Chairman Livingston called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, December 21, 2021. Present were Vice Chairman, Dossie Overfield, Commissioners, Scott Mangold, Lloyd Thiel, Joe Tilden and Clerk Colleen Renner.
Chairman Livingston led the audience in the Pledge of Allegiance.

Approve-Minutes, Payroll and Vouchers
Commissioner Overfield made a motion to approve the following consent agenda items: minutes from December 7 and 14, bi-weekly payroll in the amount of $452,823.51; vouchers; approve and sign lease for AirPro; sign two postage machine rental agreements, Commissioner Tilden seconded, Clerk Renner stated the monthly earnings were approved at the December 7th meeting, Commissioner Overfield was good with amending the motion to remove that item from the agenda, and motion carried.

Brian Edwards, Public Works Department – RE: Open bids for new pickup trucks for Landfill/Road & Bridge
Mr. Edwards stated two bids were received at the Clerk’s office. Commissioner Thiel questioned the purchase of one or two trucks, Mr. Edwards stated one will be purchased. Bert Miller with Denny Menholt and Brent Silva with Fremont Ford both commented that no fleet trucks are available, and trucks are being built by order.
Denny Menholt bid a half-ton 4wheel drive crew cab for $42,975. Fremont Motors bid a Ram 1500 for $38,386 optional $2,900 extended warranty making the total $41,286. Mr. Edwards will look the bids over and return with his recommendation.
30 X 30 Resolution Discussion –
Chairman Livingston said the 30 x 30 plan is an Executive Order where President Biden directed the Secretary of Interior and others to develop a program to conserve at least 30 percent of the lands and waters in the United States by 2030. Chairman Livingston stated the Federal Government does not own these lands, the citizens of Wyoming own these lands and they are managed by BLM and the Forest Service. Commissioner Tilden made a motion to approve the resolution with the changes discussed, Commissioner Thiel seconded, and motion carried.
Bucky Hall – RE: CYAIR
Mr. Hall explained that CYAIR works with promoting commercial air service to Yellowstone Regional Airport. United will again serve the Chicago flights through September and bid on essential air service. With that said CYAIR account was wiped out.
Discussions on where CYAIR receives their funds Mr. Hall stated most through donations, municipal and county governments. YRA and Travel Council cannot give dollars for promoting this service. SkyWest, Alaskan Airlines, Delta was also discussed.
Commissioner Tilden made a motion to give CYAIR $26,000 as we need to support the group which the Board has in the past through Special Funding, Commissioner Mangold seconded, with further discussions Chairman Livingston called for the question, Commissioner Thiel opposed, and the motion carried.
Sheriff Scott Steward and Undersheriff Varian, Park County Sheriff’s Office – RE: Replacement of patrol rifles & request for temporary over hire
Sheriff Steward gave a brief background on the rifles, the age, reliability of them and has put out for three different bids. Several employees finished armor school and are going through the weapons. The budget may or may not need to be amended. Commissioner Tilden made a motion to allow, Commissioner Mangold seconded, motion carried.
Sheriff stated that the employee that was planning on retiring in May will be staying on, so the department is over hired at this time. Commissioner Overfield made a motion to allow the Sheriff to do the hire if it falls within his budget, Commissioner Tilden seconded, motion carried.
Sheriff Steward updated on Homeland Security, 24 applications received, very qualified and will begin vetting to interview sometime in January. Working with grants at the state level also.
Brian Edwards, Public Works Department – RE: Review bids for new pickup trucks for Landfill & Road/Bridge and Consider Purchase Award
Mr. Edwards looked over the bids and recommends that both vehicles be purchased. Commissioner Thiel moved to allow the purchase of one of each, Commissioner Tilden seconded, Commissioner Overfield questioned the budget coverage, motion carried.
RE: Review bids for new track excavator(s) for Landfill/Road & Bridge (Bids opened 12/7/21) and consider Purchase Award
Mr. Edwards reported this equipment is new to Landfill and Tri-State Equipment is allowing us to test it so would like to postpone the decision until after first of year.
