Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, October 18, 2022. Present were Vice Chairman, Scott Mangold, Commissioners Lee Livingston, Lloyd Thiel, Joe Tilden and Clerk Colleen Renner.
Stephen Dow led the audience in the pledge of allegiance.

Commissioners – RE: Continued Public Hearing for Leonhardt Variance
Chairwoman Overfield opened the continuation of the Leonhardt variance. The Leonhardt’s are withdrawing the variance and will begin working with the City of Cody for annexation.
Commissioner Livingston moved to close the public hearing, Commissioner Thiel seconded, motion carried.
Commissioners – RE: Retirement Recognition for Kelly Myrick from Solid Waste Division
Chairwoman Overfield presented a plaque and congratulated Mr. Myrick for his years of service with Park County. Mr. Myrick stated it has been an honor to serve the citizens of Park County.
Commissioners – RE: Continued Public Hearing for Leonhardt SUP
Chairwoman Overfield opened the continuation of the public hearing, stating that the Leonhardt’s have withdrawn their application and will begin working with the City of Cody to annex the property into city limits.
Commissioner Livingston moved to close the public hearing, Commissioner Mangold seconded, motion carried.
Ann Trosper, District Manager, Powell Clarks Fork Conservation District – RE: Annual Update
Ms. Trosper thanked the board for all their support. Two educational small acreage workshops covered irrigation rights and responsibilities, irrigation districts, designing small irrigation systems, weed management, irrigation rules for subdivisions and water master training. The workshops were a huge success, drawing 180 participants.
The Wyoming Water Development Commission is conducting a level one study approved by the Legislature and focusing “on farm” projects; multiple public meetings were held and well attended. A Bureau of Reclamation Water SMART grant will end 12/31/2022 with a complete report in January 2023.
A Wyoming Department of Agriculture grant installed 10 time-lapse cameras to correlate spikes in sediment measured at the Willwood Dam from various tributaries. This information is being shared with students from the University of Wyoming looking at sediment sources.
The water quality monitoring equipment is in dire shape and generally cannot be repaired. The cost of replacement is being investigated with estimates ranging from $15,000 to $20,000.
Chairwoman Overfield thanked Ms. Trosper for the updates.
Cody Shooting Complex – RE: Requesting Permission to file for SUP Amendment
Otis Smith, president of the shooting complex, presented a list of projects to be included in the SUP, including an archery range and parking lot, bunker trap, road pavement, a 1,000-yard range with limited access and a berm 10 feet tall and 100 feet long.
A lengthy discussion followed on what work has been done, a lack of detail on the direction of shooting and a need for specifics on where the projects will be located, updated legal descriptions and a new lease agreement.
Commissioners Livingston and Thiel raised issues with public health and safety on the county-owned property and reservations with current leadership not acting in good faith, including moving forward with projects after being asked to cease all activity on the new parcel until the SUP and new lease agreement are addressed.
Planning Director Joy Hill stated the developments must be clearer as they become the county’s responsibility. Chairwoman Overfield stated the board is in favor of the shooting complex under the correct rules and with cooperation, understanding that safety is the main goal. Commissioner Tilden agrees there are problems and miscommunication on both sides. He made a motion to allow the shooting complex to file a new SUP. Commissioner Mangold seconded and recommended moving forward with new additions and a draft lease agreement. Commissioner Thiel stated these are two totally separate issues. After discussion the motion was amended to approve the SUP application, and it carried.
Commissioner Thiel made a motion to send a letter providing a 90-day notice that the Board is re-writing the complex’s lease, Commissioner Tilden seconded, motion carried.
Kim Dillivan, Planning & Zoning – RE: Public Hearing: L&P MS-69 Sketch Plan
Chairwoman Overfield opened the public hearing.
Mr. Dillivan presented an application requesting approval of a two-lot minor subdivision consisting of one 12.10-acre lot and one 22.90-acre lot, each for residential use. The property is located one mile north of Cody in RR-2 zoning. Agency referrals, public notices have been met and no public comments received. Conditions from City of Cody, Rocky Mountain Power and for a weed management plan and irrigation water distribution plan have not been met. Commissioner Tilden questioned the soil concerns raised by the Cody Conservation District. Mr. Dillivan read the nine staff recommendations into the record.
Chairwoman Overfield called for public comments. William Sheets owns property to the north and has no issues. Cody Schatz of Engineering Associates stated the Conservation District uses soil maps and Rocky Mountain Power has two meters present on the property; one will need to go from ag to residential.
There being no further comments Commissioner Livingston moved to close the public hearing, Commissioner Thiel seconded, motion carried.
