City Council Proceedings
June 2, 2025
The governing body of the City of Powell met in regular session at 6:00 p.m. on June 2, 2025, in the Council Chambers of City Hall. Mayor John Wetzel called the meeting to order, and the following were present: Council Members Tim Sapp, Steven Lensegrav, Zane Logan, Geoff Hovivian and Troy Bray. Absent Councilman Floyd Young. City Officials: Administrator Zack Thorington, City Clerk Tiffany Brando, Chief of Police Jim Rhea, Finance Director Kaela Nelson, Building Official Ben Hubbard and City Attorney Alexa Rolin. Approval of Agenda: Councilman Lensegrav moved to approve the agenda as presented, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Approval of May 19, 2025 Minutes: Councilman Logan moved to approve both as presented, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED.
Bills and Claims: Councilman Hovivian made a motion the bills be allowed and authorize the Treasurer to draw warrants for payment of the, seconded by Councilman Logan, unanimous approval, MOTION CARRIED. PUBLIC HEARING 6:00 P.M.: Application to Transfer Ownership of Retail Liquor License held by KBLA, Inc to CJ Foods, LLC at 331 W Coulter Ave, Powell, WY. Attorney Rolin opened the hearing at 6:02 p.m. no comments, closed 6:03 p.m. Councilman Hovivian moved to approve the transfer of ownership and authorize all necessary signatures, seconded by Councilman Logan, unanimous approval, MOTION CARRIED.
SWEARING IN OFFICER JONATHAN SHAMEL: Mayor Wetzel gave oath of office and welcomed Officer Shamel. Resolution No. 6, 2025: Request for Waiver of Open Container WYOld West Brewing Company 10 Year Anniversary June 7, 2025 4pm-11pm at Plaza Diane to include sidewalk and parking space closure. Mayor Wetzel asked Chief Rhea if any issue, none. Councilman Lensegrav moved to approve, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED. Request Waiver of Fees for Paint the Town Red at the Commons August 22, 2025. Councilman Logan moved to approve, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Resolution No. 7, 2025: Request for Waiver of Open Container for Paint the Town Red Aug. 22, 2025 from 3pm-11pm in designated area indicated on the map. Councilman Lensegrav moved to approve, seconded by Councilman Bray, unanimous approval, MOTION CARRIED. Employment Agreement Zack Thorington: Mayor Wetzel recommended approval. Councilman Hovivian moved to approve and authorize necessary signatures, seconded by Councilman Logan, unanimous approval, MOTION CARRIED.
WAM Membership Meeting Discussion: Mayor Wetzel discussed the action items to be voted on, minutes, membership dues and by-laws and at the WAM Board meeting were approved and reviewed by their attorney. Powell’s increase is 2% and would recommends voting for all items. Councilman Lensegrav moved to authorize the voting delegate to vote in favor of all action items as presented, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Tabled Ordinance No. 4, 2025: Councilman Logan moved to remove Ordinance 4, 2025 from the table, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Ordinance No. 4, 2025: An Ordinance to Change the Zoning Designation of the Real Property Described Below, From General Residential (R-G) to Business General (B-G). Father Jim Schumacher of St. Barbara’s Church of Powell discussed the need for handicap accessible bathrooms and for congregating indoors. Lee Craig spoke on behalf of the building and finance committee and the request to re-zone to have an addition that has been planned for 10 years. Mr. Craig also spoke on the concern for children’s safety as one of the biggest concerns for the parishioners as well. Mayor Wetzel asked if the plans presented were the primary plan. Kelly Spiering spoke on the conceptual plan and the line-of-sight regulation will be in the plan when finalized. Rebekah Smith asked for the timeline of the build to indicate traffic concerns and safety of children. Mike Dunleavy spoke on the line-of-sight issue and any proposed addition would comply with the line-of-sight ordinance, spoke of the congestion being mitigated by the additional parking lot and other projects within the church to limit congestion including 3 services. Ms. Smith expressed concern with traffic and obscuring views and those running stop signs. Ms. Smith discussed an accident involving her husband on Absaroka and is lucky to be alive, asked if it would be better suited to build to the east instead. Tony Daniel spoke on the issues of traffic and safety and feels the items should be tabled until the plan has been finalized. Mr. Craig stated they have explored other options for building and structurally to the East is not an option and building to the south is the best option. William Smith spoke on being hit in that intersection and physically injured during the accident; he is concerned with the addition the crowd being pushed further into the street and concerned on children in the area and the deterred vision. Mary Vail also lives on Absaroka and attends the church, she stated these issues were all brought up when they widened Absaroka Street and to her knowledge it has not significantly changed. Ms. Vail stated accidents have happened on other streets and bad drivers are not the responsibility of the church. Kristy Fields spoke on the concerns of those gathered outdoors and the additional space inside would not force those to gather outside, the utilization of the acquired parking lot and other areas with much worse vision and no 4-way stops. Ms. Fields stated they would not do something that would cause harm to children in the area, and the area is already surrounded by businesses, and they see the church as an extension of the downtown businesses. Daniel Catone spoke in support of the re-zone and not seeking special treatment. Mayor Wetzel does not see an issue with the zone change, Councilman Lensegrav agreed with the sight triangle and will be better than others nearby, he stated accidents are sometimes just accident and cannot plan for it. Councilman Bray did not see a reason whey they should not be able to use their property. Councilman Logan stated looking at the zoning, the request is an appropriate location and use. Councilman Logan made a motion to approve Ordinance No. 4, 2025 on seconded reading, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED. Ordinance No. 5, 2025: Attorney Rolin read by title - An Ordinance to Provide for the 2025-26 Budget for the City of Powell, Wyoming for the Fiscal Year Beginning the First Day of July, 2025 and Ending the 30th Day of June 2026. Councilman Sapp moved to approve on second reading, seconded by Councilman Logan, unanimous approval, MOTION CARRIED.
