ORDINANCE NO. 3, 2022
AN ORDINANCE VACATING TWENTY FEET OF ALLEY SOUTH OF LOTS 1 THRU 9, AND SIXTY FEET OF RIGHT OF WAY EAST OF LOT 1, SHOOPMAN SUBDIVISION NO. 3A, POWELL, PARK COUNTY, WYOMING.
WHEREAS, there has previously been annexed into the City of Powell by Ordinance #3 2020, and subsequently thereto subdivided and designated as Lots 1 thru 9 of the Shoopman Subdivision No. 3 said real property more particularly described as follows, to-wit;
A parcel of land located in Lot 62-C, Lot 62 (NESE, Original Section 14), T55N, R99W, 6th PM, Park County, Wyoming, and being a portion of the property described by the Warranty Deed recorded as Document 2019, Page 2467, at the Park County Clerk and Recorder’s Office in Cody, Wyoming, with said parcel of land described more particularly as follows:
Commencing at the 1½ inch aluminum cap found at the Northeast corner of said Lot 62-C; thence, N89̊°54’04”W, along the north line of said Lot 62-C, 489.94 feet, to a calculated position being the POINT OF BEGINNING of this parcel of land description.
Thence, from said Point of Beginning continue N89̊54’04”W, along said north line, 828.72 feet, to an “X” chiseled in concrete at the Northwest corner of said Lot 62-C; thence, S00̊04’45”W, along the west line of said Lot 62-C, 135.00 feet, to a calculated position, from which a 2 inch aluminum cap found at the Southwest corner of said Lot 62-C bears, S00̊04’45”W, along said west line, 1184.25 feet; thence, S89̊54’04”E, parallel to said north line, 828.79 feet, to a calculated position; thence, N00̊02’59”E, 95.00 feet, to intersect the right-of-way of Monroe Street at a 2 inch aluminum cap witness corner set; thence, continue N00̊02’59”E, 40.00 feet, to said Point of Beginning of this parcel of land description, containing 2.57 acres, more or less, and subject to all easements, rights-of-way and restrictions of record.
Basis of Bearing being Grid North according to the Wyoming State Plane Coordinate System, West Central Zone, with a bearing of N89̊54’04”W, along the north line of said Lot 62-C, 1318.66 feet, between the 1½ inch aluminum cap found at the Northeast corner of said Lot 62-C and the “X” chiseled in concrete at the Northwest corner of said Lot 62-C.
WHEREAS, the subject property has not yet been developed or improved and the Owners of the subject property have filed their petition, pursuant to WS 15-4-305, to vacate the platted alley abutting the southern 20-foot portions of Lots 1 thru 9 and vacating the 60 foot ROW abutting the Eastern property line of their subdivision, and;
WHEREAS, the petition to vacate is supported by the majority of abutting property owners located within 300 feet of the proposed alley and ROW to be vacated, and;
WHEREAS, the proposed vacating of the alley and ROW has been reviewed by Powell Planning and Zoning with a recommendation that it be approved by the Governing Body of the City of Powell, and;
WHEREAS, the City of Powell has determined that the vacating of the alley and ROW can be vacated without adversely impacting utility services and traffic circulation within the area and it being the desire of the governing body of the City of Powell to approve the proposed and petitioned vacation of the alley and ROW.
NOW, THEREFORE, it is hereby ordained by the Governing Body of the City of Powell, Park County, Wyoming as follows:
SECTION 1. That the 20-foot alley located South of Lots 1 thru 9 and the 60-foot ROW located East of and within the Shoopman No. 3A Subdivision as are both currently designated and platted be vacated. That no demand is being made by the City of Powell for the value of the land being vacated.
SECTION 2. That the alley and ROW vacated as set forth herein shall revert to the Owners of the Shoopman No. 3A Subdivision and an amended plat be prepared, submitted and recorded as will reflect this vacation.
SECTION 3. This ordinance shall be in full force and effect upon adoption and publication as required by law.
