FORECLOSURE SALE NOTICE
WHEREAS, on July 14, 2022, Randel Hooper and Courtney Hooper (collectively, “Borrowers”), as mortgagors, executed and delivered to Cassie’s Sprits, Inc., a Wyoming corporation (“Original Lender”), as mortgagee, a mortgage on the real property more particularly described in said mortgage as security for payment of the indebtedness evidenced by a promissory note in the principal amount of $2,000,000.00, which was executed by Borrowers in favor of Original Lender on the same date (the “Note”). Said mortgage was duly recorded at the office of the County Clerk and Recorder in and for Park County, Wyoming, on July 15, 2022, as Document No. 2022-4008 (the “Mortgage”) (with the Note and Mortgage hereinafter collectively referred to as the “Loan Documents”). On October 31, 2024, the Original Lender sold and assigned the Loan Documents to Cohano Investments, LLC, a Wyoming limited liability company (“Lender”). Said assignment of the Mortgage was duly recorded at the office of the County Clerk and Recorder in and for Park County, Wyoming, on October 31, 2024, as Document No. 2024-4921.
WHEREAS, there have been material breaches of the Loan Documents, and Borrowers are thus in default.
WHEREAS, the Mortgage contains a right of foreclosure provision which, by reason of the above-stated defaults, Lender, as the owner and holder of the Mortgage, declares to have become operative.
WHEREAS, as of November 15, 2024, the total amount due and owing to Lender under the Loan Documents is $1,913,382.74, which represents the unpaid principal balance of $1,891,136.26, plus accrued but unpaid interest in the amount of $20,543.58 (with interest continuing to accrue at the rate of $336.78 per diem), plus additional fees and charges in the amount of $1,702.90. The total amount due will also increase in an amount equal to Lender’s attorney’s fees and costs incurred to date and may further increase in an amount equal to any additional late charges, attorney’s fees and other charges, fees and/or costs which accrue pursuant to the terms of the Loan Documents.
WHEREAS, the property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale. Any prospective purchaser should research the status of title before submitting a bid.
NOW, THEREFORE, Lender will have the mortgage foreclosed as provided by law by causing the mortgaged property to be sold at public venue by the Sheriff or Deputy Sheriff in and for Park County, Wyoming, to the highest bidder for cash at 10:00 a.m. on December 18, 2024, at the front door of the Park County Courthouse located at 1002 Sheridan Avenue, Cody, Park County, Wyoming, for application on the above-described amounts secured by the Mortgage, said mortgaged property having an address of 214 Yellowstone Avenue, Cody, Wyoming 82414 and being more particularly described as follows, to-wit:
A tract of land being a portion of Lots 69 and 70, Township 52 North, Range 102 West, 6th PM, Park County, Wyoming, according to the records of the County Clerk and Recorder of Park County, State of Wyoming, described by metes and bounds as follows:
BEGINNING at corner no 3, the southwest corner of said lot 70, the same being identical with corner no. 4 of said Lot 69; thence S. 84° 47’ E. for a distance of 283.9 feet to the POINT OF BEGINNING of this description; thence N. 13°19’ E. for a distance of 161.9 feet; thence N. 78° 29’ E. for a distance of 282.4 feet; thence N. 80° 18’ E. for a distance of 183 feet; thence S. 0° 05’ W. for a distance of 290.3 feet to intersect the south boundary of said Lot 70; thence N. 84° 47’ W. along the south boundary of Lot 70 for a distance of 45.8 feet; thence S. 9° 25’ E. for a distance of 103 feet; thence S. 22° 23’ W. for a distance of 280.0 feet; thence S. 37° 45’ W. for a distance of 85 feet; thence S 59° 45’ W. for a distance of 335.3 feet; thence N. 0° 40’ E. for a distance of 525.2 feet; thence N. 14° 50’ W. for a distance of 90.3 feet: thence N. 13° 19’ E. for a distance of 36.90 feet more or less to the POINT OF BEGINNING, subject to the highway right-of- way.
