Chairman Tilden called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, February 18, 2020. Present were Commissioners, Dossie Overfield, Jake Fulkerson, Lloyd Thiel, and Clerk Colleen Renner, absent was Vice Chairman, Lee Livingston.
Tycee Mohler led the audience in the Pledge of Allegiance.

Commissioner Thiel made a motion to approve the following consent agenda items as presented: minutes from February 4; bi-weekly payroll in the amount of $395,015.45; vouchers; and monthly earnings and collection statements for the Clerk, Clerk of District Court, and Sheriff; Commissioner Overfield seconded, and the motion carried.

Park County Landfill Manger, Tim Waddell – RE: Park County Landfill Bid Opening for Tractor Loader
Mr. Waddell received one bid in the Clerk’s office from Tractor and Equipment Co of Billings Montana for a Caterpillar track loader in the amount of $324,465.00 with trade-in of $209,000.00 leaving a balance of $115,465.00. Mr. Waddell will report back with recommendations.
Park County Commissioners – RE: GIS Committee Recommendation for Park County
Commissioner Overfield gave a brief update on the committee meetings and their recommendation is to move forward with ESRI training and each department will handle their own data. Commissioner Overfield made a motion for the County to go forward with ESRI/GIS, Commissioner Fulkerson seconded, and motion carried.
Park County Library Director, Frances Clymer and Chairman John Gordnier – RE: Approve Replacing Park County Library Director Position
Commissioner Tilden thanked Ms. Clymer for her years of service. Mr. Gordnier informed the Commissioners they will place the opening on the Wyoming Library System job website which includes 7 to 8 western states. Mr. Gordnier also requested that one member from the Commission be on the interview team not as a voting member but for their input.
Park County 4-H/Youth Development Extension Educator, Tycee Mohler – RE: Introduce Rural Living in Wyoming Workshop Proposal – “Barnyards & Backyards”
Ms. Mohler presented a reimbursable grant that Park County received from the University of Wyoming to present a workshop. The expenditures will total no more than $1,000 and be used for advertising purposes for the Barnyards and Backyards workshop. Commissioner Thiel moved to accept the reimbursable grant, Commissioner Overfield seconded, and motion carried.
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Llama’s Unlimited SUP - 193
Chairman Tilden opened the public hearing.
Mr. Dillivan presented for consideration of a Special Use Permit and Site Plan Review to allow a Dude Ranch and Resort in order to operate a llama ranch as an educational retreat. The applicants Justin & Levi Gerlach plan to provide one small cabin and three small silos for overnight guest accommodations, as well as two RV sites with additional portions of the property to be used for llama training. The proposed use is located at 5 Heart View Lane, (formerly 1473 Highway 14A), approximately 3.3 miles southwest of Ralston, parcel is located within a GR-P (General Rural Powell) zoning district. Legal notices and all agencies have been notified and comments received from entities but no public comments. There is an existing residence on the property which is used as the primary residence of the property owners. There are several existing shelters on the property for the llamas.
Chairman Tilden called for public comment. The owners were the only ones to comment and clarify several questions from the board. There bring no further public comment Commissioner Fulkerson made a motion to close the public hearing, Commissioner Thiel seconded, and motion carried.
Commissioner Fulkerson made a motion to approve the SUP allowing two additional employees with reminder of no employee housing, Commissioner Overfield seconded, after discussion Commissioner Thiel offered an amendment to the motion to allow one-night stays, the amendment died due to the lack of a second. Chairman Tilden called for the question and motion carried. RESOLUTION 2020-06
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Jensvold Simple Subdivision Final Plat 259
Mr. Dillivan presented for consideration a Subdivision Application received from Dale L. Jensvold, who is the registered agent for Jensvold Enterprises, LLC. The proposed subdivision is located approximately 2.0 miles southeast of Powell with an address of 955 County Road 6. The parcel is located within a GR-P zoning district with a 1-acre average minimum lot size. The surrounding land use is primarily agricultural with some residential nearby. No public comments have been received and no public hearing notices are required.
