NOTICE OF PUBLIC HEARING
VACATION OF CERTAIN PUBLIC ROADS IN THE VICINITY OF GARLAND COMMUNITY CHURCH OF GOD PROPERTY (PIDN: 01569805600010 & 01559890361007) AND AMENDED PLAT OF THE ORIGINAL TOWN OF GARLAND (SCHOOL LOT AND BLOCK 4, LOT 1)
TO ALL WHOM IT MAY CONCERN: The Board of Commissioners of Park County (“Board”) is proceeding with consideration of the vacation of certain public roadways and alleyways in the vicinity of Garland Community Church of God Property (PIDN: 01569805600010 & 01559890361007; a.k.a. “the Church property”) located in the northwest corner of the Garland Townsite (Howard Bell, 1901), T. 55 N., R. 98 W., 6th PM, Park County, Wyoming. This Notice is provided, per the requirements of Wyoming State Statute § 24-3-110.
A Petition to vacate the referenced portion of public roadway (alley) was originally submitted to the Park County Clerk’s office on October 29, 2024. Said Petition was later resubmitted with a clarified legal description and additional signatures on February 14, 2025. Said road/alley sections described in the Petition are more particularly described as follows:
“The streets and alley surrounding the property addressed at 900 Sheridan Avenue, Garland, WY 82435, being Lots 1 and 2 of Block 4 and a parcel measuring 140 feet x 300 feet lying between Long Street and Howell Street along Sheridan Avenue of the town of Garland, Lot 56, T. 55 N., R. 98 W., 6th PM, Park County, Wyoming”.
The Board met on February 18, 2025, and reviewed the referenced Petition for vacating the referenced public roads and alleys adjacent to the Church property. Upon review of the referenced Petition, submitted and filed with the County Clerk, Resolution 2025-08 was approved by the Board initiating the procedures for vacation of the referenced public roadways/alleys. Said Resolution was duly recorded in the Park County Clerk’s Office as Document No. 2025-667 (Pages 1 & 2). The Resolution assigned Mr. Russell Blough, Wyoming registered land surveyor, as Viewer in accordance with State Statutes 24-3-103 and 24-3-104.
A Viewer’s Report, prepared by Mr. Blough, was presented to the Board on May 6, 2025. The Viewer recommended vacation of the subject public road sections in the vicinity of the Church property based on all available information. Said Viewer’s Report is available for review on the Park County website at www.parkcounty-wy.gov or at the Park County Public Works Department Offices located at 1131 11th Street in Cody. The Board accepted the Viewer’s recommendations and moved on May 6, 2025, to continue the vacation process for the subject roads.
NOW THEREFORE, all objections thereto or claims for damages by reason thereof must be filed in writing with the Park County Clerk before noon on the 16th day of June 2025, or such public road(s) may be vacated without reference to such objections or claims for damages.
FURTHER, at their regular meeting on Tuesday, June 17th, 2025, at 9:55 am, the Board will conduct a public hearing to consider any claims for damages and objections (if any). At said public hearing, the Board will also review and consider an Amended Plat Application of Garland Community Church of God, in conjunction with their request for vacation of the referenced public roads/alleys. The applicant intends to vacate the roads surrounding the school lot in the Original Town of Garland Plat. The Church property will be expanded by the addition of the land encompassing the roads thus vacated. The property is located in Tract 56 (Resurvey) of Section 4, T55N, R98W, of the 6th P.M., Park County, Wyoming, in the northwest corner of the townsite of Garland in the General Rural Powell (GR-P) Zoning District.
