Chairman Livingston called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, June 15, 2021. Present were Vice Chairman, Dossie Overfield, Commissioners, Scott Mangold, Lloyd Thiel, Joe Tilden and Clerk Colleen Renner.
Bill Crampton led the audience in the Pledge of Allegiance.

Commissioner Tilden made a motion to approve the following consent agenda items: minutes from June 1 and 8; bi-weekly payroll in the amount of $420,228.92 and Elected payroll of $90,822.12; vouchers; monthly earnings and collection statements for the Clerk, Clerk of District Court, and Sheriff; amended Memorandum of Understanding between Wyoming Department of Health, Public Health Division and Park County; and lease agreement with Ragain & Clark, Commissioner Mangold seconded, and the motion carried.

Park County Deputy Clerk Hans Odde – RE: Public Hearing: Renewal of all Park County Liquor Licenses -
Chairman Livingston opened the public hearing.
Mr. Odde stated this is the annual renewal for the twenty-one full retail liquor licenses, four malt beverage permits, and one satellite manufacturer permit. There are twenty-four total full retail permits available outside city limits. All the licensees are in good standing with state compliance and sales tax divisions.
At the present time there are three licenses that are having issues with their Forest Service lease and the State is recommending approval with conditions on those three. The current licenses are good through July 24, 2021. If for some reason a lease is not extended the County and State would withdraw the renewal and the establishment would not be allowed to order liquor from the division. The satellite license does not have a place to dispense, they are working on getting a tap room within city limits.
Chairman Livingston called for public comment, there being none Commissioner Tilden made a motion to close the public hearing, Commissioner Thiel seconded, and motion carried.
Commissioner Overfield made a motion to approve the retail, malt beverage and satellite manufacturer licenses as presented contingent on Forest Service lease agreement, Commissioner Thiel seconded, and motion carried.
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Wapiti Red Barn Kiosk Addition SUP-217
Chairman Livingston opened the public hearing.
Mr. Dillivan presented to the board an SUP for Fred and Manda Siebert which included plan view drawing showing use, adding a food kiosk/food truck to sell ice-cream, snow cones, snacks, hotdogs, sandwiches and possibly coffee. The hours of operation would be Monday – Sunday, 9 a.m. to 8 p.m. and is located 20 miles west of Cody on highway 14-16-20. The zoning is GR-5 and a variety of uses are permitted.
Parking is sufficient, there is a convenience store and gas station with a residence in the rear of the store. Up to four chemical toilets will be used on the property during the period of operation of the kiosk/food truck which is from Memorial Day to Labor Day. Legal notices and agency referrals have been met. Commissioner Tilden questioned the disposal of grey water, Mr. Dillivan stated that is an issue for the owners to work out with DEQ.
Chairman Livingston called for public comments. Phil Campbell and Tamra Young made comments in favor of the addition. There being no further public comments Commissioner Tilden made a motion to close the public hearing, Commissioner Thiel seconded, and motion carried.
Commissioner Tilden made a motion to approve SUP-217 with the added to conditions and the others as presented, Commissioner Mangold seconded, and motion carried. RESOLUTION 2021-34
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Country Roads Minor Subdivision-51 Sketch Plan Review
Chairman Livingston opened the public hearing.
Mr. Dillivan presented the sketch plan for Jason and Jamie Bunker which is for a three-lot subdivision with two lots of 5.0 acres each and one lot 6.84 acres, all for residential use. The zoning is GR-P and is located 5 miles southwest of Ralston. Land use is primarily agricultural with some residential and three subdivisions are located within a ½ mile of the property. Legal notices and agency referrals have been met. Easements, water analysis results, requirement for wells and Farm & Ranch Act shall all be noted on the final plat.
Chairman Livingston called for public comments, Ms. Bunker stated she received the soil report. There being no further public comment, Commissioner Tilden made a motion to close the public hearing, Commissioner Overfield seconded, motion carried.
Commissioner Overfield moved to approve the sketch plan with conditions presented, Commissioner Tilden seconded, and motion carried. RESOLUTION 2021-35
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Kisgen Minor Subdivision-52 Sketch Plan Review
Chairman Livingston opened the public hearing.
Mr. Dillivan presented a notice of intent to subdivide. Mark Kisgen is requesting a two-lot minor subdivision consisting of two 20-acre lots for residential use. The zoning is GR-20 and is in Clark, south of County Road 8VE and west of County Road 8WC addressed as 168 Road 8VE. Legal notices and agency referrals have been met. Easements shall be provided, long-term noxious weed management plan and WY Right to Farm & Ranch Act along with wells permitted according to the State Engineers office shall all be placed on the Final Plat.
Chairman Livingston called for public comments, one written public comment was received. There being no further public comment, Commissioner Thiel made a motion to close the public hearing, Commissioner Tilden seconded, motion carried.
Commissioner Thiel moved to approve the Kisgen minor subdivision sketch plan as written with conditions, Commissioner Tilden seconded, and motion carried. RESOLUTION 2021-36
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Pony Trail Simple Subdivision-273 Final Plat Review
Mr. Dillivan presented the final plat for Tye & Jayme Whitlock who requested approval to create two lots. Easements must be identified on the final plat and applicant shall comply with the requirements of the Willwood Irrigation District.
Commissioner Tilden moved to approve the final plat with staff conditions, Commissioner Overfield seconded, and motion carried. RESOLUTION 2021-37
Park County Commissioners – RE: Public Hearing – Approve Final Park County Natural Resource Management Plan
Chairman Livingston opened the public hearing.
Ms. Hill presented the final plan after working with DJ&A Consultants which went out in April for public comments. There were many written comments received with regards to mechanized recreation, bikes, mountain bikes, wilderness study areas, fisheries, sport fishing, wild horses and burrows referred to as feral, reintroduction of black footed ferret, to name some of the topics. The document can be found at www.parkcounty-wy.gov.
Chairman Livingston called for public comments. Phyliss Preator, Gene Spiering, John Osgood, Jenny Dessaro, Marshall Dominic, Marian Morrison, and Mary Keller all made comments.
After discussion on how to proceed with a redraft which takes the comments received into consideration, it was decided to not allow any more public comments, Commissioner Overfield made a motion to close the public hearing, Commissioner Tilden seconded, and motion carried.
