Regular Meeting
Tuesday, October 15, 2024
Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, October 15, 2024. Present were Vice Chairman, Scott Steward, Commissioners Lee Livingston, Scott Mangold, Lloyd Thiel and Clerk Colleen Renner.
Michael Conners led the audience in the pledge of allegiance.
Chairwoman Overfield called for an Executive Session to be added at the start of this day’s agenda.
Executive Session.
Commissioner Livingston made a motion to enter executive session pursuant to W.S. § 16-4-405 (a)(ii), Commissioner Steward seconded, and motion carried.
Chairwoman Overfield called to end the Executive Session.
There were no decisions made in the session.

Commissioner Livingston made a motion to approve the following consent agenda items: October 1 and 8, 2024 minutes; Payroll for Elected officials of $102,976.98 and bi-weekly for employees $508,859.37; vouchers; monthly earnings and collection statements for the Clerk, Clerk of District Court, and Sheriff; approve and sign TANF/CPI FY24 Q4 Report; approve and allow Chair to sign lease extension for Cody Heritage Museum; MOU between Park County and State Parks; WYDOT Lease Agreement; Commissioner Thiel seconded, motion carried.

Jenny Cramer, Planning & Zoning – RE: Public Hearing: Davison Variance
Ms. Cramer presented the variance for Katie Hauck Davison, which would allow for a special use permit to operate a nonowner occupied short-term rental, defined as a highway commercial business, within a GR-P zoning District.
Notice requirements and agency referrals have been met. The property is located five miles Northeast of Powell. Neighboring uses are agricultural, residential, exempt BLM, and vacant lands. Staff recommends denial as two conditions, read into the record, have not been met.
Chairwoman Overfield called for public comments.
Applicant Ms. Davison stated traffic should be unaffected, neighboring owners are not against the variance, and she is in contact with Shoshone Irrigation.
There being no further comments, Commission Livingston moved to close the public hearing, Commissioner Mangold seconded, motion carried.
Commissioner Mangold made a motion to approve with staff conditions, Commissioner Thiel seconded. Commissioner Livingston is inclined to vote against, since it’s not owner occupied as other properties are within the county. Commissioner Mangold understands concern, but county regulations currently do allow, and Commissioner Thiel agrees. Ms. Hill, Planning Director stated the regulations do state that highway commercial is prohibited in GR-P zoning, so the variance is needed.
Chairwoman Overfield called for the question. Chairwoman Overfield opposed along with Commissioners Livingston and Steward. Motion is denied. RESOLUTION 2024-57
Jenny Cramer, Planning & Zoning – RE: Gimmeson SS-314 Final Plat Review
Ms. Cramer presented the final plat for Ray Gimmeson creating one 7.68-acre residential use lot, leaving a remainder parcel of 62.32-acres. The property is 3.5 miles Northeast of Powell and has an existing residence and outbuilding. The property is in GR-P zoning. Agency referrals have been met. Staff recommends approval with four conditions read into the record.
Commissioner Thiel moved to approve with conditions from staff, Commissioner Steward seconded, motion carried. RESOLUTION 2024-58
Commissioners Virtual Meeting with T-Mobile - No show
Commissioners – RE: Bentley Appeal Decision
Chairwoman Overfield asked Mr. Bentley regarding any changes since the last discussions, Mr. Bentley stated no.
Commissioner Thiel moved to grant the appeal request; Commissioner Mangold seconded. Discussion about liability regarding covenants. Commissioner Steward is willing to approve a variance for the building expansion but is hesitant on the sign. Commissioner Thiel explains the sign will follow current standards.
Livingston questioned if the motion included both the building expansion, and the sign for advertising, Commissioner Thiel stated yes, the motion includes both. Motion carried. RESOLUTION 2024-59

Commissioner Livingston made a motion to enter executive session pursuant to W.S. § 16-4-405 (a)(ii), Commissioner Thiel seconded, and motion carried.
