City Council Proceedings
May 5, 2025
The governing body of the City of Powell met in regular session at 6:00 p.m. on May 5, 2025, in the Council Chambers of City Hall. Mayor John Wetzel called the meeting to order, and the following were present: Council Members Tim Sapp, Floyd Young, Steven Lensegrav, Zane Logan, Geoff Hovivian and Troy Bray. City Officials: Administrator Zack Thorington, City Clerk Tiffany Brando, City Attorney Alexa Rolin, Building Official Ben Hubbard and Police Chief Jim Rhea. Approval of Agenda: Councilman Young moved to approve the agenda as presented, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Approval of April 21, 2025 Minutes: Councilman Lensegrav moved to approve as presented, seconded by Councilman Young, unanimous approval, MOTION CARRIED. Bills and Claims: Mayor Wetzel abstained #48. Councilman Lensegrav made a motion the bills be allowed and authorize the Treasurer to draw warrants for payment of the same, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED.
PUBLIC HEARING: Request for Zone Change Lots 9, 10, 11, 12 and 13, Block 28, Original Town of Powell, park County, Wyoming also known as 115 East 3rd Street, Powell, park County, Wyoming from Residential General (R-G) to Business General (B-G). Attorney Rolin opened the hearing at 6:02 p.m. no comments, closed 6:03 p.m. Ordinance No. 4, 2025: Attorney Rolin read by title - An Ordinance to Change the Zoning Designation of the Real Property Described Below, From General Residential (R-G) to Business General (B-G). Mayor Wetzel asked for the zoning of the area to the west and currently it is residential. Councilman Lensegrav asked the purpose of the re-zone and Building Official Hubbard explained the current setbacks are 25ft and by changing it would decrease that setback to 0 ft for an addition of a covered area, they would need to keep the line-of-sight triangle by the corner. Planning & Zoning Member Thom Miller discussed concerns brought to planning & zoning regarding any future sale of the building and it no longer being residential within a residential neighborhood. City of Powell zoning map shown and Councilman Hovivian asked if the Building Official had any concerns, he did not. Councilman Lensegrav moved to approve on first reading, seconded by Councilman Bray, aye Mayor Wetzel, Councilmembers Young, Lensegrav, Logan, Hovivian and Bray, nay Councilman Sapp, MOTION CARRIED.
Committee Updates: Councilman Young YCan, Councilman Bray Urban Systems and Traffic Committee and Councilman Logan Recycle Board. Proclamation Nurse’s Week May 6-12, 2025: Mayor Wetzel read the proclamation for Nurse’s Week. Proclamation 56th Annual Professional Municipal Clerk’s Week May 4-10, 2025: Councilman Logan moved to approve, seconded by Councilman Bray, unanimous approval, MOTION CARRIED.
2024 Tree City USA Designation: Mayor Wetzel recognized 35 years of Tree City USA. Discussion Sage Brews, Wines and Spirits Patio and Event Space: Attorney Rolin discussed the memo sent with the agenda and discussions on the liquor law with the Liquor Division and City Clerk. Restroom access inside the licensed building for those under 21 years of age escorted by parents, legal guardians or spouse. Attorney Rolin presented 3 options for changes to make the patio accessible for those under 21 years of age; a change in ordinance 5.08.250 to remove age restrictions; a new seasonal permit, or update to language in 5.08.250 in regard to commercial kitchen, also noted option for portable bathrooms for access. Councilman Bray stated it would be up to the owner to mitigate the bathroom situation and putting the ownness on the owner; he is in favor of option 1. Council discussion on permit process. Mayor Wetzel asked the City Clerk to discuss the options with the owner and work with legal to draft an ordinance after discussions.
Ordinance No. 3, 2025: Attorney Rolin ready by title – An Ordinance to Amend Ordinance 5.08.095 (D) Related to Alcohol Consumption on City-owned Property. Councilman Hovivian moved to approve on third and final reading with all necessary signatures, seconded by Councilman Bray, unanimous approval, MOTION CARRIED.
Resolution No. 2, 2025: A Resolution Updating Fees and Charges at the Powell Aquatic Center and Establishing an Effective Date of July 1, 2025. Councilman Logan moved to approve and authorize all necessary signatures, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED.
Hangar Lease Agreement – Orville Moore: Administrator Thorington discussed the hangar lease agreement for the City Hangar and it has been signed by Orville Moore. Councilman Hovivian moved to approve and authorize necessary signatures, seconded by Councilman Young, unanimous approval, MOTION CARRIED.
Unified Certification Program WYDOT Disadvantaged Business Enterprise Program: Administrator Thorington stated it is done every 3 years for the airport with the FAA. Councilman Lensegrav moved to approve and authorize necessary signatures, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Adopt Capital Improvement Plan FY26-30: Administrator Thorington discussed the capital improvement plan for future projects. Councilman Sapp moved to adopt the plan as presented, seconded by Councilman Bray, unanimous approval, MOTION CARRIED. Adjourn: There being no further business to be considered at this meeting; Councilman Lensegrav moved to adjourn, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED. Mayor Wetzel adjourned the regular meeting at 6:37 p.m.
