Chairman Tilden called to order a regular meeting of the Board of County Commissioners of Park County, Wyoming, on Tuesday, December 15, 2020. Present were Vice Chairman, Lee Livingston, Commissioners, Dossie Overfield, Jake Fulkerson, Lloyd Thiel, and Clerk Colleen Renner.
Commissioner Livingston led the audience in the Pledge of Allegiance.

Commissioner Livingston made a motion to approve the following consent agenda items: minutes from December 3 & 8, elected payroll $90,847.08; bi-weekly payroll in the amount of $419,394.66; vouchers; monthly earnings & collection statements for Clerk, Clerk of District Court and Sheriff; Approve and Allow Chairman to Sign Grant Award Agreements Between Wyoming Office of Homeland Security and Park County for $56,132, $12,349 and $55,000 with a $55,000 match (three grants in total) Commissioner Fulkerson seconded, and the motion carried.

Park County Engineer, Brian Edwards – RE: Open Bids for 2020 or Newer 1 Ton Chassis Only 4WD Pickup – Park County Public Works Department
Clerk received one bid from Denny Menholt Chevrolet in the amount of $40,859 with $10,000 for the trade in. Mr. Edwards will look over the bid and report back.
Park County Planning & Zoning Planner II, Kim Dillivan – RE: Public Hearing: Cramer Minor Subdivision Sketch Plan Review - 44
Chairman Tilden opened the public hearing.
Mr. Dillivan presented the application received from William Cramer with description of proposed use, sketch plan and copy of notice to subdivide. The request is for a five-lot minor subdivision consisting of one 21.67-acre lot, one 17.30-acre lot and three 10 acre lots. The property is in GR-P zoning district and located 1.5 miles north of Powell. Notices and agency referrals with comments have been met and one public comment received. After brief discussion regarding raptors, wildlife in regulations and the Wyoming Right to Farm and Ranch Act of 1991 listed under staff recommendations Commissioner Livingston made a motion to close the public hearing, Commissioner Thiel seconded, and motion carried.
Commission Livingston made a motion to approve as presented, Commissioner Thiel seconded, and motion carried.
RESOLUTION 2020-82
Park County Planning & Zoning Planner II – Kim Dillivan – RE: Public Hearing: Woodsmythes Variance
Chairman Tilden opened the public hearing.
Mr. Dillivan presented an application requesting a variance to allow flexibility to establish a major industrial use in a residential zoning district. Chris Taylor is the applicant, the property is owned by Marshall Dominick, Beacon Hill Land Company. A 2018 variance was approved but expired. If approved the site will continue to be used for a log processing site. Legal notices and agency referrals have been met. No public comments have been received.
Chairman Tilden called for public comments, there being none, Commissioner Livingston made a motion to close the public hearing, Commissioner Overfield seconded, and motion carried.
Commissioner Overfield made a motion to approve the variance as requested, Commissioner Fulkerson seconded, and motion carried. RESOLUTION 2020-83
Park County Planning & Zoning Planner II – Kim Dillivan – RE: Public Hearing: Woodsmythes Special Use Permit - 213
Chairman Tilden opened the public hearing.
Mr. Dillivan presented an application including plan-view drawings showing a log processing yard for constructing hand-crafted log home buildings, vicinity map and impact on adjacent properties. The log-yard will be operated by a 3-person crew during the hours of 7 a.m. – 6 p.m. Monday through Saturday and consists of five acres of a 322-acre parcel. A variance was requested which allows for major industrial use in R-H zoning district. Legal notices, agency referrals were sent, and no public comments received.
Chairman Tilden called for public comments, there being none, Commissioner Thiel made a motion to close the public hearing, Commissioner Livingston seconded, and motion carried.
Commissioner Livingston made a motion to approve the SUP with the condition clarifying that a chemical toilet is authorized for use on the property, Commissioner Thiel seconded, and motion carried. RESOLUTION 2020-84
Park County Historic Preservation Board Chair, Dakota Russell – RE: Approve and Allow the Chairman to Sign Park County Historic Preservation Commission Annual Report
Mr. Russell gave an update of the projects making progress this year including Wite Cabin at Needle Creek, and surveying barracks originally from the Relocation Camp in the Big Horn Basin. Chairman Tilden congratulated the preservation board on everything they do for Park County. Commissioner Livingston made a motion to approve the annual report, Commissioner Overfield seconded, and motion carried.
 Northwest Rural Water District Manager, Tony Rutherford – RE: Approve and Allow Chairman to Sign Order of the Park County Board of County Commissioners Petition for Enlargement of the Northwest Rural Water District without Election
Mr. Rutherford presented a draft petition for enlargement without election. All documentation was for the enlargement to proceed with signatures of registered voters and the real property has been reviewed by the NWRW Board. Commissioner Livingston made a motion to approve and allow the chair to sign, Commissioner Thiel seconded, and motion carried.
Park County Engineer, Brian Edwards – RE: Presentation of Viewers Report to Consider Vacation of Public Road Easements Along Castle Rock Road and Update on Proposed Vacation on Road 6JM, Portions of Road 54 and Road 54b
Mr. Edwards presented the viewers report involving Castle Rock Road which connects Road 6 NS to the Southfork Road. All public easements are being vacated during the process and will include Road 54 and 54B and 6JM. A portion of the easement on 6NS does not follow alignment with Castle Rock Road and the State Land track. After a brief history and more discussions on the process of moving forward with the help of Attorney Skoric, Commissioner Overfield made a motion to accept the viewers report and continue with the vacation, Commissioner Livingston seconded, and motion carried.
Chairman Tilden requested the commissioners consider allowing county employees to have all of Christmas Eve off. Commissioner Overfield stated that some departments like the court system already have schedules made and may not be able to take the entire day off. After discussion Chairman Tilden called for the question. Commissioner Overfield made a motion to allow the employees a full day off on December 24, Commissioner Fulkerson seconded, Commissioner Thiel and Livingston opposed, Chairman Tilden voted in favor, and motion carried.
Park County Engineer, Brian Edwards - RE: Review and Consider Staff Recommendations for Purchase of 2020 or Newer 1 Ton Chassis Only 4WD Pickup for Park County Public Works Department
Bids were received and opened earlier, after reviewing the only bid received Mr. Edwards made a recommendation to accept the $40,859 bid for a 2021 Chevy Silverado with a trade in of $10,000. Commissioner Fulkerson made a motion to accept the recommendation, Commissioner Livingston seconded, and motion carried.
Park County Commissioners – RE: Presentation to Outgoing Commissioner Jake Fulkerson
Chairman Tilden presented a plaque and picture to Commissioner Fulkerson for his service to Park County.
