Chairman Livingston called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, July 20, 2021. Present were Vice Chairman, Dossie Overfield, Commissioners, Scott Mangold, and Joe Tilden and Clerk Colleen Renner. Commissioner Lloyd Thiel was absent.
Cody Schatz led the audience in the Pledge of Allegiance.
Consent Items:
Approve-Minutes, Payroll and Vouchers
Commissioner Tilden made a motion to approve the following consent agenda items: minutes from July 6, 12 and 13, bi-weekly payroll in the amount of $410,361.82, vouchers, monthly earnings for the Clerk, Clerk of District Court, and Sheriff; approve and allow chairman to sign Northwest Center of Training and Development Memorandum of Understanding; Q3 FFY 2021 TANF/CPI Report; Assessment Roll for the Deaver Irrigation District; amended and restated Cooperative Agreement among the Wyoming Department of Transportation, City of Powell, and Park County and Chairman Livingston would request adding approval for Kim Dillivan to attend the FEMA Training August 29-September 3, Baltimore Maryland. Commissioner Mangold seconded, with the additional consent item added, the motion carried.

Planning & Zoning Planner II, Kim Dillivan – RE: Flying O Minor Subdivision Final Plat Review-42
Mr. Dillivan presented the final plat for Tom Quick approving a four-lot minor subdivision consisting of one 8.05-acre lot, one 9.18-acre lot, one 11.72-acre lot and one 8.37-acre lot for residential use. The parcel is in GR-5 with neighboring land uses as a mix of agricultural and residential. No public comments were received, and all conditions have been met.
Commissioner Overfield made a motion to approve as presented, Commissioner Tilden seconded, and motion carried. Resolution 2021-45
Planning & Zoning Planner II, Kim Dillivan – RE: Sandstone Ridge Minor Subdivision Final Plat Review – 43
Mr. Dillivan presented the final plat for Beth Anne Reiter approving five-lot minor subdivision consisting of one 14.17-acre lot, one 11.76-acre lot, one 10.70-acre lot, one 11.52-acre lot and one 9.95-acre for residential use, located in a RR-2 zoning district and is agricultural and residential vacant. No public comments were received, and all conditions have been met.
Commissioner Tilden moved to approve as presented, Commissioner Mangold seconded, and motion carried. Resolution 2021-46
Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Kimmett Commercial Storage Special Use Permit-218
Chairman Livingston opened the public hearing.
Mr. Dillivan presented a special use permit to expand an existing permitted major home occupation for a 2000-square foot public storage business by allowing additional storage units. The proposed expansion includes up to 10 storage containers, each measuring 8’ by 20’, for an addition of 1,600 square feet. This use is in the GR-20 zoning district in the Clark area. Legal notices and agency referrals have been met. Commissioner Mangold questioned the day-time hours only, Ms. Kimmett the applicant, stated that is in the contract the lessor signs.
Chairman Livingston called for public comment, there being none, Commissioner Tilden made a motion to close the public hearing, Commissioner Mangold seconded, and motion carried.
Commissioner Overfield made a motion to approve SUP-218 as presented, Commissioner Tilden seconded, and motion carried. Resolution 2021-47
Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Buck Creek Estates Major Subdivision Preliminary Plat Review
Chairman Livingston opened the public hearing.
Mr. Dillivan presented the preliminary plat review, the applicant is requesting approval of a 23-lot subdivision consisting of lots varying in size from 4.03 to 8.29 acres, each designated for residential and possible agricultural use. The zoning of the property is GR-P located between Powell and Cody. Public notices and agency referrals have been met. No written public comments have been received; however, during the Planning & Zoning Commission public hearing numerous members of the public expressed concerns regarding the creation of this subdivision. The applicant shall provide all easements as requested by applicable utilities; shall provide an approved Subdivision Improvements Agreement; shall comply with the recommendation of the Wyoming Department of Environment Quality (WYDEQ); floodplain requirements; Right to Farm & Ranch Act and the statement regarding the natural flow of any stream or river within or adjacent to proposed subdivision must all be identified on the final plat.
Chairman Livingston called for public comments.
Scott Lewis, Granite Engineering & Surveying addressed concerns raised regarding the land being taken out of ag use, fire and fire protection and the spraying of fields.
Alexandra Kurt and Spencer George commented and with time running out the Board decided to continue the public hearing. Commissioner Tilden made a motion to continue the hearing to August 3rd at 11:15 a.m., Commissioner Overfield seconded, and motion carried.
Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Westlinc Minor Subdivision – 48 Sketch Plan Review
Mr. Dillivan presented approval of a five-lot minor subdivision consisting of lot sizes varying from 5.76 acres to 8.86 acres for residential use. The property is owned by Westlinc LLC and located .8 miles south of Powell in GR-P zoning. Notices and agency referrals have been met, the applicants have requested administrative relief for the width of access right-of-way, which has been denied. All easements as requested by utilities and agencies providing services must be on the final plat. An HOA for road maintenance and snow removal must be submitted.
Chairman Livingston called for public comments.
Several comments were made concerning the water table and the loss of ag lands. There being no further comments, Commissioner Overfield made a motion to close the public hearing, Commissioner Mangold seconded, and motion carried.
Commissioner Mangold made a motion to approve the sketch plan, Commissioner Tilden seconded, and motion carried. Resolution 2021-48
Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Pheasant Ridge Minor Subdivision -53 Sketch Plan Review
Chairman Livingston opened the public hearing.
Mr. Dillivan presented approval of a five-lot subdivision consisting of four 3.36-acre lots and one 15.77-acre lot for residential use. Approval of this subdivision will create a remainder parcel of 43.61 acres. The proposed subdivision is located 2.2 miles east of the City of Powell and located in GR-P zoning district. Notices and agency referrals have been met and legal access exists.
Chairman Livingston called for public comment, there being none, Commissioner Overfield made a motion to close the public hearing, Commissioner Tilden seconded, and motion carried.

Planning & Zoning Planner II, Kim Dillivan – RE: Country Roads Minor Subdivision Final Plat Review- 51
Mr. Dillivan presented the applicants request for approval to create a three-lot minor subdivision comprised of two 5.0-acre lots and one 6.84-acre lot, all for residential use and is in GR-P zoning district. No public comments were received.
Commissioner Tilden moved to approve with conditions recommended Commissioner Overfield seconded, motion carried. Resolution 2021-50
Park County Commissioners – RE: Approve Park County American Rescue Plan Projects:
1. Park County Homeland Security Project - $167,852.15
2. Park County Telephone System - $225,000.00 – all county offices
3. Park County Sheriff Portable Radios (30) - $265,860.60
4. Park County IT Collaboration Equipment - $121.086.50
5. Park County Buildings & Grounds Touchless Water Fountains - $36,000.00
A total of $5.7 million funds has been provided to Park County. Ms. Kohn reported the five projects listed above and the recently approved ambulance request are the only funds being spent at this time.
Commissioner Overfield made a motion to approve as listed but not to exceed the amount, Commissioner Tilden seconded, motion carried.
Executive Session.
Commissioner Overfield made a motion to enter executive session pursuant to W.S. § 16-4-405 (ix), Commissioner Tilden seconded, and motion carried.
Commissioner Overfield moved to exit from executive session, Commissioner Tilden seconded, and the motion carried.
Commissioner Overfield made a motion to adopt the proposal discussed, Commissioner Mangold seconded, motion carried.
