June 21, 2021
The governing body of the City of Powell met in regular session at 6:00 p.m. on June 21, 2021 in the Council Chambers of City Hall. Mayor John Wetzel called the meeting to order and the following were present: Council Members Tim Sapp, Floyd Young, Lesli Spencer, Steven Lensegrav and Geoff Hovivian. Absent Councilman Zane Logan. City Officials: City Administrator Zack Thorington, City Clerk Tiffany Brando, City Attorney Sandee Kitchen and Deputy Attorney Scott Kath. Approval of Agenda: Mayor Wetzel requested addition under Mayor/Council of Wyoming Business Council Amendment for Clocktower Inn of Powell. Councilwoman Lesli moved to approve the agenda as amended, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED.
Approval of June 7, 2021 minutes and June 14, 2021 special meeting minutes: Councilman Young asked for correction on June 7, 2021 minutes on page 2 he seconded the slurry bid and he did not 2nd adjourning. Councilwoman Spencer made the second to adjourn. Councilman Young moved to approve minutes as amended, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Bills and Claims: Councilman Hovivian made a motion the bills be allowed and authorize the Treasurer to draw warrants for payment of the same, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Red Zone catering permit July 10th at the fairgrounds for alumni. Councilman Young moved to approve, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED. Resolution No. 10, 2021: Wavier of Open Container the Elks Club Wednesday Night Dinner. Councilman Lensegrav moved to approve, seconded by Councilman Young, unanimous approval, MOTION CARRIED. Committee Updates: Councilman Lensegrav Golf Board. Mayoral Appointments: Mayor Wetzel re-appointed Jeff Sheridan to Board of Adjustment and Scott Hicswa to the Tree Board. Councilman Young moved to approve appointments, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
WAM Voting Delegate: Councilman Lensegrav moved to appoint Mayor Wetzel for WAM 2021, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Amendment One to Grant Agreement Between the Wyoming Business Council and the City of Powell: Mayor Wetzel discussed approval by the Business Council for extension as the Council had previously sent a letter of support, completion date is June 30, 2024. Councilman Sapp moved to approve and authorize all necessary signatures, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED. Ordinance No. 7, 2021: An Ordinance to Provide for the 2021-22 Budget for the City of Powell, Wyoming for the Fiscal Year Beginning the First Day of July 2021 and Ending the 30th Day of June 2022. Councilman Young moved to approve on third and final reading, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Ordinance No. 8, 2021: An Ordinance to Change the Zoning Designation of 456 S Bent Street from IG, Industrial General, to RG, Residential General. Councilwoman Spencer moved to approve on second reading, seconded by Councilman Hovivian, aye; Wetzel, Young, Spencer, Lensegrav, Hovivian and Logan, nay; Sapp, MOTION CARRIED. Development Agreement First Development Park Lot 6: Attorney Kath reviewed the agreement and has been signed by the owner. Councilman Sapp moved to approve and authorize necessary signatures, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED. Ordinance No. 9, 2021: An Ordinance Amending Section 5.08.010 of the Powell City Code Pertaining to Definitions in the Alcoholic Beverage License Chapter by Adding a New Definition for the Term “Sealed”. The changes come after this year’s legislative update. Councilwoman Spencer moved to approve on first reading, seconded by Councilman Lensegrav, unanimous approval. MOTION CARRIED.
Ordinance No. 10, 2021: An Ordinance Amending Section 5.08.095 of the Powell City Code Regarding Restrictions for Permits to be Utilized Upon Facilities Owned, Operated and Maintained by the City of Powell. Mayor Wetzel has asked for this change and discussed authority given to the Clerk to authorize. Councilwoman Spencer moved to approve on first reading, seconded by Councilman Young, unanimous approval, MOTION CARRIED.
Policy and Procedure updates: Updates for policies 1.1, 1.3, 3.5, 3.10, 4.1, 4.3, 5.4, 6.2, 6.3, 7.4, 7.5 and 7.6 as presented. Administrator Thorington stated new updates for 1.1, 1.3 and 4.3 have been handout out after attorney review. Councilman Lensegrav moved to approve as presented, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED. Vining Substation Change Order #2: Addison Construction Co – Administrator Thorington discussed for the fencing around and unable to reuse the existing. Councilman Hovivian moved to approve the change order #2 and authorize necessary signatures, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Capital Construction Loan Program – Loan Agreement – Vining Substation Upgrade and Expansion: Administrator Thorington discussed the loan approval from 2020 and the following loan documents will need approval: Resolution No. 11, 2021: A Resolution Authorizing the Loan Transaction CCL21001 PA Through he Wyoming Loan and Investment Board; Capital Construction Loan Program CCL21001 PA Loan Agreement; Capital Construction Loan Program CCL21001 PA Security Agreement and Financing Statement; and Certification Statement. Councilman Lensegrav moved to approve all as presented and authorize all necessary signatures, seconded by Councilman Young, unanimous approval, MOTION CARRIED.
There being no further business to be considered at this meeting, Councilwoman Spencer moved to adjourn, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED. Council President Sapp adjourned the regular meeting at 6:19 p.m.
