January 18, 2021
The governing body of the City of Powell met in regular session at 6:00 p.m. on January 18, 2021 in the Council Chambers of City Hall. Mayor Wetzel called the meeting to order and the following were present: Mayor John Wetzel, Council Members Tim Sapp, Lesli Spencer, Steven Lensegrav, Geoff Hovivian and Zane Logan. Absent Councilman Floyd Young. City Officials: City Administrator Zack Thorington, City Clerk Tiffany Brando, City Attorney Sandee Kitchen and Deputy Attorney Scott Kath. Approval of Agenda: Councilman Lensegrav moved to approve the agenda as presented, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Approval of January 4, 2021 minutes: Councilwoman Spencer moved to approve minutes as presented, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED.
Bills and Claims: Mayor Wetzel abstained from item #45. Councilman Hovivian made a motion the bills be allowed and authorize the Treasurer to draw warrants for payment of the same, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Dash Storage Development Agreement Request First Development Park Lot 6, presented by Mike Birdsley requesting 5-year extension before curb gutter and sidewalk be installed. Mr. Birdsley indicated he is planning to have the property de-annexed but needs to get property owner to the east to also agree to de-annex. Administrator Thorington gave an update on the current 1994 agreement and Attorney Kath gave information on agreement and regulations and would need approval of all lot owners to make a change. Mayor Wetzel did not want to set a precedent and stated it would be best to de-annex to start. Councilman Logan gave insight on the original agreement. Councilwoman Spencer asked if staff could help with the de-annexation process of both lot owners. Committee Updates: Councilman Lensegrav update on golf board. Mayoral Appointments: Appointment of Bob Graff and Heath Streeter to Planning & Zoning Board. Councilman Lensegrav moved to approve, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Council Appointments as recommended and presented by Mayor Wetzel and indicate Councilman Logan is the WMPA representative. Councilman Hovivian moved to approve recommendations as presented, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED. Ordinance No. 1, 2021: An Ordinance Amending Section 9.20.030 of the Powell City Code Pertaining to the Sale of Tobacco, Electronic Cigarettes and Requirements for Minors. Councilman Lensegrav moved to approve on first reading, seconded by Councilman Logan, unanimous approval, MOTION CARRIED.
Ordinance No. 2, 2021: An Ordinance Amending Section 5.08.090 of the Powell City Code Regarding Alcoholic Beverage License Fees by Establishing a Fee for Satellite Winery Permits Manufacturer’s Off Premise Permits, Increasing the Resort Liquor License Fee, Removing Restrictions Regarding Permits to be Utilized on Facilities Owned, Operated and Maintained by the City of Powell. Councilwoman Spencer moved to approve on first reading, seconded by Councilman Sapp, unanimous approval, MOTION CARRIED.
Ordinance No. 3, 2021: An Ordinance Enacting Section 5.08.095 of the Powell City Code by Establishing a New Powell City Code Section that Consolidates Prior Language in the Code Concerning Restrictions on Permits if to be Utilized In or Upon a Facility Owned, Operated or Maintained by the City of Powell. Councilman Sapp moved to approve on first reading, seconded by Councilwoman Spencer, unanimous approval, MOTION CARRIED.
Ordinance No. 4, 2021: An Ordinance Revising Section 5.08.130 of the Powell City Code by Regarding Licensee Responsible for Violation by Replacing the Reference to Beer Gardens with Secured Patio. Councilman Lensegrav moved to approve on first reading, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED. Ordinance No. 5, 2021: An Ordinance Amending Section 5.08.240 of the Powell City Code Pertaining to Restrictions on Permittee’s for Catering Permits, Malt Beverage Permits by Adding Manufacture’s Off-Premise Permits and Replacing the Reference to Special Malt Beverage Permits with Malt Beverage Permits. Councilwoman Spencer moved to approve on first reading, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED.
Ordinance No. 6, 2021: An Ordinance Repealing Sections 5.08.220 Regarding Malt Beverage and Catering Permits-Limit per Person and 5.08.230 Regarding Hours and Duration of Malt Beverage and Catering Permits. Councilman Hovivian moved to approve on first reading, seconded by Councilman Lensegrav, unanimous approval, MOTION CARRIED.
Annual Depository Records read by Attorney Kitchen for First Bank and Bank of Powell. Councilman Lensegrav moved to approve, seconded by Councilman Hovivian, unanimous approval, MOTION CARRIED. Annual Disclosure of Conflict-of-Interest Statement read by Attorney Kitchen for Mayor, Council, City Administrator and Finance Director. Vining Substation Control House Bid presented by Administrator Thorington and received 6 bids the two low bids did not meet specifications and recommends bid to Trachte for $178,684. Councilman Lensegrav moved to approve and authorize all necessary signatures, seconded by Councilman Logan, unanimous approval, MOTION CARRIED.
There being no further business to be considered at this meeting, Councilwoman Spencer moved to adjourn, seconded by Councilman Lensegrav unanimous approval, MOTION CARRIED. Mayor Wetzel adjourned the regular meeting at 6:36 p.m.
