One charged as of Monday

Powell police are continuing to investigate a Wednesday incident where a pistol was reportedly fired on West Second Street.

The only individual charged in the case as of Monday afternoon, 19-year-old Sage M. Miears of Powell, has been charged with threatening an individual with a gun, but he is not alleged to have fired the shot.

According to a police affidavit filed in Miears’ case, a group of young adults had been hanging out at an apartment complex in the 100 block of West Second Street when someone began knocking on the back door of two of the apartments and was then running away.

Eventually, the young men left the apartment to try catching whoever was knocking on the doors, they told police. One of the apartment residents found three males dressed in hoodies near the alley. According to the resident, one of the individuals pointed a gun at his head and said, “You want to get shot?”

The resident told the male, who he recognized as Miears, to “go ahead,” and continued talking back, according to the affidavit. Miears allegedly then handed the gun off to one of the other males he was with, and the resident tackled Miears and hit him in the head, the document says.

At that point, there was a gunshot fired by an unknown male with Miears, and he, Miears and the other male ran away. Powell Police Investigator Dave Brown said no one was hit by a gunshot.

Police were summoned to the scene around 12:37 a.m. early on April 6. Officers recovered a Derringer pistol from the middle of the alley. The pistol had been reported stolen from a rural Park County residence earlier this year, along with 10 other guns, the affidavit says.

Powell police are working with the Park County Sheriff’s Department on the shooting and burglary cases.

Brown said the altercation wasn’t random and that it appeared the people involved knew each other.

“They were after something,” he said.

Miears was arrested Thursday night and charged with aggravated assault and battery. The felony charge alleges he threatened to use a drawn, deadly weapon. His bail was set at $50,000 cash at an initial court appearance on Friday.

At the time of his arrest, Miears was out on bond on an unrelated, still-pending burglary charge from last year.

Deputy Park County Attorney Tim Blatt said he expects other arrests to be made in coming days in connection with the incident.

“It’s likely that other charges will come out,” Blatt said.
