Affidavit for Collection of Property
I, Branden J. Martinez, of 441 Cook Ave., Billings, Montana 59101, hereinafter known as the “Affiant” certify that all of the following statements are true in regards to the Estate of Virginia Martinez who has passed away in the State of Montana, County of Yellowstone:
1. Decedent, Virginia Martinez, died on 10/1/2018 in the County of Yellowstone, In the State of Montana.
2. A copy of the decedent’s death certificate will be submitted along with this affidavit.
3. The value of the assets of the decedent’s estate exceeds the estate’s known liabilities.
4. The Decedent has liabilities and/or debs owed to creditors described as: $41,752 to Wyoming Department of Health. $4,665 to Collection Professional. $3,400 to Park County Treasurer. $3,235.93 to City of Powell.
5. The value of the decedent’s estate does not exceed the monetary limit of $500,000 imposed by the State of Wyoming.
6. There is no pending administration of the decedent’s estate.
7. There is no reasonable expectation that probate of the decedent’s estate is soon to commence.
8. The total number of heirs or devisees to the decedent is Two (2) identified as: Branden J. Martinez is the Decedent’s Son and is entitled to the following property: Real Estate at 557 Avenue E, Powell, Wyoming 82435. $125,000.
Katrina Martinez is the Decedent’s Daughter and is entitled to the following property: 1997 Dodge Van $200.
There are no additional assets or property of the Decedent.
9. All heirs or devisees will be given notice of this affidavit within 30 days of filing.
10. This document is governed under the laws in the State of Wyoming and shall not be filed with any local authority until the minimum time period has passed after the death of the Decedent.
