Chairwoman Dossie Overfield called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, July 16, 2024. Present were Vice Chairman, Scott Steward, Commissioners Lee Livingston, Scott Mangold, and Clerk Colleen Renner. Commissioner Lloyd Thiel was absent.
Sheriff Steward led the audience in the pledge of allegiance.

Commissioner Mangold made a motion to approve the following consent agenda items: Minutes, 7/2/24; Payroll for Elected of $102,401.09 and employees of $494,945.55; vouchers; Monthly Earnings & Collection Statements for Clerk, Clerk of District Court, and Sheriff; approve and allow Chair to sign TANF FFY2024 Q3 Report; Annual Compensation Agreement for UW Extension Educator; approve and sign lease agreements for Bright Futures Mentoring, Open Lands, lease renewal for Merit Energy; approve and allow Chair to sign Catering Permit for Irma Hotel, Commissioner Steward seconded and the motion carried.

Park County Commissioners – RE: Public Hearing: Approval of Final Budget (FY24-25) and Amendments to the FY23-24 Budget.
Chairwoman Overfield opened the public hearing. Mr. Pomajzl read the resolution of amendments into the record; Commissioner Steward moved to approve Commissioner Livingston seconded motion carried. RESOLUTION 2024-37
Discussions on the proposed budget and items that were discussed at the public hearing the evening before with regards to decisions on dash & body cams for officers. Discussion regarding salaries and benefits for detention and patrol officers by increasing all wages by $2.00/hour plus the recommended cola and step increase. Commissioner Steward wanted to state the budget is not increasing but the difference in income is due to grant moneys.
Chairwoman Overfield called for public comment, Gary Carlson commented on the constitution and stated his disapproval of funds going to Forward Cody. Mr. Carlson believes that the distribution may be unconstitutional.
There being no further comments, Commissioner Mangold made a motion to approve, Commissioner Livingston seconded motion carried.
Annual Appropriation of Money for the maintenance and operation of Park County Fiscal Year ending June 30, 2025 - RESOLUTION 2024-38. Income necessary to provide financing Park County for Fiscal Year 2024-25. RESOLUTION 2024-39
Jenny Cramer, Park County Planning & Zoning – RE: Public Hearing: Mendoza Subdivision Preliminary Plat
Chairwoman Overfield opened the public hearing.
Ms. Cramer presented the applicant Lorenzo Mendoza’s request of a preliminary plat for a two-lot subdivision consisting of one 2.55-acre lot and one 1.58-acre lot for residential use owned by LM Construction LLC. Notices and agency referrals have been met and administrative relief for the road which has two existing maintenance agreements that relate to existing landowners that utilize Barrows Road which was dedicated to the use of the public by a previous subdivision plat. Public comments were received. Staff would recommend a road alignment be addressed by an amended plat, prior to final approval of this subdivision. Ms. Cramer read the ten conditions into the record if the board chooses to approve.
Chairwoman Overfield called for public comments. Cody Schatz, EA Engineering representing the applicant made clarification of perk test, irrigation box, Western Hills document Book 160-page 469 discussed maintenance and collection of fees, document was dated 1998 and expires in 2038. Sullivan subdivision (document 2014-2) also speaks on road maintenance. Brian Edwards, County Engineer spoke to the administrative relief granted. Don Hansen gave history since living there for the past 45 years. Tyler Hansen homeowner is in the right-of-way and willing to work on a remedy.
There being no further comments Commissioner Livingston moved to close the public hearing, Commissioner Steward seconded, motion carried.
After many questions regarding multiple issues and finding the best way to correct the path moving forward regarding road improvement agreements which would be a civil issue, amending the plat, family exemption, and the cul-de-sac. Ben McDonald, Assistant Engineer suggested research of vacating a portion of the road. Commissioner Livingston would like to look at possibilities and not decide today, so he made the motion to reopen the public and continue to September 3 and 9:35 a.m., Steward seconded, motion carried. Chairwoman Overfield stated working with staff and county attorney to look at the options.
Jenny Cramer, Park County Planning & Zoning – RE: Quiet Grove MS-76 Final Plat
Ms. Cramer presented the final plat for Taylor & Mariah Hubbell requesting a four-lot subdivision consisting of two 5.02-acre lots, one 5.01-acre lot and one 4.88-acre lot for residential and agricultural use with a parcel of 78-acres remaining. The Subdivision Improvements Agreement (SIA) is also up for approval which has been approved by the County Attorney. The property is in GR-P zoning, notices and agency referrals have been met. Staff recommends approval with seven conditions read into the record.
Commissioner Livingston moved to approve the SIA as presented, Commissioner Steward seconded, motion carried.

