June 7, 2021
The governing body of the City of Powell met in regular session at 6:00 p.m. on June 7, 2021 in the Council Chambers of City Hall. Council President Tim Sapp called the meeting to order and the following were present: Council Members Tim Sapp, Floyd Young, Lesli Spencer, Steven Lensegrav, Geoff Hovivian and Zane Logan. Absent Mayor John Wetzel. City Officials: City Administrator Zack Thorington, City Clerk Tiffany Brando, City Attorney Sandee Kitchen, Chief of Police Roy Eckerdt and DPW Ben Hubbard. Approval of Agenda: Councilwoman Lesli moved to approve the agenda as presented, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED. Approval of May 17, 2021 minutes: Councilman Young moved to approve minutes as presented, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Vining Substation Change Order #1: Addison Construction – Councilman Logan moved to approve the change order, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Bills and Claims: Councilman Lensegrav made a motion the bills be allowed and authorize the Treasurer to draw warrants for payment of the same, seconded by Councilman Young, unanimous approval, MOTION CARRIED. Swearing in new Police Officer: – Council President Sapp swore in David Salters. PUBLIC HEARING: 6:00 PM Re-Zone 456 S Bent St. – Attorney Kitchen opened hearing at 6:04 p.m., Council President Sapp brought forward the question on Industrial General (IG) almost surrounding the property and Residential General (RG) is across the street. Discussion on city code definition of spot zoning 17.08.115. DPW Hubbard spoke on Planning and Zoning recommendation as is contiguous with Residential General. No further comments, closed hearing at 6:08 PM.
Ordinance No. 8, 2021: An Ordinance to Change the Zoning Designation of 456 S Bent Street from IG, Industrial General, to RG, Residential General. Councilman Logan asked for reason for the proposed change and Councilwoman Spencer asked for clarification on what could potentially be on the lot. DPW Hubbard addressed prospective buyer to turn into a duplex and is approx. 14,000 feet so largest housing could be a 6-plex. Councilman Lensegrav moved to approve on first reading, seconded by Councilman Young, aye; Young, Spencer, Lensegrav, Hovivian and Logan, nay; Sapp, MOTION CARRIED.
WYOld West Brewing catering permits for Plaza @ 5 June 10th, June 7th, June 24th, July 8th and July 15th; Resolution No. 8, 2021: A Resolution of Open Container for Plaza @ 5 June 10th, June 7th, June 24th, July 8th and July 15th; Request for Transient Vendor at Plaza Diane June 10th, June 7th, June 24th, July 8th, July 15th and Aug. 21st. Councilwoman Spencer moved to approve catering permits, Resolution No.8, 2021 and the request for transient vendor at Plaza Diane, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED.
WYOld West Brewing catering permit Aug. 21st at Plaza Diane Renaissance Fair; Resolution No. 9, 2021: A Resolution for Open Container Aug. 21st at Plaza Diane Renaissance Fair. Councilman Hovivian moved to approved the catering permit and Resolution No. 9, 2021 for the Renaissance Fair, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Committee Updates: Councilman Lensegrav Recreation Board, Councilman Logan Recycle Board, Councilman Young YCAN and Councilman Hovivian Tree Board.
Ordinance No. 7, 2021: An Ordinance to Provide for the 2021-22 Budget for the City of Powell, Wyoming for the Fiscal Year Beginning the First Day of July 2021 and Ending the 30th Day of June 2022. Administrator Thorington gave an update on amended pages. Councilman Lensegrav moved to approve as amended, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Amended Plat of Cottonwood Village Subdivision Parcel 1Lots (5, 6, 14 &15): Councilman Lensegrav asked for clarification on the alley access off Lot 15. DPW Hubbard stated it was recommended by Planning & Zoning. Councilwoman Spencer moved to approve and authorize all necessary signatures, seconded by Councilman Logan, unanimous approval, MOTION CARRIED. Amended Plat Water Tower West Addition Lot 4 Block 2: Attorney Kitchen stated recommendation by Planning & Zoning and is City property. Councilman Young moved to approve an authorize all necessary signatures, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED. Bid Results Slurry Seal: Administrator Thorington recommends low bid from Asphalt Preservation; $40k under budgeted amount. Councilman Lensegrav moved to approve and authorize all necessary signatures, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED.
Bid Results Asphalt: Administrator Thorington recommends Quality Asphalt Paving. Councilman Hovivian moved to approve and authorize all necessary signatures, unanimous approval MOTION CARRIED. Dispatch Services Agreement w/ Powell Valley Healthcare: Administrator Thorington updated the 5-year contract expired June 30, 2020. Unable to renew with pandemic, price was increased and services offered updated. Councilman Hovivian abstained from voting. Councilman Logan moved to approve and authorize all necessary signatures, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Emergency Insect Management Program Grant Agreement: mosquito grant agreement matching of $3750. Councilwoman Spencer moved to approve and authorize all necessary signatures, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED.
There being no further business to be considered at this meeting, Councilman Young moved to adjourn, seconded by Councilman Young, unanimous approval, MOTION CARRIED. Council President Sapp adjourned the regular meeting at 6:27 p.m.
