July 3, 2023
The governing body of the City of Powell met in regular session at 6:00 p.m. on July 3, 2023, in the Council Chambers of City Hall. Council President Tim Sapp called the meeting to order, and the following were present: Council Members Tim Sapp, Floyd Young, Zane Logan, Steven Lensegrav and Geoff Hovivian. Absent Mayor John Wetzel and Council Member Lesli Spencer.
City Officials: City Administrator Zack Thorington, City Clerk Tiffany Brando, Police Lt. Matt McCaslin and via phone City Attorney Sandee Kitchen. Approval of Agenda: Councilman Logan moved to approve the agenda as presented, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED. Approval of June 20, 2023: Councilman Young moved to approve as presented, seconded by Councilman Logan, unanimous approval, MOTION CARRIED.
Bills and Claims: Councilman Hovivian abstained #35. Councilman Lensegrav made a motion the bills be allowed and authorize the Treasurer to draw warrants for payment of the same, seconded by Councilman Young, unanimous approval, MOTION CARRIED.
Swearing in Police Officer Isaac Gutierrez: Lt. McCaslin presented Officer Gutierrez with his shield and Council President Sapp gave the oath of office. Committee Updates: Councilman Logan Recycle Board and Councilman Lensegrav Rec Board. Ordinance No. 2, 2023: Attorney Kitchen Read by title only – An Ordinance to Change the Zoning Designation of N. 75’ of S. 150’ of W/2 Lot B; N 50’ of W/2 Lot B; the E/2 Lot B Excepting the S. 75’ and the N/2 of Lot A, All Within Block 38, Original Town of Powell, From B-G, General Business District. To R-M, Residential Mixed Use District. Councilman Young moved to approve Ordinance No. 2, 2023 on third reading, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED.
Ordinance No. 3, 2023: Attorney Kitchen Read by title only – An Ordinance Amending Section 17.32.020(A) By Adding Subsection (7) Allowing Accessory Structures and Uses. Councilman Logan moved to approve Ordinance No. 3, 2023 on third reading, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED.
Ordinance No. 4, 2023: Attorney Kitchen Read by title only – An Ordinance Enacting Section 17.32.035 on the Powell City Code to Allow Affordable Small Lot Exceptions to Minimum Lot Requirements In R-M, Residential Mixed Use District. Councilman Young moved to approve Ordinance No. 4, 2023 on third reading, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED.
Ordinance No. 5, 2023: Attorney Kitchen read by title only – An Ordinance Amending Section 17.36.060 of the Powell City Code Pertaining to and Reducing the Clear Area Vision Triangle From 55’ to 25’ for the Location of Structures. Councilman Logan moved to approve Ordinance No. 5, 2023 on second reading, seconded by Councilman Young, unanimous approval, MOTION CARRIED.
Ordinance No. 6, 2023: Attorney Kitchen Read by title only – An Ordinance Amending Section 5.080.040 of the Powell City Code Pertaining to Hours of Operation for Alcoholic Beverage Licensees by Allowing Request for Extended Hours for Two (2) Holidays Per Year. Councilman Hovivian moved to approve Ordinance No. 6, 2023 on second reading, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED. Adopt Capital Improvement Plan FY 2024-2028: Councilman Hovivian inquired on street repairs in the plan. Councilman Lensegrav moved to adopt the FY 2024-2028 Capital Improvement Plan, seconded by Councilman Logan, unanimous approval, MOTION CARRIED.
Agreement LEFTA Systems Shield Suite: Lt. McCaslin spoke on the software for tracking. Councilman Young moved to approve and authorize necessary signatures, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED.
Agreement Park County School District #1 for Pool: Administrator Thorington gave update on COLA increase and usage of rec side during meets. Councilman Lensegrav moved to approve and authorize necessary signatures, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED. Agreement Powell Swim Club for Pool: Administrator Thorington discussed the contract is for three (3) years and they will pay for up to 4 lanes per the agreement, dependent on usage. Councilman Hovivian moved to approve and authorize necessary signatures, seconded by Councilman Logan, unanimous approval, MOTION CARRIED.
Bid Award Slurry Seal: Administrator Thorington discussed that after the re-bid the recommended low bidder is Asphalt Preservation with a total of $2.015/square yard totaling $272,025. Councilman Hovivian moved to approve Asphalt Preservation and authorize all necessary signatures, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED.
Airport Master Plan Contract Coffman & Associates: Administrator Thorington discussed the contract and Attorney Kitchen recommended changing 10.10 from the title showing Indemnification to Non-Waiver of Sovereign Immunity. Councilman Lensegrav moved to approve the contract and authorize necessary signatures with the recommended change to 10.10 of the contract, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED. Adjourn: There being no further business to be considered at this meeting, Councilman Young moved to adjourn, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED. Council President Sapp adjourned the regular meeting at 6:26 p.m.