Jenny Cramer, Park County Planning & Zoning – RE: JL Sessions SS-319 Final Plat
Ms. Cramer presented the final plat for Lynn & Jim Sessions on behalf of landowner, NDTCO which will create a one 16.93-acre lot and one 16.94-acre lot from an existing 33.87-acre parcel. The property is in GR-P zoning, notices and agency referrals have been met. Staff recommends approval with four conditions read into the record, condition #2 has been met.
Commissioner Mangold moved to approve JL Sessions SS-319 with staff recommendations, Commissioner Livingston seconded, motion carried.
RESOLUTION 2024-41
Jenny Cramer, Park County Planning & Zoning – RE: Half Star MS-82 Final Plat Review with SIA
Ms. Cramer presented the final plat for Triple KB Ranch LLC on behalf of landowner, Cody Easum for approval of a subdivision resulting in one 15.15-acre lot and 77.18-acre exempt remainder parcel with a SIA which the County Attorney has approved to form. The property is in GR-P zoning and is currently vacant land. Staff recommends moving forward with seven recommendations read into the record. The property is not fenced, and the there is a sheep fence in place for the only neighbor who requires fencing. After discussion the board feels this meets requirements. Conditions two and three may be deleted and an SIA will not be necessary.
Commissioner Steward made a motion to approve with conditions amended by staff, Commissioner Livingston seconded, motion carried. RESOLUTION 2024-42
Jenny Cramer, Park County Planning & Zoning – RE: Booher MS-80 Final Plat Review with SIA
Ms. Cramer presented the final plat with a SIA for Rudi & Carla Booher with a surety performance bond for a three-lot subdivision consisting of one 12.20-acre lot, one 12.26-acre lot and one 12.43-acre lot for residential use. The Bond and SIA have been approved to form by the County Attorney. Staff recommends approval with five conditions read into record.
Commission Livingston made a motion to approve SIA with inclusion of the performance bond, Commissioner Mangold seconded, motion carried.
Commissioner Mangold moved to approve the final plat with staff recommendations, Commissioner Steward second motion carried. RESOLUTION 2024-43
Park County Commissioners – RE: Lodging Tax Resolution
Mr. Odde, First Deputy Clerk and Jennifer Thoma, Cody Chamber Director, presented the lodging tax resolution for consideration to continue in Park County, for the November 5th general election ballot. City of Powell, Cody and Town of Meeteetse Boards each signed for approval. After clarification of the county receiving 4% as in the past Commission Mangold moved to approve as presented for signatures, Commissioner Livingston seconded, motion carried. RESOLUTION 2024-44
Executive Session.
Commissioner Livingston made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (ix) & (a) (x), Commissioner Mangold seconded, motion carried.
Commissioner Livingston moved to exit from executive session, Commissioner Steward seconded, motion carried.
Commissioner Livingston moved to approve what was discussed in executive session, Commissioner Steward seconded motion carried.
Park County Commissioners – RE: Williams Consideration of Penalties
Chairwoman Overfield gave a history of penalties with regards to the landowners not getting permits for the uses and events on the property from June 30, 2023, to September 1, 2023, West Music Fest. Commissioner Livingston stated it was brought to the attention of the Board that the Williams were having unpermitted uses on the property, they contend they don’t need permits with the 1995 PUD. Commissioner Livingston read into the record that the PUD states “use of any portion of the property…shall obtain written approval and all permits required…”
Commissioner Livingston recommended penalties for $750/concert that took place without obtaining proper permits, Commissioner Steward seconded, motion carried. Chairwoman Overfield will forward to the Court System. RESOLUTION 2024-45
