed the agreement with 48 hrs. listed and it was originally discussed 24 hrs. for emergent situations. Mr. Petersen addressed concern if it was over a weekend and is a worst-case scenario. Councilwoman Spencer indicated in initial meetings it was between 4 hrs. and 8 hrs. and with the time frame increased is a concern for houses and businesses in the area. Mr. Petersen is agreeable to change to 24 hrs. from 48 hrs. and this would be an anomaly to the norm. Councilman Sapp addressed the delivery time of animals as being 8 a.m. initially and other councilpersons indicated the time frame for live animals 5 a.m. to 7 p.m. was early. Discussion led to agreement of 6 a.m. to 8 p.m. Councilman Mangold moved to approve the agreement with the amendments of 24 hrs. and 6 a.m. to 8 p.m. for live animals to be on site, seconded by Councilman Young. Councilman Sapp also clarified language on $100 testing fee annually and Administrator Thorington indicated those fees do not change often. Aye – Wetzel, Mangold, Young, Lensegrav, Hovivian; Nay – Sapp, Spencer, MOTION CARRIED.
Caring for Powell Animals Agreement: Administrator Thorington indicated not any changes from previous agreement. Councilman Lensegrav moved to approve and authorize necessary signatures, seconded by Councilman Young, unanimous approval, MOTION CARRIED. Wastewater Testing Agreement Extension: Administrator Thorington explained an extension through 2021 and Councilwoman Spencer asked for results of the test and Administrator Thorington will email the link to Council. Councilman Spencer moved to approve and authorize necessary signatures, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Squad Car Bid Results: Fremont Motor Powell $29,475 and is under budget. Councilman Mangold moved to approve and authorize necessary signatures, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED.
There being no further business to be considered at this meeting, Councilman Young moved to adjourn, seconded by Councilman Lensegrav unanimous approval, MOTION CARRIED. Mayor Wetzel adjourned the regular meeting at 6:57 p.m.
