Chairman Tilden called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, June 16, 2020. Present were Vice Chairman, Lee Livingston, Commissioners, Dossie Overfield, Jake Fulkerson, Lloyd Thiel, and Clerk Colleen Renner.
Leo Wolfson led the audience in the Pledge of Allegiance.

Approve-Minutes, Payroll and Vouchers
Commissioner Overfield made a motion to approve the amended consent agenda. Added were the RCI Administrative Agreement and an Executive Session pursuant to W.S. § 16-4-405 (a) (ii). Minutes from June 2 and 9; bi-weekly payroll in the amount of $411,435.34 and elected payroll with insurance of $90,481.31; vouchers; monthly earnings and collection statements for the Clerk, Clerk of District Court, and Sheriff; and the 2020 Health Incentive; Commissioner Livingston seconded, and the motion carried.

Park County Commissioners – RE: Liaison Report
Commissioner Fulkerson reported on library, drug court and WCCA.
Commissioner Overfield reported on library, museum, fair, Southfork construction meetings and Health Insurance Committee.
Commissioner Livingston reported on fair and an upcoming travel council meeting.
Commissioner Theil reported on predator board, raven removal at landfill, Weed & Pest and Meeteetse Visitor Center.
Commissioner Fulkerson and Overfield attended the Lost Creek Fire meeting.
Park County Deputy Clerk Hans Odde – RE: Public Hearing: Renewal of all Park County Liquor Licenses
Chairman Tilden opened the public hearing.
Mr. Odde reported the 2020-21 renewal for the period beginning July 25, 2020 through June 24, 2021. The public hearing was advertised twice in in Cody and Powell newspapers. There are twenty-four licenses available in the county, twenty-one have renewed and all are in good standing with the State Department of Revenue and the Business Division of the Secretary of State. The fee increase is effective in this renewal collecting $18,100 for the licenses.
Chairman Tilden called for public comments, there being none, Commissioner Livingston made a motion to close the public hearing, Commissioner Thiel seconded, and motion carried.
Commissioner Fulkerson made a motion to renew liquor licenses as presented, Commissioner Livingston seconded, and motion carried.
Park County Commissioners – RE: Approval and Allow the Chairman to Sign the Park County 5th Penny Tax
Clerk Renner stated she received two signed resolutions from City of Cody dated June 2 and Town of Meeteetse dated June 10 requesting the Commissioners place the 5th penny question on the General Election Ballot on November 3. Commissioner Thiel made a motion to approve and allow the chair to sign this resolution, Commissioner Fulkerson seconded. Comments were made with regards to the use of the penny. This 5th cent will allow Park County to earmark for infrastructure, ongoing maintenance issues, and increasing utilities, to name a few. Ninety-nine percent of this penny comes back to the county, where only 34% of the four-cent tax comes back to the city, towns and counties based on population. The Board all agreed that the county will need to make major decisions regarding future budgets if the penny is not received. The Board encourages electors to do their homework and be the judge of whether the 5th penny is needed or not. Chairman Tilden called for the question, all in favor, motion carried. Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Merit Oregon Basin Communication Tower Special Use Permit-195
Chairman Tilden opened the public hearing.
Mr. Dillivan presented the application to allow construction of a 50-foot-tall communication tower with four 18-inch dish antennas and two omnidirectional antennas.The tower will be constructed near other Merit Energy infrastructure in the Oregon Basin oil field. The tower will be located on BLM land in which is un-zoned by the County. Legal notices and agency referral were all met. Written comments were received from Public Works and Weed & Pest, no public comments were received. Access to the facility is off State Hwy 120 and County Road 3FK.
Chairman Tilden called for public comments, there being none, Commissioner Livingston made a motion to close the public hearing, Commissioner Fulkerson seconded, and motion carried.
Commissioner Fulkerson made a motion to approve the application to build the communication tower, Commission Thiel seconded, and motion carried.
RESOLUTION 2020-23
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Lennon Major Subdivision Preliminary Plat Review
Chairman Tilden opened the public hearing.
Mr. Dillivan presented the preliminary plat application for Jason & Christine L. Lennon to vacate and re-subdivide Lot 13 of Musser Subdivision #3 into one 3.83-acre lot and one 2.16-acre lot, each for residential use. Notices were met and no public comments have been received. Conditions recommended by staff include that applicant provide all easements as requested and identify on the final plat. A water right distribution plan must be submitted and approved by State Engineer, and a statement stating “Northwest Rural Water is available to serve the subdivision and comply with Park County Development Regulations.
