Cody man arrested for use of controlled substances, indecency

Cody resident Christopher Badia was arrested Wednesday and charged with being under the influence of controlled substances, interfering with a peace officer and public indecency, all misdemeanor charges. 

According to Cody Police Sgt. Beau J. Egger and Officer Jason Potter arrived at Shoshone Court apartments after reports of a man allegedly walking with his pants down and genitalia exposed. Potter spoke with Badia and cited him with public indecency before removing him from the premises for trespassing. 

Later that evening, Egger went to Cody Middle School after receiving reports of an “unresponsive male subject in the women’s bathroom at the tennis courts.”

According to the affidavit, the two individuals who had called the police had arrived at the courts and noticed a yellow bicycle parked near the girls bathroom. After leaving for a period of time to go to Maverik, the individuals returned and noticed the bike had not moved.

After knocking on the men’s room door and receiving no response, one of the individuals knocked on the women’s room door.  From within the women’s restroom, Badia allegedly informed the individual he was OK but did not respond further. 

Egger identified himself as police and also received no responses from Badia.

“Concerned the subject may be having a medical event, I tried to open the door and found it was locked. I called for officer [Brandon] Tillery to respond to my location,” Egger said in the affidavit.

After further failed attempts to contact Badia, Tillery picked the lock. 

“When the door opened, we looked and saw Christopher Badia with his pants down on the toilet looking at his phone,” Egger said in the affidavit.“Badia appeared to be lethargic and unresponsive. Badia got off the toilet and came outside after we ordered him to do so.”

When outside of the women’s restroom, Badia was allegedly unsteady on his feet, and his eyes were “extremely dilated.” He admitted to having alcohol earlier that evening and refused Egger’s attempt to perform a test for alcohol impairment.

Badia was placed under arrest and questioned at the Park County Detention Center. 

At this point, it was discovered that Badia is a registered sex offender in Nevada, but he is not required to register as one  in the state of Wyoming. 

When questioned about drugs Badia had taken, he claimed he was only taking large amounts of Benadryl and Molixicam. According to Egger, this combination would not produce the level of impairment Badia demonstrated. 

Badia was charged on March 10, 2022, with possession of methamphetamine in an amount less than 3 grams in Cody. 

Currently he is being held in the Park County Detention Center with a bond of $10,000.

If released on bond, he will have to submit to random testing and is not allowed on school or park grounds or other areas where children gather. 

A jury trial is scheduled for Dec. 1, 2022.