Commissioner Fulkerson made a motion to approve the final plat, Commissioner Overfield seconded, and motion carried. RESOLUTION 2020-07
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Leroux Simple Subdivision Final Plat 260
Mr. Dillivan presented a Subdivision Application from John F. Leroux, for a one lot simple subdivision located at 251 Adams Lane. Surrounding land use is primarily residential. The exempt 55.81-acre parcel is currently in agricultural use, and it accommodates a residence and other buildings. The applicant shall provide all easements as requested by applicable utilities and special districts, irrigation districts or public agencies providing services. Easements must be identified on the final plat, and no public comments were received.
Commissioner Thiel made a motion to approve the final plat, Commissioner Fulkerson seconded, and motion carried. RESOLUTION 2020-08
Park County Planning & Zoning Director, Joy Hill – RE: Revisiting Steedly Consideration of Fines
Ms. Hill presented the information regarding the septic tank that has been installed in the ground with an alarm and a physical inspection has been completed. The Commissioners discussed the length of this process and if fines need to be assessed sooner. Since no fines will be assessed a motion was not needed.
Park County Landfill Manger, Tim Waddell – RE: Approve Vendor for Purchase of Park County Landfill Tractor Loader
Mr. Waddell reported that specifications have been met and he recommends notifying Caterpillar of their successful bid. Commissioner Thiel made a motion to approve the purchase, Commissioner Fulkerson seconded, and motion carried.
Park County Engineer, Brian Edwards – RE:
• Review/Approve and Chairman sign changes to the CMAR contract
Mr. Edwards stated the contract has been cleaned up by Attorney Skoric with Filener accepting the changes and the agreement has been signed. Mr. Edwards explained the steps moving forward with start date of May 15th and meeting with City of Cody. Commissioner Thiel made a motion to allow the chair to sign the contract, Commissioner Fulkerson seconded, and motion carried.
• Review Viewer’s Report for Proposed Vacation of a Public Road Right-of Way (Alley) Located at the Back of Lots 1,2,3, & 4 on Clark Street in Ralston, Wyoming
Mr. Edwards presented some history which dates to 1907 when the Ralston townsite was officially established by Big Horn County. It appears that the alleyway has never been established or used by the public. It is not needed or used for emergency services or deliveries. Further, it is not anticipated that the public alley will be needed or used in the future. Should the property east of the Ralston townsite be developed and subdivided in the future, rights-of-way remain within the Ralston townsite to connect Carbon Street and Natrona Street, both public roads to any future development to the east. The proposed vacation of the alley for Lots 1, 2, & 3 is consistent with previous vacations for the alley for Lot 4 (Block 8) approved by the BOCC in 2011. Based on the information and findings summarized Mr. Edwards recommends accepting the Viewers Report and proceeding with the process to “vacate” the public roadway (alley).
Commissioner Fulkerson made a motion to accept the viewers report with the requirement of a $1,500 deposit, Commissioner Thiel seconded, and motion carried.
Park County Museum Board, Dakota Russell – RE: Approve Replacing Park County Museum Registrar
Mr. Russell introduced Brandy Wright, Museum Curator and they are requesting replacement of the registrar who has left the museum. Mr. Russell also requested that the curator be increased to a fulltime position which would eliminate the two part time positions.
Commissioner Overfield made a motion to accept the museum Boards recommendation to move to a full-time position at the rate of $12.54 plus benefits, Commissioner Fulkerson seconded, and motion carried.
Executive Session.
Commissioner Thiel made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (ii), Commissioner Fulkerson seconded, and motion carried.
Commissioner Fulkerson moved to exit from executive session, Commissioner Thiel seconded, and the motion carried. No decisions were made in or as a result of the executive session.
Park County Commissioners – RE: Interview for Park County Predator Board
Jay Reynolds and Breanne Thiel were interviewed for the Predator Board’s
open position. Commissioner Overfield made a motion to reappoint Breanne Thiel to the board, Commissioner Fulkerson seconded, Commissioner Thiel abstained from voting and, motion carried with Chairman Tilden voting aye.