RE: Review bids for new articulating dump truck for Landfill Division (Bids opened 12/7/21) and consider Purchase Award
Mr. Edwards stated this long-term investment with a low bid of $452,416 from T&E Equipment. Commissioner Thiel suggested that we investigate used, Commissioner Tilden would like to be sold on why after all these years this equipment is needed. Mr. Edwards stated much more material is being moved and we would not need to hire outside to help with the operational deficiencies. Mr. Edwards will report back in January.
Executive Session.
Commissioner Overfield made a motion to enter executive session pursuant to W.S. § 16-4-405 (a) (i-xi), Commissioner Tilden seconded, and motion carried.
Commissioner Mangold moved to exit from executive session, Commissioner Thiel seconded, and the motion carried. No decisions were made in or as a result of the executive session.
Bryan Skoric, County Attorney Re: Discussion and Decision on Opioid Settlement
Attorney Skoric stated Wyoming has been involved with the opioid litigation and settlements and are currently getting counties to sign the agreement which states and local political subdivision against the three largest pharmaceutical distributors and Johnson & Johnson. After further discussion regarding funds, participation, opioid abatement, participation in both agreements and OneWyo MOA. Commissioner Overfield made a motion to allow chair to sign the agreements as presented, Commissioner Tilden seconded, motion carried.
Brian Edwards, Public Works Department – RE: Sewer Lagoons
Mr. Edwards stated Philip Bowman, Public Works Director, City of Cody, and Engineering Associates have been working on the lagoons, taking steps to move forward in preliminary design by hiring an Engineering Firm to do a detailed analysis of alternatives for long-term solutions based on the firm’s feedback. Mr. Edwards believes we could get someone on board for $150,000 or less. Commissioner Mangold questioned why not just move forward with the City of Cody. Mr. Edwards stated the City is taking on the risk and a 30-year commitment and would like to move forward with confidence. Commissioner Thiel made a motion to allow $150,000 ARPS funding for further general analysis the wastewater project to acquire a level two design, Commissioner Tilden seconded, motion carried.
RE: Staffing Needs for Public Works Department
• Equipment Operator / Mechanic at Road & Bridge Division
Mr. Edwards has requested to re-classify a position in the Powell Road & Bridge division. Commissioner Thiel made a motion to fill within the department a mechanic/operator position; Commissioner Mangold seconded after hearing the pros and cons in doing this move, all in favor, motion carried.
• Administrative Assistant at Landfill
Discussion hiring Administrative Assistant. After discussions, Commissioner Overfield moved to approve hiring an Administrative Assistant for the park county landfill, Commissioner Thiel seconded, motion carried. 
Jason Lund, CPA Carver Florek & James, CPAs Re: Audit Presentation via Zoom
Mr. Lund thanked the Board for accommodating with a zoom meeting. Mr. Lund reported SEFA was not prepared in a timely manner with regards to returning the Charitable Relief Program funds. It took the firm about 400 hours to complete the audit and are so appreciative of the Treasurer and Clerk and other departments that we work with during the process. Entities needing to be reviewed is Search & Rescue and the commissary account which have both been discussed with the Sheriff. During the inventory review one item was overstated as the quantity count did not align with the item price.

Kim Dillivan, Park County Planning & Zoning Re: Final Plat for Gillette Family SS-263
Mr. Dillivan presented the final plat for Ronnie Gillett which is requesting approval to split one 8.48-acre lot and one 8.50-acre lot out of an existing 316-acre parcel which is in GR-P zoning. Some ag and residential surround the property. Agency referrals have been met and a water distribution plan approved.
Commissioner Mangold moved to approve the final plat as presented, Commissioner Thiel seconded, motion carried.
Wendy Morris, Healthy Park County Re: Quarterly update
Ms. Morris presented the Board members with a handbook which was distributed to 2,300 middle and high school parents. Ms. Morris also gave highlights on the alcohol safety, Ask11.org and the prescription take back collection days.
Commissioner Overfield attends the meetings and stated there are usually 18-20 participants that work together on these topics and more.