Ordinance No. 6, 2025: Attorney Rolin read by title – An Ordinance to Amend Section 10.08.010 of the Powell City Code Pertaining to the Incorporation of the Uniform Act Regulating Traffic on Highways. Attorney Rolin spoke on updating the code section and the exceptions are not current to make it more concise for law enforcement and to utilize Title 31 when writing citations. Councilman Bray moved to approve on first reading, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED.
Ordinance No. 7, 2025: Attorney Rolin read by title – An Ordinance to Amend the Ordinance Section 9.08.00 of the Powell City Code Pertaining to Disorderly Conduct. Chief Rhea spoke on conflicting language and keeping municipal violations in municipal court. Councilman Logan moved to approve on first reading, seconded by Councilman Bray, unanimous approval, MOTION CARRIED. Ordinance No. 8, 2025: Attorney Rolin read by title – An Ordinance to Pertaining to the Adoption of the Municipal Drug Paraphernalia Ordinance into Chapter 9, Section 8 of the Powell City Code. Councilman Lensegrav moved to approve on first reading, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED.
Ordinance No. 9, 2025: Attorney Rolin read by title – An Ordinance to Repeal Ordinance Section 9.12.040 of the Powell City Code Pertaining to Disturbing the Peace. Attorney Rolin spoke on combining the section with that in Ordinance 7. Councilman Hovivian moved to approve on first reading, seconded by Councilman Logan, unanimous approval, MOTION CARRIED. Ordinance No. 10, 2025: Attorney Rolin read by title – An Ordinance Pertaining to the Adoption of the Municipal Criminal Trespass Ordinance into Chapter 9, Section 16 of the Powell City Code. Chief Rhea spoke on currently only able to send to circuit court and not in municipal court. Councilman Lensegrav moved to approve on first reading, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Agreement Park County School District #1 for Powell Aquatic Center: Administrator Thorington discussed COLA increase added by PCSD#1 and no other changes. Councilman Sapp moved to approve an authorize all necessary signatures, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED.
Bid Award Slurry Seal: Administrator Thorington gave low bidder as Morgan Pavement $2.48 per square yard. Councilman Bray moved to accept the low bid and authorize all necessary signatures, seconded by Councilman Logan, unanimous approval, MOTION CARRIED. Bid Award Chip Seal: Administrator Thorington gave the low bidder as Wild West Construction $4.00 per square yard. Councilman Hovivian moved to accept low bid and authorize all necessary signatures, seconded by Councilman Bray, unanimous approval, MOTION CARRIED. WYDOT Highway Safety Behavioral Grant: Chief Rhea spoke on funding for overtime for DUI and seatbelt safety. Councilman Lensegrav moved to approve and authorize all necessary signatures, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Agreement Diagle Law Group: Administrator Thorington discussed NDA reviewed by attorneys and is for sergeants and communication supervisor training. Councilman Hovivian moved to approve and authorize signatures of 3 sergeants and communications supervisor for the Supervisor & Command Training with Diagle Law Group, seconded by Councilman Bray, unanimous approval, MOTION CARRIED. Amendment Operation and Maintenance Agreement Powell Country Club, Inc: Administrator Thorington stated to amend the date to 2026 for compliance with liquor division. Councilman Lensegrav moved to approve and authorize necessary signatures, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
WMPA Policy Statement for Behind Meter Generation and Proposed City Policy: Administrator Thorington discussed the member policy with WMPA and meeting with Councilman Logan and Finance Director Nelson who prepared a city policy for review and would like to credit the customer instead of cutting a check each year. Councilman Logan thanked Finance Director Nelson for work on the policy and spoke on the goal for generation going back on the grid and investing in technology and distributing the credit from the agency to the customer as close as possible. Administrator Thorington stated this will give the City a process to follow when anyone wants to add solar or wind generation. Councilman Bray moved to approve the WMPA Policy Statement for Behind Meter Generation and the Proposed City Policy, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED. General Announcements: Administrator Thorington stated the splash pad soft opening was a hit.
Adjourn: There being no further business to be considered at this meeting; Councilman Hovivian moved to adjourn, seconded by Councilman Logan, unanimous approval, MOTION CARRIED. Mayor Wetzel adjourned the regular meeting at 7:11 p.m.