Chairman Tilden called for public comments, there being none, Commissioner Fulkerson made a motion to close the public hearing, Commissioner Overfield seconded, and motion carried.
Commissioner Overfield made a motion to approve the Lennon Major Subdivision Plat with condition of water rights distribution plan submittal to State Engineer as it is not required, Commission Livingston seconded, and motion carried. RESOLUTION 2020-24
10:45 a.m. Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Cody Shooting Complex Special Use Permit - 19
Chairman Tilden opened the public hearing.
Mr. Dillivan presented the review and approval of a SUP for continued use of a Major Recreation Facility. Park County is the owner and the property is located 2.6 miles NW of City of Cody. The parcel is split between two planning areas the Clark Planning Area is the northern portion, and the southern portion is the Cody Local Planning Area. The parcel is in GR-35 and major recreation is permitted provided a SUP is approved. The Shooting Complex is a 501c (4) organization and has been in operation since August 6, 1996. Legal notices and agency referrals have been met, written comments were received from Public Works, Fire District #2, Weed & Pest, Cody Conservation District, Heart Mountain Irrigation, Northwest Rural Water and Two Tough Guys Services, LLC but nothing from the public.
Chairman Tilden called for public comments, there being none, Commissioner Livingston made a motion to close the public hearing, Commissioner Thiel seconded, and motion carried.
Commissioner Thiel made a motion to approve SUP 194 as written with conditions, Commission Fulkerson seconded, and motion carried. RESOUTION 2020-25
Park County Landfill Manger, Tim Waddell – RE: Approval to Replace Landfill Operating Personnel
Mr. Waddell is requesting to fill the position of site foreman whom after 36 years is retiring. After discussion of waiting 90 days and the necessity of having two employees present for safety reasons, and Landfill being an enterprise fund, Commissioner Thiel made a motion to allow Mr. Waddell to advertise and replace the foreman position, Commissioner Livingston seconded, Commissioner Fulkerson questioned the savings of this being an entry level position. All in favor and motion carried.
Park County Planning & Zoning Director, Joy Hill – RE: Correction on Resolution 2019-41 Wyoming Game & Fish -184
Chairman Tilden turned the discussion over to Vice Chairman Livingston and abstained from the discussion.
Ms. Hill presented to the Board a correction on the resolution to clarify footprint vs. square footage which removes the wording of floor space. After discussion Commissioner Fulkerson made a motion correcting to 32,500 building footprint, Commissioner Overfield seconded and motion carried. RESOLUTION 2020-26
Park County Assessor, Pat Meyer – RE: Presentation Park County Assessor Office and Approval to Replace Personnel
Assessor Meyer presented a power point presentation on what is required of his office, to become a certified Wyoming appraiser. Mr. Meyer is a member of the International Association of Assessing Officers. Descriptions were given on mass appraisal and fee appraisal. the commissioners agreed to discuss Mr. Meyer’s request to fill a vacant position and make a decision this afternoon.
Preliminary Park County Budget Fiscal Year 2020-21 Continued
Planning & Zoning
County Assessor – after discussion regarding the budget the Board visited at length regarding the vacant position. Commissioner Thiel made a motion to allow the Assessor to refill the position, Chairman Tilden seconded. Commissioner Fulkerson, Overfield and Livingston opposed, and motion failed. Mr. Meyer was asked to come back in 90 days to revisit the situation which is being asked of all departments.
Public Health – which includes the pass-through grant budgets
County Coroner – no changes made at this time as he was unable to appear.
Land Environment – remain the same
Information Technology & E911
Homeland Security returned for more discussions.
Park County Commissioners – RE: Continue Discussion on Variance Exception Park County Restaurants
Dr. Billin briefed the Board on the changes taking place with the county health orders. The variance has been presented to the County Attorney for review and once he approves, will be sent to State Health Officer for final approval. Commissioner Thiel made a motion to send an email of support along with the variance, Commissioner Fulkerson seconded, and motion carried.
District Court – Judge Simpson appeared to defend his budget and give an update on the court system.
Executive Session.
Commissioner Overfield made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (ii), Commissioner Livingston seconded, and motion carried.
Commissioner Livingston moved to exit from executive session, Commissioner Thiel seconded, and the motion carried. No decisions were made in or as a result of the executive session.
